About this file
This document is an affidavit attachment for the Commonwealth of Kentucky required for bidders, offerors, and contractors to compete for state contracts. The affidavit serves as a mandatory submission for contract award or renewal and remains effective for one year from the date of execution. The document contains multiple attestation requirements that authorized representatives of contracting parties must complete, have notarized, and return to the Commonwealth. The primary attestation requires contractors to swear under penalty of perjury that they have not knowingly violated Kentucky's campaign finance laws and that contract award will not violate any provision of such laws.
The affidavit document includes additional attestations for bidders claiming resident bidder status and qualified bidder status. Resident bidder claims require entities to demonstrate they were authorized to transact business in Kentucky, filed state corporate income taxes, made unemployment insurance fund payments, and maintained workers' compensation policies for the year preceding contract advertisement. Qualified bidder status applies to nonprofit corporations furthering purposes under Kentucky Revised Statutes Chapter 163 or nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor man hours. The bidding agency retains the right to request supporting documentation for any claimed status and may disqualify bidders or terminate contracts for failure to provide such documentation upon request.
