I. GENERAL

1 FISH RIVER AND WEEKS BAY MARSH RESTORATION PROJECT

DESCRIPTION

The Fish River and Weeks Bay Marsh Restoration Project is located in Baldwin County, Alabama on Fish River at the Weeks Bay National Estuarine Research Reserve (NERR) property north of US Highway 98. The Project Construction Site is approximately eighty (80) acres and is surrounded by public lands that were previously used as a campground. The Project Construction Site contains salt marsh habitat interspersed with approximately eight (8) acres of canals that were dredged in the late 1960’s and early 1970’s to facilitate access to the campground and a small docking facility. The project consists of all Work necessary to degrade borrow areas and place material within the canal fill areas. The material will be obtained from within the Project Construction Site.

2 SUMMARY OF THE WORK

Base Bid shall consist of Fill Areas: 1 and 2 (Does Not Include Fill Area 2 Expansion):

The Base Bid includes the following items in accordance with the Contract Documents:

Mobilization and Demobilization;

Performance and Payment Bonds;

Pre-construction Surveying;

Pay Surveys;

Post-construction Surveying;

Clearing and Grubbing;

Debris Removal;

Canal Fill (Volume in Place);

Erosion and Turbidity Control Measures; and

Special Construction Sign (Temporary Navigation Warning Sign).

Bid Alternative Number 1-Fill Area 3:

The Bid Alternative Number 1-Fill Area 3, if awarded, includes the following items in accordance with the Contract Documents:

Mobilization and Demobilization;

Performance and Payment Bonds;

Pre-construction Surveying;

Pay Surveys;

Post-construction Surveying;

Clearing and Grubbing;

Canal Fill (Volume in Place); and

Erosion and Turbidity Control Measures.

It is the intent of the GOVERNMENT to award this Bid Alternative Number 1 provided the awarded Base Bid including this Bid Alternative Number 1 is within funding limitations.

Bid Alternative Number 2-Fill Area 2 Expansion Area:

The Bid Alternative Number 2-Fill Area 2 Expansion Area, if awarded includes the following items in accordance with the Contract Documents:

Performance and Payment Bonds;

Pre-construction Surveying;

Pay Surveys;

Post-construction Surveying;

Canal Fill (Volume in Place); and

Erosion and Turbidity Control Measures.

It is the intent of the GOVERNMENT to award this Bid Alternative Number 2 provided the awarded Base Bid and the awarded Bid Alternative Number 1 including this Bid Alternative Number 2 is within funding limitations and sufficient infill volume is available within the borrow areas.

3 SCOPE

The CONTRACTOR shall provide all labor, materials, tools, equipment, plant, supplies, superintendence, submittals, incidentals, and services necessary or required to fully complete the Work for “Fish River and Weeks Bay Marsh Restoration” in accordance with these Specifications and in conformity to the lines, grades, and elevations shown on the Plans. Major tasks associated with this Work include the items described in Paragraph I-2 of these Technical Provisions of the Specifications.

4 PROJECT CONSTRUCTION SITE

Project Construction Site Work Limits are shown on Plan Sheet GD-101.

The CONTRACTOR shall not work beyond these Project Construction Site Work Limits without prior GOVERNMENT approval. Work limits do not include any identified no-work area.

5 PHYSICAL DATA

Information and data furnished or referred to in the Contract Documents are furnished for the CONTRACTOR'S information. However, it is expressly understood that the GOVERNMENT will not be responsible for any interpretation or conclusion drawn there from by the

CONTRACTOR. Likewise, the GOVERNMENT will not be responsible for any information provided to the CONTRACTOR by any information agency or other party.

The physical conditions of the borrow and fill areas indicated on the Plans and in these Specifications are the result of site investigations conducted using bathymetric surveys, topographic surveys, cultural resources surveys, and sediment sampling. While the GOVERNMENT’S bathymetric survey, topographic survey, cultural resources surveys and sediment samples are representative of surface or subsurface conditions at their specific locations and vertical reaches, variations in the characteristics of the surface or subsurface materials are possible and should be expected. Interpretations as shown in the Plans between sampling points are estimates of expected average conditions in these areas and are provided for the convenience and use of the CONTRACTOR but should not be taken as the actual conditions at each point beyond the sampling points. Should any questions or discrepancies arise, the CONTRACTOR shall report conditions to the GOVERNMENT immediately. Copies of the boring logs are included in Appendix A: Geotechnical Report of these Technical Provisions of the Specifications.

The physical conditions of the borrow and fill areas, as indicated on the Plans, are based on bathymetric and topographic surveys, and sediment sampling data acquired in March 2019.

5.1 Weather Conditions:

The Project Construction Site generally has a mild subtropical climate and may be affected by tropical storms and hurricanes primarily from June through November and by stormy and/or rainy weather, including severe thunderstorms, during any time of the year. The CONTRACTOR shall be responsible for obtaining information concerning rain, wind, and wave conditions that could influence safety and construction operations prior to making a bid. A list of publications containing climatological and meteorological observations and data for the Project Construction Site is provided below. Other publications or information sources are available in addition to the following:

5.1.1 Local Climatological Data: Monthly Summary published by the National Oceanic and Atmospheric Administration (NOAA), Asheville, NC. Subscription price and ordering information is available from the National Climatic Data Center, Federal Building, Asheville, NC 22801. This publication gives hourly wind speed and direction observations. The Annual Summary gives a summary of the observations for the period of record.

