About this file

Attachment D – Federal Forms Summary

This attachment contains federal compliance forms and requirements issued by SJCOG (San Joaquin Council of Governments) in partnership with the City of Ripon, San Joaquin County, Stanislaus County, and the California Department of Transportation for the Congestion Relief Alternative for SR 99 project. The document mandates that all consulting firms submit completed federal forms with their proposals, including Exhibit 10-Q (Disclosure of Lobbying Activities), Certification of Indirect Costs and Financial Management System, and a Cost Proposal. These forms must be signed and submitted as part of the proposal package and will become part of any resulting contract agreement. The attachment establishes SJCOG's nondiscrimination policy prohibiting discrimination based on race, color, national origin, sex, religion, age, or disability in all contract awards, performance, and administration, consistent with 49 Code of Federal Regulations Part 26 and the Disadvantaged Business Enterprises (DBE) program requirements.

The document provides detailed instructions for completing Exhibit 10-Q, which discloses any lobbying activities undertaken to influence covered federal actions. Consultants must report the type and status of federal action, details of lobbying entities engaged, compensation amounts and payment types, and specific descriptions of services performed or to be performed, including identification of federal officers or employees contacted. Failure to file required disclosures subjects the reporting entity to civil penalties ranging from $10,000 to $100,000 per violation. The form requires certification by an authorized representative and notes that disclosed lobbying information will be reported to Congress semiannually and made available for public inspection. All contractors and subcontractors must comply with these federal-aid requirements as conditions of contract award and performance.
