About this file
This is an Indian Health Service (IHS) Buy Indian Act Indian Economic Enterprise Representation Form, which is a certification document for federal contract opportunities.
The form is used in conjunction with solicitations, sources sought notices, and requests for information (RFI) related to Indian Health Service contracting. Offerors must self-certify whether they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined under 25 U.S.C. 47 (the Buy Indian Act) and HHSAR 326.601. The specific solicitation referenced is 75H71026Q00232 for a Blanket Purchase Agreement (BPA) (4+4OY) for toner cartridges for the Gallup Indian Medical Center, dated 08/04/2026. Offerors must maintain eligibility throughout three critical periods: when submitting an offer, at time of contract award, and during the full contract performance period, with immediate written notification required to the Contracting Officer if eligibility status changes. The form requires the offeror to identify the federally recognized tribal entity, the 51% owner of the Indian Economic Enterprise firm, the business name, DUNS number, and a certifying signature. Offerors must also be registered with the System of Award Management (SAM). The document includes penalties for false or misleading information, including violations under 18 U.S.C. 1001 for false certification and 31 U.S.C. 3729-3731 for false claims during contract performance.
