About this file

This is an Annual Affidavit document required by the Commonwealth of Kentucky for bidders, offerors, and contractors participating in state and local contract opportunities. The affidavit establishes compliance requirements across multiple categories of bidders and contract types, with an effective period of up to one year. All bidders and offerors must affirm under penalty of perjury that they have not violated Kentucky campaign finance laws (KRS 45A.110 and KRS 45A.115), have properly disclosed information required by KRS 45A.485, are registered with the Kentucky Department of Revenue for sales and use tax collection, are not delinquent on state taxes or fees, are not engaged in prohibited boycotts as defined in KRS 45A.607, and have not violated prohibitions in KRS 11A.236 during the previous ten years. For non-bid contracts including sole-source, non-practical-to-bid, and emergency contracts, additional affidavits are required addressing campaign contribution limits for gubernatorial candidates and elected officials with jurisdiction over the contract award, as well as restrictions on direct solicitation of contributions exceeding specified thresholds.

The affidavit also provides optional status categories for bidders claiming resident bidder status or qualified bidder status. Bidders claiming resident bidder status must affirm that they are authorized to transact business in Kentucky and have, for one year prior to contract advertisement, filed Kentucky corporate income taxes, made payments to the Kentucky unemployment insurance fund, and maintained an active workers' compensation policy. Bidders claiming qualified bidder status must meet requirements as a nonprofit corporation furthering KRS Chapter 163 purposes or as a qualified nonprofit agency for individuals with severe disabilities, which requires employing individuals with severe disabilities for at least seventy-five percent of direct labor hours in manufacturing or providing listed products or services. The bidding agency retains the right to request documentation supporting claims of resident or qualified bidder status and may disqualify bidders or terminate contracts for failure to provide such documentation or maintain ongoing compliance.
