1.01 SUMMARY

A. This section specifies procedures for the technical submittals required in the Plans and Specifications.

NOTE:

1. The Contractor is responsible for making technical submittals as called for in the Plans and individual Specification Sections. The Contractor shall develop a submittal list within 14 Days after being issued the Notice To Proceed for Owner to review and approve. Contractor shall modify the submittal list as requested by Owner until approved.

2. During construction, if the Contractor installs products or materials which are not in conformance with the Plans and Specifications, that are not approved by the Owner through the submittal process, the Contractor will be required to remove such products or materials and replace with the specified product or material at no additional cost to the Owner.

B. Submittals shall contain information that will enable the Project Manager to assess whether the Contractor’s proposed materials, equipment or methods of work are in general conformance to the design intent and in compliance with the Plans and Specifications. The information may consist of product data, drawings, specifications, descriptive data, certificates, samples, mock-ups, test results and/or other information, as required in the individual Specification Sections and Plans.

1.02 CONTRACTOR RESPONSIBILITIES

A. Prior to submittal transmittal to the Project Manager,

1. Ensure the accuracy and completeness of the information contained in each submittal and that the material, equipment or method of work is as described in the submittal.

2. Ensure information is legible by the Owner. Faxed submittals are NOT acceptable.

3. Ensure that the information is transmitted and approved by Owner and as follows:

a.Prior to purchasing/leasing/ordering/installing
b.Early enough to allow a 7-day review period by the Owner, and tomeet the construction schedule.
c.Additional time may be required if submittal is inadequate or incomplete and requires revision and resubmittal.
d.Contractor is responsible to plan for preparation, submittal, review period and potential revision period without impact to project schedule.

4. Verify the material and equipment described in each submittal conforms to the requirements of the Specifications and Plans.

5. Ensure there is no conflict with other submittals.

6. Notify the Project Manager in each case where such submittal may affect the Work of another contractor or Owner.

B. Substitutions:

4. “Or Approved Equal” Substitutions: Shall be considered during bidding for products requiring an approved equal, provided they are submitted within the time period allowed stated in the ITB and the substitution complies with the Technical Specifications herein. Obtain written approval from the Project Manager, prior to bidding, by submitting the Substitution Request Form to the Single Point of Contact (located in the ITB document).

“Or Equal” or “Basis of Design” Substitutions: May be considered by the Project Manager during construction through the Submittal process.

Manufacturers and products listed in the Contract Documents establish minimum requirements for appearance, quality, utility, durability, function, and purpose, and are all considered to have the designation “or equal” associated with the manufacturer or product.

Substitutions Submittals should include complete data substantiating compliance of proposed substitution with Contract Documents.

C. Refer to the Contract Documents and State of Oregon General Conditions for additional information regarding submittals and substitutions.

PART 2 – PRODUCTS (not applicable)

PART 3 – EXECUTION

3.01 TRANSMITTAL PROCEDURE

A. General:

1. For each required submittal, submit two (2) copies of all required information not less than fourteen (14) Days prior to purchase or installation (if previously purchased). One copy will be returned to the Contractor. Individual sheets shall not exceed 22 inches x 34 inches. NOTE: SUBMITTALS MAY BE MADE ELECTRONICALLY VIA EMAIL WITH PDF ATTACHMENT(S) AS APPROVED BY PROJECT MANAGER.

2. Use a Submittal/Transmittal Form for material and equipment submittals. Use a separate form for items specified in separate, discrete sections for which the submittal is required. Use a single form for submittals for various items when the items taken together constitute a manufacturer’s package, or are related such that expediency indicates review of the package as a whole.

3. Assemble complete submittal package into a single indexed file incorporating all submittal requirements of a single Specification Division.

4. Name file with submittal number or other unique identifier, including revision identifier. Note the unique sequentially assigned number that will accompany each item submitted, on the transmittal form. Original submittal numbers shall have the format: “XXX”; where “XXX” is the sequential number assigned by the Contractor followed by an underscore and the applicable Specification Section. Resubmittals shall have the format: “XXX‑Y”; where “XXX” is the originally assigned submittal number and “Y” is a sequential letter assigned for resubmittals, i.e., A, B or C being the 1st, 2nd and 3rd resubmittals, respectively.

5. Mark each item to show applicable choices and options. Where Product Data includes information on several products that are not required or proposed for Work, clearly mark to indicate applicable information.

B. Deviation from Contract: Submit a request for substitution for deviations from the Specifications or Plans. Include the reason for the deviation and cost differential for the deviation. Deviations from the Contract shall be authorized by Change Order only.

C. Submittal Completeness: submittals that do not have all the information required to be submitted are not acceptable and will be returned without review.

D. Project Manager reserves the right to ask for submittals not referenced in this document.

3.02 REVIEW PROCEDURE

A. The Project Manager will review the submittal and return it to the Contractor. The returned material will consist of one (1) marked‑up copy of the submittal. The returned submittal will indicate one of the following actions:

1. If the review indicates the material, equipment or work method is in general conformance with the Plans/Specifications, the submittal copies shall be marked “Approved”. In this event, the Contractor may begin to incorporate the material/equipment/work method covered in the submittal.

2. If the review indicates the submittal is insufficient or that limited corrections are required, the submittal copies may be marked “Approved as Noted”. The Contractor may begin to implement the work method or incorporate materials/comments covered in the submittal in accordance with the corrections/comments noted.

3. If the review reveals the submittal is insufficient or contains incorrect data and the comments require revision and resubmittal, the submittal copies shall be marked “Not Approved, Resubmit”. In this case, the Contractor shall not undertake Work covered by this submittal until the submittal has been revised, resubmitted and returned to the Contractor with a marking of “Approved” or “Approved as Noted”.

4. If the review reveals the material, equipment, or Work does not require submittal, then the submitted copies shall be marked “Review Not Required Per Contract Documents.” In this event, the Contractor may begin to incorporate the material/equipment/Work covered by the submittal and no further action is required.

3.03 EFFECT OF REVIEW OF CONTRACTOR’S SUBMITTALS

A. Submittal review of what the Contractor proposes to provide shall not relieve the Contractor of his responsibility for errors therein, nor shall it be regarded as an assumption of risks or liability by the Owner, or by any officer or employee of the Owner.
