About this file
This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form used for self-certification of eligibility in response to Sources Sought Notices, Requests for Information (RFI), or solicitations.
The form requires offerors to self-certify that they meet the definition of an "Indian Economic Enterprise" (IEE) with Indian Ownership under 25 U.S.C. 47 and HHSAR 326.601. Enterprises must maintain eligibility throughout three critical periods: at the time of offer submission, at contract award, and during the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. Successful offerors must also maintain registration with the System of Award Management (SAM). False or misleading information submitted in offers is subject to criminal penalties under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. The form requires the offeror to indicate whether it does or does not meet the IEE definition and must be signed by an authorized representative, with required information including the name of the Federally Recognized Tribal Entity, the 51% owner of the IEE firm, business name, DUNS number, and certifying signature with printed name.
