About this file

This is an affidavit document issued by the Commonwealth of Kentucky that establishes compliance requirements for bidders, offerors, and contractors seeking to be awarded or renew state contracts. The document contains three required affidavits effective for one year from the date of execution. All affidavits must be completed by an authorized representative of the contracting party, notarized, and submitted to the Commonwealth prior to contract award. The affidavits establish attestations regarding campaign finance law compliance, resident bidder status, and qualified bidder status. The first affidavit requires contractors to swear under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance law provisions. The second affidavit, for those claiming resident bidder status, requires entities to attest that they are authorized to transact business in Kentucky, have filed corporate income taxes for one year prior to advertisement, have made unemployment insurance fund payments, and have maintained an active workers' compensation policy.

The third affidavit applies to bidders claiming qualified bidder status and requires attestation that the entity and all subcontractors meet qualification requirements under 200 KAR 5:410(3) and will maintain compliance throughout the contract term. Qualified bidder status includes nonprofit corporations furthering the purposes of Kentucky Revised Statutes Chapter 163 or qualified nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor hours. The bidding agency reserves the right to request documentation supporting any claimed status and may disqualify bidders or terminate contracts for failure to provide such documentation upon request. All affidavits must be subscribed and sworn before a notary public with commission information provided.
