About this file
This is a Master Contract model document issued by the Colorado Department of Labor and Employment (CDLE), Division of Oil and Public Safety (OPS), for petroleum storage tank assessment, remediation, and emergency response services under RFP #KATA 2016000249-P. The contract establishes a framework for qualified contractors to provide services including site characterization/assessment, corrective action/remediation, and emergency response/initial abatement activities at petroleum-contaminated sites throughout Colorado. Work is authorized through task orders, emergency work authorizations, and unanticipated expense approvals rather than a fixed scope. The contract initial term runs from November 1, 2016, through October 31, 2019, with the State holding an option to extend for an additional two-year term at the same rates and conditions, provided written notice is given at least 30 days prior to contract expiration. The State reserves the right to award work to multiple contractors and does not guarantee any minimum work volume to any single contractor.
Contractor rates are based on the Reasonable Cost Guidelines (RCG) established by the Colorado Petroleum Storage Tank Committee and must be the lesser of the contractor's proposed rates or the RCG amounts. Compensation is contingent upon continuing availability of State and federal appropriations, with funding derived from the Colorado Petroleum Storage Tank Fund (PSTF), the Environmental Protection Agency (EPA), and the LUST (Leaking Underground Storage Tanks) Trust Fund. Payment terms specify that approved invoices are due within 45 days of receipt by OPS, with the potential for interest accrual on unpaid amounts after 45 days. Contractors must maintain comprehensive insurance coverage including workers' compensation, general liability ($1,000,000 minimum), automobile liability ($1,000,000 minimum), commercial environmental impairment liability ($5,000,000 minimum), and professional liability ($1,000,000 minimum). The contract includes performance evaluation and review requirements tracked in the statewide Contract Management System, and contractors must comply with federal requirements including the Federal Funding Accountability and Transparency Act (FFATA), criminal background checks for employees, and various nondiscrimination and compliance certifications.