5.1.2 Summary of Synoptic Meteorological Observations: North American Coastal Marine Areas Atlantic and Gulf Coasts. Produced by the National Weather Service, U.S. Department of Commerce. Distributed by the National Technical Information Service, U.S. Department of Commerce.

5.2 Access to the Project Construction Site:

Land access to the Project Construction Site will be provided by the property owners.

Areas that may not be accessed by land may be accessed through the canals on the Project Construction Site.

5.3 Obstruction to Navigation:

The CONTRACTOR shall operate in compliance with pertinent U.S. Coast Guard regulations and conduct the Work in such a manner as to minimize any obstruction to navigation. Failure of the CONTRACTOR to familiarize himself/herself with all terms, conditions, and provisions of the rules and regulations applicable to the Work shall not relieve them of their responsibility under the Contract. If the CONTRACTOR'S floating equipment so obstructs any navigation channel as to make navigation difficult or endanger the passage of vessels, said equipment shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. Upon completion of the Work, the CONTRACTOR shall promptly remove the floating and submerged equipment, as well as ranges, buoys, piles, and other marks or objects placed in navigable waters or on shore unless otherwise noted in these Contract Documents.

5.4 Local Inlets, Waterways, and Ports:

The canals within the Project Construction Site are connected to Fish River and are close to Bon Secour Bay. Bon Secour Bay is connected to the eastern portion of Mobile Bay and contains a portion of the Gulf Intracoastal Waterway (GIWW). Some areas within the canals and bay are extremely shallow and may require shallow draft vessels to navigate.

Boat traffic offshore and around Bon Secour Bay will consist primarily of pleasure boats, commercial fishing boats, commercial oyster harvesting vessels and GIWW traffic. All inlets, waterways, and ports are used at the CONTRACTOR'S own risk. The CONTRACTOR is responsible for any damage to any private property due to activity by the CONTRACTOR.

5.5 Navigation Safety:

Navigable depths shall not be impaired except as allowed by laws regulating navigation in the area. As necessary, it is the CONTRACTOR’S responsibility to select equipment that can navigate to the Project Construction Site, and operate at the Project Construction Site, without dredging or excavation. All equipment shall remain floating at all times during the transit to the Project Construction Site. The CONTRACTOR is referred to the following GOVERNMENT website for navigation information and charts:

6 PAYMENT FOR MOBILIZATION AND DEMOBILIZATION

6.1 General:

Mobilization and demobilization includes all costs necessary to prepare and move personnel, equipment, materials, supplies and incidentals to and from the Project Construction Site, establish construction offices, and other facilities necessary for the Work, improve and maintain the staging area(s) as deemed necessary by CONTRACTOR (including coordination with property owners), and any other preconstruction expenses necessary to perform the Work and any post-construction Work including but not limited to final Project Construction Site cleanup. All costs connected with mobilization and demobilization will be paid for at the Contract Lump Sum Price for Mobilization/Demobilization (Line Item 0001, Base Bid), and

Mobilization/Demobilization (Line Item 0101, Bid Alternative Number 1). Material costs for items listed or subsidiary to the major Work items listed on the Schedule of Prices shall not be included under mobilization and demobilization.

6.2 Arbitrary Mobilization by CONTRACTOR:

GOVERNMENT shall pay for only two (2) mobilization and demobilization efforts (one (1) for the Base Bid and one (1) for the Bid Alternative Number 1). Under no circumstances will the CONTRACTOR demobilize from the Project Construction Site without the written consent of the GOVERNMENT, unless one or more of the following occurs: the Work is complete, weather or sea state conditions require movement from the Project Construction Site, a condition exists that threatens the safety and welfare of personnel or threatens equipment, and/or the time frame provided for the Work in the Contract has expired without amendment by the GOVERNMENT through a Change Order, or the State or Federal Permits have expired.

6.3 Ratio of Mobilization (60%) and Demobilization (40%) Effort:

Sixty percent (60%) of the mobilization/demobilization Contract Lump Sum Price of (Line Item 0001, Base Bid) will be paid to the CONTRACTOR upon mobilization to the Project Construction Site and the completion of one-half (0.5) acres of clearing and grubbing for the Base Bid.

Sixty percent (60%) of the Mobilization/Demobilization Contract Lump Sum Price of (Line Item 0101, Bid Alternative Number 1) will be paid to the CONTRACTOR upon mobilization to Fill Area 3 and the completion of one-half (0.5) acres of clearing and grubbing.

The remaining forty percent (40%) of the Contract Lump Sum Price of Mobilization/Demobilization (Line Item 0001, Base Bid), and Mobilization/Demobilization (Line Item 0101, Bid Alternative Number 1) will be paid to CONTRACTOR upon final acceptance of the Work and completion of Final Construction Site Clean-up.

6.4 Justification of Costs:

In the event the GOVERNMENT considers that the cost for mobilization does not bear a reasonable relation to the cost of the entire Work in this Contract, the GOVERNMENT may require the CONTRACTOR to produce cost data to justify this portion of the bid. Failure to justify such price to the satisfaction of the GOVERNMENT will result in payment of estimated mobilization costs, as determined by the GOVERNMENT at the completion of mobilization, and payment of the remainder of this item in the final payment under this Contract.

