About this file
Attachment D is an Employment Eligibility Verification (EEV) Certification and Agreement form required by the Mississippi Transportation Commission for vendors contracting with the state. The document establishes compliance requirements with the Mississippi Employment Protection Act, Section 71-11-3 of the Mississippi Code of 1972, and federal work authorization programs administered by the U.S. Department of Homeland Security. Vendors must certify that they and any subcontractors are registered with and participating in the federal E-Verify program to electronically verify employment eligibility of newly hired employees. The agreement requires vendors to maintain records of subcontractor compliance and provide copies of verification documentation to the Mississippi Transportation Commission during the period any subcontractor is retained.
The certification must be executed by an authorized officer or agent of the contractor and sworn before a notary public. Vendors acknowledge that any violation of the agreement may result in contract cancellation, loss of business licenses or permits for up to one year, and potential criminal prosecution under 8 U.S.C §1324a(h)(3), including fines ranging from $1,000 to $10,000 or imprisonment for not less than one year, or both. The document requires completion of an EEV Company Identification Number and submission of the certified form as a condition of contracting with the Mississippi Transportation Commission.
