About this file

This file is an affidavit template document from the Commonwealth of Kentucky required for bidders, offerors, and contractors seeking state contracts. The document provides three separate affidavit forms that authorized representatives of contracting parties must complete, have notarized, and submit to the Commonwealth. The affidavits are effective for one year from the date of execution and apply to new contract awards and contract renewals. All required affidavits must be executed under penalty of perjury by a duly authorized representative of the bidding entity.

The first affidavit attests that the contractor has not knowingly violated Kentucky's campaign finance laws and that contract award will not violate any campaign finance provisions. The second affidavit, for entities claiming resident bidder status, requires attestation that the bidding entity is authorized to transact business in Kentucky, has filed corporate income taxes for one year prior to advertisement, made payments to the Kentucky unemployment insurance fund, and maintained an active workers' compensation policy. The third affidavit applies to entities claiming qualified bidder status, requiring attestation that the bidder and all subcontractors meet the definition of "qualified bidder" under 200 KAR 5:410(3), which includes nonprofit corporations or qualified nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor hours. The bidding agency reserves the right to request supporting documentation for any claimed status and may disqualify bidders or terminate contracts for failure to provide such documentation upon request.