6.5 Payment Requests:

The CONTRACTOR may apply for payment for Mobilization on the monthly Application for Payment upon complete mobilization to the Project Construction Site for the Base Bid and to the Fill Area 3 (Bid Alternative Number 1). Demobilization effort will be included in the final Application for Payment for Work under this Contract.

7 PAYMENT FOR PERFORMANCE AND PAYMENT BONDS

All costs connected with obtaining performance and payment bonds for the Work will be paid for at the Contract Lump Sum Price for this item: Performance and Payment Bonds (Line Item 0002, Base Bid), Performance and Payment Bonds (Line Item 0102, Bid Alternative Number 1), and Performance and Payment Bonds (Line Item 0201, Bid Alternative Number 2). The CONTRACTOR may apply for one hundred percent (100%) payment of this item following written approval by the GOVERNMENT of the Schedule of Prices.

8 PAYMENT FOR PRE-CONSTRUCTION SURVEYING

8.1 Pre-construction Surveys

8.1.1 General:

The pre-construction survey shall consist of bathymetric and topographic surveying of the Project Construction Site in accordance with the Plans and Specifications to document pre-construction conditions. All costs connected with the pre-construction survey will be paid for at the Contract Lump Sum Price for Pre-construction Surveying (Line Item 0003, Base Bid), Pre-construction Surveying (Line Item 0103, Bid Alternative Number 1), and Pre-construction Surveying (Line Item 0202, Bid Alternative Number 2). Payment will also include all other items of overhead, profit, labor, material, submittals, and any other costs incidental to performing the Work.

8.1.2 Payment Requests:

The CONTRACTOR may apply for payment for the pre-construction survey on the monthly Application for Payment once the completed survey has been submitted to and accepted by the GOVERNMENT in the survey format described in Paragraph II-17 of these Technical Provisions of the Specifications.

8.2 Pre-construction Hazard Survey

8.2.1 General:

The pre-construction hazard survey shall consist of a magnetometer survey and ground-truthing by probing to determine the depth of magnetometer hits and any other surveys and investigations as required of the Project Construction Site in accordance with the Plans and Specifications. All costs connected with the pre-construction hazard survey will be paid for at the Contract Lump Sum Price for Pre-construction Surveying (Line Item 0003, Base Bid), Pre-construction Surveying (Line Item 0103, Bid Alternative Number 1), and Pre-construction Surveying (Line Item 0202, Bid Alternative Number 2), for which payment will also include all other items of overhead, profit, labor, material, submittals, and any other costs incidental to performing the Work.

8.2.2 Payment Requests:

The CONTRACTOR may apply for payment on the monthly Application for Payment for the pre-construction hazard survey once the completed survey has been submitted to and accepted by the GOVERNMENT in the survey format described in Paragraph II-16 of these Technical Provisions of the Specifications.

9 PAYMENT FOR PAY SURVEYS

9.1 General:

Pay surveys shall consist of bathymetric and topographic surveying of the Project Construction Site in accordance with the Plans and Specifications. Pay surveys shall be performed within two (2) weeks of completion of fill Work within the area of the pay survey. All costs connected with the pay surveys will be paid for at the Contract Lump Sum Price for Pay Surveys (Line Item 0004, Base Bid), Pay Surveys (Line Item 0104, Bid Alternative Number 1), and Pay Surveys (Line Item 0203, Bid Alternative Number 2). Payment will also include all other items of overhead, profit, labor, material, submittals, and any other costs incidental to performing the Work.

9.2 Payment Requests:

The CONTRACTOR may apply for payment on the monthly Application for Payment for the pay survey once the completed survey has been submitted to and accepted by the GOVERNMENT in the survey format described in Paragraph II-17 of these Technical Provisions of the Specifications.

10 PAYMENT FOR POST-CONSTRUCTION SURVEYING

10.1 General:

The post-construction, or as-built, survey shall consist of bathymetric and topographic surveying of the Project Construction Site in accordance with the Plans and Specifications. The post-construction survey shall be performed within two (2) weeks of completion of all Work. All costs connected with the post-construction survey will be paid for at the Contract Lump Sum Price for Post-Construction Surveying (Line Item 0005, Base Bid), Post-Construction Surveying (Line Item 0105, Bid Alternative Number 1), and Post-Construction Surveying (Line Item 0204, Bid Alternative Number 2), for which payment will also include all other items of overhead, profit, labor, material, submittals, and any other costs incidental to performing the Work.

10.2 Payment Requests:

The CONTRACTOR may apply for payment on the monthly Application for Payment for the post-construction survey once the completed surveys of the Project Construction Site have been submitted to and accepted by the GOVERNMENT in the survey format described in Paragraph II-17 of these Technical Provisions of the Specifications.

11 PAYMENT FOR CLEARING AND GRUBBING

11.1 General:

This Work consists of clearing all trees, logs, brush, and other vegetation above the ground level; grubbing all underground tree roots and other root systems; and legal

disposal of all listed materials in accordance with the Plans and Specifications. All costs connected with clearing and grubbing will be paid for at the Contract Unit Price per acre for Clearing and Grubbing (Line Item 0006, Base Bid), and Clearing and Grubbing (Line Item 0106, Bid Alternative Number 1), for which payment will also include all other items of overhead, profit, labor, material, submittals, disposal costs, and any other costs incidental to performing the Work.

