Summary of Attachment B - Special Terms & Conditions
This document contains the special terms and conditions for a Virginia Department of Conservation and Recreation invitation for bids regarding asphalt paving and maintenance work at Sky Meadows State Park. The project involves asphalt paving, improvements, general maintenance, and repairs of approximately 4,500 square yards of existing paved roadways and parking areas at the park's entrance road and parking areas located at 1012 Edmonds Lane, Delaplane, VA 20144. A mandatory pre-bid conference is scheduled for 11:00 AM on September 29, 2026, at the Sky Meadows State Park Visitor Center, with attendance required for bid submission eligibility. Bids must remain valid for 60 days from submission, and the Commonwealth reserves the right to make awards on a grand total basis to the lowest responsive and responsible bidder. The contract may be cancelled or terminated by either party without penalty upon 60 days' written notice, though termination after the initial 12 months requires such notice from either the Commonwealth or contractor.
The special terms and conditions establish comprehensive requirements for contractor performance and compliance, including mandatory licensing appropriate to the contract value under Virginia's State Board of Contractors classifications. Contractors must maintain required licenses throughout the contract term and immediately notify the agency of any license revocation. All bidders must submit a Small Business Subcontracting Plan demonstrating efforts to utilize Department of Small Business and Supplier Diversity certified businesses, with a statewide goal of 42 percent of purchases from small businesses. Prime contractors winning awards exceeding $100,000 must provide monthly subcontractor reporting through the eVA portal, while those exceeding $200,000 must report on both certified and non-certified subcontractors. Additional requirements include E-Verify program participation for employers with more than 50 employees on contracts exceeding $50,000, State Corporation Commission identification or compliance statements, commercial warranties, submission of evidence of job site inspection, compliance with occupational safety and health standards, and prohibition of minors under age 18 on work sites except as permitted under applicable child labor laws.
