About this file
This is a Certifications document (Attachment C) for the Town of Royalston, Massachusetts, related to an RFP for a Solar Photovoltaic Project at the Royalston Landfill. The document outlines mandatory certifications and representations that proposers must provide as part of their submission to develop Solar Generating Facilities at the site located at 6 Town Dump Road, Royalston, MA 01368. The RFP seeks qualified renewable energy developers to propose projects that would lease the site or establish Power Purchase Agreements (PPAs) to generate financial benefits for the Town. Proposers are required to submit certifications addressing non-collusion, non-discrimination compliance, debarment status, qualifications, tax compliance, employment security contributions, workers' compensation insurance, and acknowledgment of site conditions including the closed and capped landfill, transfer station operations, and surrounding forested land.
Proposers must certify compliance with all applicable Federal and State statutes prohibiting employment discrimination, including the Americans with Disabilities Act and Executive Orders 227, 237, and 246. The document requires disclosure of all material bankruptcy filings, defaults, prior debarments, suspensions, litigation, regulatory enforcement actions, and environmental violations within the past ten years involving the proposer, project ownership entity, parent company, or key subcontractors. Proposers acknowledge that they bear responsibility for due diligence, permitting, interconnection, construction, operations, maintenance, decommissioning, environmental compliance, insurance, and indemnification. The certification stipulates that merchantable timber within approved project clearing areas remains the property of the Town unless otherwise approved in writing, and no clearing shall occur before completion of timber appraisal, Town approval of clearing limits, and receipt of all required permits and approvals.