11.2 Payment Requests:

The CONTRACTOR may request payment for the Contract Unit Price per acre of clearing and grubbing upon submittal of the required documentation and acceptance by the GOVERNMENT. Price and payment for this item shall constitute full compensation for all materials, labor, supplies and equipment required for clearing and grubbing. This Work is considered complete when the areas have been cleared and grubbed to an acceptable level as determined by the GOVERNMENT and documentation of disposal of all cleared and grubbed material has been provided by the CONTRACTOR to the GOVERNMENT.

12 PAYMENT FOR DEBRIS REMOVAL

12.1 General:

This Work consists of clearing all debris and structures within the Project Construction Site specified for removal per the Plans and legally disposing of all materials in accordance with the Specifications. All costs connected with debris removal will be paid for at the Contract Lump Sum Price for Debris Removal (Line Item 0007, Base Bid), for which payment will also include all other items of overhead, profit, labor, material, submittals, disposal costs, and any other costs incidental to performing the Work.

12.2 Payment Requests:

The CONTRACTOR may request payment for the Contract Lump Sum Price upon submittal of the required documentation and acceptance of debris removal by the GOVERNMENT. Price and payment for this item shall constitute full compensation for all materials, labor, supplies and equipment required for debris removal. This Work is considered complete when debris have been removed to an acceptable level as determined by the GOVERNMENT and documentation of disposal of all debris material has been provided by the CONTRACTOR to the GOVERNMENT.

13 PAYMENT FOR CANAL FILL (VOLUME IN PLACE)

13.1 General:

Costs associated with this Work, including costs associated with, but not limited to, layout, site restoration and repairs, excavation of material, material transport, fill placement, and other materials and Work shall be included in the Contract Unit Price per cubic yard for Canal Fill (Volume in Place) (Line Item 0008, Base Bid), Canal Fill (Volume in Place) (Line Item 0107, Bid Alternative Number 1), and Canal Fill (Volume in Place) (Line Item 0205, Bid Alternative Number 2), which payment shall also include all other items of overhead, profit, labor, material, and any other costs incidental to performing the Work.

The CONTRACTOR shall anticipate encountering fine-grained materials and sands at the Project Construction Site; however, the CONTRACTOR may also encounter other debris. Bidders are expected to examine the geotechnical report in Appendix A of these Technical Provisions of the Specifications, the site of Work and history of similar work in the area and decide for themselves the character of the materials and the measures necessary to perform the Work within the required schedule as well as safeguard their personnel, equipment and the public. Local variations in the subsurface materials are to be expected and, if encountered, will not be considered as being materially different.

All material shall be excavated from within the borrow areas specified in the Plans.

Under no circumstances shall material be obtained from outside the established horizontal and vertical limits of the borrow areas.

13.2 Payment Surveys:

Payment quantities will be based on the pre-construction and pay survey transects shown in the Plans, with volumes calculated from those survey points as detailed in Paragraph 13.3 of these Technical Provisions of the Specifications. The CONTRACTOR may choose to use the as-built survey as a payment survey. Payment surveys shall be performed within two (2) weeks of completion of fill Work within the area of the pay survey. The GOVERNMENT will verify the pay quantities provided by the CONTRACTOR based on pre-construction and pay surveys conducted by the CONTRACTOR and accepted by the GOVERNMENT. Surveys shall be certified by a Licensed Surveyor or Professional Engineer (licensed professional) registered in the State of Alabama. The licensed professional shall be employed by a firm registered to perform land surveys in the State of Alabama. The CONTRACTOR shall notify the GOVERNMENT at least five (5) working days prior to when the payment surveys will be conducted. The GOVERNMENT, at its discretion, may verify the pay survey results of the CONTRACTOR. The GOVERNMENT’S survey will be used for payment purposes if, in the GOVERNMENT’S opinion, a significant difference is found between the CONTRACTOR'S pay survey and the GOVERNMENT’S survey.

The surveys will be conducted per the specifications provided in Paragraph II-17 of these Technical Provisions of the Specifications. All costs connected with the pay surveys shall be included in the Contract Lump Sum Price for Pay Surveys (Line Item 0004, Base Bid), Pay Surveys (Line Item 0104, Bid Alternative Number 1), and Pay Surveys (Line Item 0203, Bid Alternative Number 2).

13.3 Computation of Payment Volumes:

The volume of fill material shall be calculated by completed fill area. Portions of fill areas shall not be considered for acceptance unless otherwise approved by the

GOVERNMENT.

Payment volumes will be calculated by the GOVERNMENT using AutoCAD Civil3D software, with the surface-to-surface volume calculation method. Required survey points for computation of surfaces are detailed in the Plans, and only those points will be used for surface and volume computations. No other survey points will be considered in computing pay volumes unless otherwise approved by the GOVERNMENT. No payment will be provided for fill placed above or beyond the construction template.

The CONTRACTOR shall provide their volume calculations along with each monthly Application for Payment to the GOVERNMENT to determine if the GOVERNMENT calculated quantities are in agreement, as determined by the GOVERNMENT.

Payment quantities will be based on GOVERNMENT calculated quantities.

13.4 Fill Tolerances:

Payment will be for fill placed within the construction template only, as shown in the Plans. The tolerance is a non-pay tolerance.

Any fill material placed above the template may be left in place at the discretion of the GOVERNMENT; however, this fill material will not be included in the fill pay quantities. The GOVERNMENT may require removal / grading of fill material placed above the upper tolerance.

