About this file
This document is an affidavit requirement file for the Commonwealth of Kentucky establishing mandatory declarations for bidders, offerors, and contractors participating in state procurement. The file contains three separate required affidavits that must be completed, notarized, and submitted to the Commonwealth prior to contract award or renewal. The first affidavit requires contractors to attest under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance provisions. This affidavit remains effective for one year from the date of execution. The second affidavit pertains to bidders claiming resident bidder status and requires attestation that the entity is authorized to transact business in Kentucky and has maintained Kentucky corporate income tax filings, unemployment insurance fund payments, and workers' compensation policies for at least one year prior to and through the advertisement date. The third affidavit applies to bidders claiming qualified bidder status, requiring confirmation that the entity and all subcontractors meet qualified bidder requirements under 200 KAR 5:410(3) and will maintain compliance throughout the contract period.
Each affidavit must be executed by an authorized representative of the contracting party and notarized before a notary public. The Commonwealth of Kentucky reserves the right to request updated affidavits at any time and may request documentation supporting claims of resident or qualified bidder status. Failure to provide requested documentation upon demand may result in bidder disqualification or contract termination. Qualified bidder status includes nonprofits furthering the purposes of KRS Chapter 163 and qualified nonprofit agencies for individuals with severe disabilities that employ individuals with severe disabilities for at least seventy-five percent of direct labor man hours in manufacturing or providing listed products and services, and maintain registration in good standing with the Kentucky Secretary of State.
