About this file

This is a certification document issued by the South Carolina Department of Transportation (SCDOT) addressing conflicts of interest requirements for contractors and consultants on the Heavy Equipment Safety Training project. The certification, dated September 9, 2020, establishes compliance obligations for all parties involved in the procurement, award, and execution of the contract. The document requires that contractors and consultants certify compliance with Section 57-1-350(G) of the South Carolina Code of Laws, which prohibits SCDOT Commission members from holding any direct or indirect interest in project proposals, bids, or resulting contracts during their term of appointment and for one year following termination of that appointment.

The certification extends these conflict-of-interest provisions to all consultants, subconsultants, contractors, vendors, suppliers, employees, and agents of the primary contractor or consultant. The contractor must represent and warrant ongoing compliance with these provisions throughout the entire contract period, with particular attention to any involvement through subcontractors, consultants, vendors, or suppliers. The document requires an authorized representative of the contractor or consultant to sign and date the certification as a condition precedent to contract execution, thereby acknowledging understanding of and agreement to maintain compliance with the specified conflict-of-interest restrictions.