The vertical tolerance for placed fill in Fill Area 1, Fill Area 2, or Fill Area 3 is minus one-half feet (-0.5’) for the fill areas. Fill placement must at least meet the tolerance below the construction template within ninety percent (90%) of each acceptance segment (by area). The CONTRACTOR may be required by the GOVERNMENT to fill any deficient acceptance segment to meet the lower construction template tolerance.

There is no vertical fill tolerance for Fill Area 2 Expansion, and the CONTRACTOR is not required to fill Fill Area 2 Expansion to ninety percent (90%) by area.

13.5 Acceptance Notification:

The notification of rejection or acceptance of a fill area will be based on written notification provided by the GOVERNMENT to the CONTRACTOR after the GOVERNMENT has reviewed the submitted calculations and survey data. After the calculations and survey data have been received by the GOVERNMENT, the GOVERNMENT will have four (4) working days to review the data and prepare a written response indicating whether the segment(s) have been accepted or rejected, and the reason for rejection, if applicable.

13.6 Payment Requests:

The CONTRACTOR may request payment for the Contract Unit Price per cubic yard of Canal Fill (Volume in Place) (Line Item 0008, Base Bid), Canal Fill (Volume in Place) (Line Item 0107, Bid Alternative Number 1), and Canal Fill (Volume in Place) (Line Item 0205, Bid Alternative Number 2) on completion of the canal fill Work within the area of Pay Survey and acceptance by the GOVERNMENT. The CONTRACTOR shall submit to the GOVERNMENT for review, on a monthly basis, an Application for Payment filled out and signed by the CONTRACTOR covering the Work completed as required by the Contract Documents and accompanied by such supporting documentation as is required by the Contract Documents and also as the GOVERNMENT may reasonably require, which includes the results of any surveys and calculations.

14 PAYMENT FOR EROSION AND TURBIDITY CONTROL MEASURES

14.1 General:

This Work consists of, but is not limited to, obtaining a construction stormwater National Pollutant Discharge Elimination System (NPDES) Permit, maintaining compliance with the Permit, Construction Best Management Practices Plan (CBMPP), and those items of temporary soil erosion and sediment control necessary for the management of construction stormwater discharge quality. The CONTRACTOR shall provide and maintain temporary soil erosion and sediment controls designed to protect the Project Construction Site from soil erosion and adjacent property and waters as required by Federal, State and Local regulations. All costs connected with the erosion and turbidity control measures will be paid for at the Contract Lump Sum Price for the Erosion and Turbidity Control Measures (Line Item 0009, Base Bid), Erosion and Turbidity Control Measures (Line Item 0108, Bid Alternative Number 1), and Erosion and Turbidity Control Measures (Line Item 0206, Bid Alternative Number 2), for which payment will also include all other items of overhead, profit, labor, submittals, material, Permit costs, and any other costs incidental to performing the Work.

14.2 Payment Requests:

Once the CONTRACTOR has obtained the construction stormwater NPDES Permit and submitted the appropriate documentation, the CONTRACTOR shall be paid twenty percent (20%) of the Contract Lump Sum Price Erosion and Turbidity Control Measures (Line Item 0009, Base Bid), Erosion and Turbidity Control Measures (Line Item 0108, Bid Alternative 1), and Erosion and Turbidity Control Measures (Line Item 0206, Bid Alternative 2), for erosion and turbidity control measures. Once the CONTRACTOR has completed all Canal Fill Work activities, the CONTRACTOR shall be paid fifty percent (50%) of the Contract Lump Sum Price Erosion and Turbidity Control Measures (Line Item 0009, Base Bid), Erosion and Turbidity Control Measures (Line Item 0108, Bid Alternative 1), and Erosion and Turbidity Control Measures (Line Item 0206, Bid Alternative 2), for erosion and turbidity control measures. Once the CONTRACTOR has completed site stabilization as approved by the GOVERNMENT, the CONTRACTOR shall be paid thirty percent (30%) of the Contract Lump Sum Price Erosion and Turbidity Control Measures (Line Item 0009, Base Bid), Erosion and Turbidity Control Measures (Line Item 0108, Bid Alternative 1), and Erosion and Turbidity Control Measures (Line Item 0206, Bid Alternative 2), for erosion and turbidity control measures. This Work is considered complete upon approval by the GOVERNMENT and removal of temporary erosion and turbidity control measures.

15 PAYMENT FOR SPECIAL CONSTRUCTION SIGN (TEMPORARY NAVIGATION

WARNING SIGN)

15.1 General:

This Work consists of furnishing and constructing, layout, and installing a temporary navigation warning sign. All costs connected with the temporary navigation warning sign will be paid for at the Contract Unit Price for the Special Construction Sign (Temporary Navigation Warning Sign) (Line Item 0010, Base Bid), for which payment will also include all other items of overhead, profit, labor, material, submittals, and any other costs incidental to performing the Work.

15.2 Payment Requests:

Upon installation and approval by the GOVERNMENT, the CONTRACTOR may request payment for the special construction sign (temporary navigation warning sign) at the Contract Unit Price on the monthly Application for Payment.

II. MATERIALS AND EXECUTION

16 PRE-CONSTRUCTION HAZARD SURVEY

16.1 Scope:

CONTRACTOR shall furnish all the materials, submittals, labor and equipment necessary to perform a pre-construction hazard survey. Prior to commencing any Work at the Project Construction Site, the CONTRACTOR shall conduct a magnetometer survey and ground-truthing by probing to determine the depth of magnetometer hits and any other surveys and investigations as required along the borrow and fill areas. All surveys shall be performed by personnel who are under the direct supervision of a professional land surveyor licensed in the State of Alabama.

Survey data shall reference the North American Datum of 1983 (NAD 83), Alabama West Zone, U.S. Survey Feet for horizontal control, and the North American Vertical Datum of 1988 (NAVD 88), U.S. Survey Feet, with orthometric heights calculated using Geoid12B for vertical control. Horizontal and vertical control shall be established by using the monument specified in the Plans. All suspected or known utilities, pipelines or other obstructions shall be probed in coordination with utilities/pipeline/obstruction owner and appropriately marked throughout the Work.

16.2 Submittals:

CONTRACTOR shall submit pre-construction hazard survey drawings to the GOVERNMENT prior to commencing any Work. A report documenting the survey methodology, results, and a summary of associated interpretations and recommendations shall be submitted to the GOVERNMENT. In addition, all potential hazards or obstructions shall be plotted on the pre-construction survey drawing submittal. Drawings shall clearly show all track lines, coordinates, amplitudes, signature types, and signature widths of all hits. The survey shall also show the coordinates, top elevation and ground cover for all pipelines, utilities, or obstructions, if any. Pre-construction hazard survey submittal shall be signed and sealed by a professional land surveyor licensed in the State of Alabama.

16.3 Survey Notification:

CONTRACTOR shall notify the GOVERNMENT no later than five (5) working days prior to performing pre-construction hazard survey so that GOVERNMENT and Construction Observer designee may accompany the survey crew and witness the Work.

17 PRE-CONSTRUCTION, PAY, AND POST-CONSTRUCTION SURVEYS

17.1 Scope:

CONTRACTOR shall furnish all the materials, submittals, labor and equipment necessary to perform pre-construction, pay and post-construction surveys. All surveys shall be performed by personnel who are under the direct supervision of a professional land surveyor licensed in the State of Alabama. Survey data shall reference the North American Datum of 1983 (NAD 83), Alabama West Zone, U.S. Survey Feet for

horizontal control, and the North American Vertical Datum of 1988 (NAVD 88), U. S.

Survey Feet for vertical control. Horizontal and vertical control shall be established by using the monuments specified in the Plans.

17.2 Submittals:

Submittals required under this paragraph include the following:

a. Name and Affiliation of Professional Land Surveyor(s) (For Information Only);

b. Survey Notification (For Information Only);

c. Pre-construction Survey Data and Drawings;

d. Pay Survey Data and Drawings; and

e. Post-construction Survey Data and Drawings.

17.3 Professional Land Surveyor:

Prior to commencing surveying activities, the CONTRACTOR shall provide the GOVERNMENT with the name and affiliation of professional surveyor(s) to be used on the project. All survey submittals shall be signed and sealed by a professional land surveyor licensed in the State of Alabama.

17.4 Survey Drawings:

Plan-view and cross-section plots showing pre-construction and pay/ post-construction lines and grades shall accompany the monthly Application for Payments. All survey data shall be referenced to the project datums shown on the Plans. Cover sheets shall be included for all submittals. All plots shall contain title blocks and clearly display the following information:

a. Project name;

b. Federal Agency Name and Project Number;

c. Professional Land Surveyor’s seal, signature, and affiliation;

d. Date(s) surveys were performed;

e. Location and description of survey control;

f. Vertical and horizontal datums;

g. Sheet names and numbers;

h. Name of CONTRACTOR;

i. Graphic Scale Bar(s);

j. Transducer frequency (as applicable); and

k. Description of submittal.

Drawings shall be formatted for white 12”×18” paper. Digital copies shall be provided in AutoCAD (version 2018 or earlier) and Adobe PDF formats. An AutoCAD 3D surface (TIN) utilizing survey data shall be developed and included with electronic AutoCAD files submission for post-construction survey. All digital submittal data shall be provided on labeled CD or DVD. Point files of the pre-construction, pay, and post-construction surveys shall be included in digital submittals and shall contain Point number, Northing (NAD 83 US ft), Easting (NAD 83 US ft), Elevation (NAVD 88 ft) and Description.

Survey drawings shall meet the following minimum layout requirements:

a. Pre-construction survey drawings shall show pre-construction cross sections superimposed over the design survey data and the design template(s) shown in the Plans.

b. Pre-construction Hazard Survey data shall be plotted over the project layout sheets provided in the Plans.

c. Pay survey cross-sections shall be plotted over pre-construction survey data, where available, and the design template(s).

d. Post-construction survey plots shall show post-construction cross-sections superimposed over pay and pre-construction cross-sections.

17.5 Survey Notification:

The GOVERNMENT shall be notified five (5) working days prior to all surveys performed by CONTRACTOR so that the GOVERNMENT and the Construction Observer may accompany the survey crew and witness the Work. The GOVERNMENT may conduct a hold point inspection prior to any pay and/ or post-construction surveying to verify field conditions prior to the survey.

17.6 Pre-construction Survey:

Prior to commencing any Work at the Project Construction Site the CONTRACTOR shall conduct a pre-construction survey. The pre-construction survey data will be used by the GOVERNMENT to update Plans. The CONTRACTOR shall provide the pre-construction survey data to the GOVERNMENT within seven (7) Days after collection of pre-construction survey. A minimum of five (5) working days and a maximum of ten (10) working days will be required to update the Plans upon receipt of the pre-construction survey data.

Survey transect locations for the pre-construction survey shall reoccupy those shown in the Plans. Survey transects shall be perpendicular to the shown alignments. At a minimum, transects shall extend from at least ten feet (10’) from the outer limits of the borrow and fill areas. Survey shots along transects shall be taken at all significant grade breaks (defined as vertical change of one-half feet (0.5’) or greater) and a maximum horizontal spacing of five feet (5’).

In addition to the transects shown on the Plans, pre-construction surveys shall also include survey points located along the perimeter of the fill and borrow areas to define the edge of the areas between survey transects. For the pre-construction survey, these

survey points shall be at a twenty feet (20’) minimum spacing, or at abrupt changes in the canal geometry not defined by the borrow or fill area layout. For borrow areas, these points shall delineate the plus one foot (+1’) NAVD88 contour between survey transects. For fill areas, the additional points should follow the waterline at the time of the survey to approximate the canal shape between survey transects.

17.7 Pay Surveys:

Pay surveys may be performed to document the progression of Work and as substantiation for the monthly Application for Payments. Pay surveys may be performed to provide the following:

a. To verify horizontal and vertical limits.

b. For interim acceptance of all other Work for the monthly Application for Payments.

Pay survey transects shall reoccupy those shown in the Plans. Survey transects shall be perpendicular to the alignments shown in the Plans. At a minimum, transects shall extend from at least ten feet (10’) from the outer limits of the borrow and fill areas. Survey shots along transects shall be taken at all significant grade breaks (defined as vertical change of one-half feet (0.5’) or greater) and a maximum horizontal spacing of five feet (5’). Pay survey plots shall show pay survey transects superimposed over pre-construction survey transects.

In addition to the transects shown on the Plans, pay surveys shall also include survey points located along the perimeter of the fill areas to define the edge of the fill areas between survey transects. These survey points shall be at a ten feet (10’) minimum spacing. For fill areas, these points shall be collected at the top of slope and the toe of slope.

Pay surveys shall be submitted to the GOVERNMENT monthly, within seven (7) Days after data collection.

17.8 Post-construction Surveys:

Upon project completion, a post-construction, or as-built, survey shall be performed to document conditions of the completed Work. The post-construction survey shall be performed within fourteen (14) Days of completion of all Work. Data obtained during pay surveys shall not be considered part of the post-construction survey unless otherwise approved by the GOVERNMENT.

Post-construction survey transects shall reoccupy those shown in the Plans. Survey transects shall be perpendicular to the alignments shown in the Plans. At a minimum, transects shall extend from at least ten feet (10’) from the outer limits of the borrow and fill areas. Survey shots along transects shall be taken at all significant grade breaks (defined as vertical change of one-half feet (0.5’) or greater) and a maximum horizontal spacing of five feet (5’). Post-construction survey plots shall show post-construction survey transects superimposed over pre-construction and pay survey transects.

In addition to the transects shown on the Plans, post-construction surveys shall also include survey points located along the perimeter of the fill and borrow areas to define

the edge of each area between survey transects. These survey points shall be at a ten feet (10’) minimum spacing. For fill areas, these points shall be collected at the top of slope and the toe of slope.

18 CLEARING AND GRUBBING

18.1 Scope:

The CONTRACTOR shall clear and grub within the borrow sites identified on the Plans; the coordinates defining these limits are provided within the Plans, and should be surveyed and clearly identified with stakes, flags, markings, or other suitable methods such that Work shall not be performed outside the limits. During clearing and grubbing operations, CONTRACTOR will be required to certify in each Daily Contractor Quality Control Report that the clearing and grubbing has occurred within the limits of the Plans.

The CONTRACTOR shall not clear and grub within any area marked as a no-work area on the Plans unless authorized by the GOVERNMENT.

Clearing shall be the removal of vegetation on and above the ground surface. After clearing, grubbing shall be completed within the borrow areas to remove any remaining roots or other debris that are not suitable to be used as fill material within one foot (1’) of the ground surface. Unless otherwise specified, all stumps, roots, and root clusters that have a diameter of one inch (1”) or larger shall be grubbed out.

All material from clearing and grubbing operations shall be properly disposed at a GOVERNMENT approved disposal facility.

18.2 Equipment:

Equipment employed for the clearing and grubbing Work shall be in satisfactory operating condition, capable of safely and efficiently performing the Work as indicated. Equipment and machinery shall be kept in good condition at all times.

A listing of all equipment and machinery utilized to accomplish the Work shall be submitted to the GOVERNMENT prior to the start of clearing and grubbing. The listing shall include year and manufacturer, operational capacities, safety features, operating and licensing requirements for operators, and a description of where and how the item of equipment will be employed in the Work. All floating working platforms shall meet OSHA requirements for worker safety. Any leaks or deficiencies shall be promptly and properly repaired.

18.3 Obstruction Identification:

The CONTRACTOR may encounter obstructions or other debris that are not identified and may pose a hazard during construction, or that which may cause a major delay to the construction schedule. The CONTRACTOR shall advise the GOVERNMENT immediately of any obstructions or other debris of this nature that are encountered within any areas to be cleared and grubbed.

18.4 Submittals:

Prior to commencing any Work at the Project Construction Site the CONTRACTOR shall submit the following:

1. Pre-construction Submittals:

The CONTRACTOR shall submit a clearing and grubbing plan to the GOVERNMENT, which shall include the following:

a. Clearly identifies any no-work areas or structures as delineated by the

GOVERNMENT;

b. Lists equipment to be used during clearing and grubbing; and

c. Details a plan for disposal of all cleared and grubbed material.

2. Within fourteen (14) Days after completion of Work, the CONTRACTOR shall provide the post-construction submittal to the GOVERNMENT documenting that all the areas have been cleared and grubbed in accordance to the Plans and Specifications and that all cleared and grubbed material has been appropriately disposed of at the approved disposal facilities.

19 DEBRIS REMOVAL

19.1 Scope:

The CONTRACTOR shall remove all trash, debris, and structures from the borrow and fill areas. The CONTRACTOR is to remove and dispose of all existing debris and structures identified for disposal in the Plans, the coordinates of which are provided in the Plans. Approximately three hundred sixty (360) cubic yards (cy) of debris/ structures are estimated within the borrow and fill areas as shown in Sheet GD-101 in the Plans. This information is provided for informational purposes only and CONTRATOR shall not rely on the GOVERNMENT estimate of the debris quantity.

The CONTRACTOR is to complete a site visit and make their own determination of the debris quantity. Payment is on a lump sum basis as outlined in section 12 of these Technical Provisions of the Specifications.

Debris removal and disposal shall be accepted by the GOVERNMENT after the listed debris in Sheet GD-101 of the Plans has been removed and properly disposed offsite and the GOVERNMENT has received proper documentation of the debris disposal.

Additional debris/ structures may be located at the Project Construction Site which are not identified within the Plans. The CONTRACTOR shall notify the GOVERNMENT who will provide instruction regarding the proper course of action for such debris/ structures. Debris/ structures which are to remain in place are identified in the Plans, with coordinates provided, and the CONTRACTOR shall not remove, damage, or impact these structures. The GOVERNMENT or the Construction Observer may inspect any removal of material containment from the Project Construction Site. All materials removed shall be disposed of in an appropriate and legal manner and at the expense of the CONTRACTOR.

19.2 Equipment:

Equipment employed for the debris removal Work shall be in satisfactory operating condition, capable of safely and efficiently performing the Work as indicated.

Equipment and machinery shall be kept in good condition at all times.

A listing of all equipment and machinery utilized to accomplish the Work shall be submitted. The listing shall include year and manufacturer, operational capacities, safety features, operating and licensing requirements for operators, and a description of where and how the item of equipment will be employed in the Work. All floating working platforms shall meet OSHA requirements for worker safety. Any leaks or deficiencies shall be promptly and properly repaired.

19.3 Submittals:

Prior to commencing any Work at the Project Construction Site the CONTRACTOR shall submit the following:

1. Pre-construction Submittals:

The CONTRACTOR shall submit a debris removal plan to the GOVERNMENT which shall include the following:

a. Clearly identifies any structures to remain in place as determined by the

GOVERNMENT;

b. Lists equipment to be used during debris removal; and

c. Details a plan for disposal of all materials and any trash or rubbish cleared from the Project Construction Site.

2. Within fourteen (14) Days after completion of Work, the CONTRACTOR shall provide post-construction submittal to the GOVERNMENT which shall include the following:

a. Documentation of the spatial extents of the debris removal areas in the form of a GIS shapefile, or Google Earth .kml or .kmz file.

b. The CONTRACTOR shall submit documentation that all debris removal material has been disposed of at the approved disposal facilities.

20 CANAL FILL (VOLUME IN PLACE)

20.1 Scope:

All fill excavated from the borrow areas shall be transported to, and deposited in, the fill areas within the lines, grades, elevations, and cross-sections shown in the Plans unless otherwise provided for herein or directed by the GOVERNMENT. The existing elevations of the fill areas may have changed between the time of the design survey (as shown in the Plans) and the time of the pre-construction survey. All pay volumes shall be calculated based on the pre-construction survey.

For Fill Areas 1, 2, and 3, the CONTRACTOR is to place the fill in such a manner as to establish a uniform elevation within each fill area and between adjacent pay survey transects. Areas within each acceptance segment, between survey transects, shall not

be under-filled or over-filled, as defined in the Contract Documents. For Fill Area 2 Expansion, the fill does not need to be uniform.

CONTRACTOR shall be paid for cubic yard of fill placed within Fill Area 1, Fill Area 2 per the Plans at a 1V:20H slope from the edge of the fill area as indicated in the Plans, to an elevation of plus one and one-half feet (+1.5’) NAVD88, Geoid12B. This shall include any mud-waving (displacement of in-situ soft material) that occurs within this template.

CONTRACTOR shall be paid by cubic yard of fill placed within Fill Area 3 per the Plans to an elevation of plus one feet (+1’) NAVD88, Geoid12B, from the fill edge adjacent to the existing marsh, to the top of slope, then at a 1V:5H slope from the top of slope to the existing grade as indicated in the Plans. This shall include any mud-waving that occurs within this template.

CONTRACTOR shall be paid by cubic yard of fill placed within Fill Area 2 Expansion so long as it is within the horizontal and vertical limits shown on the Plans.
