About this file

This document is an affidavit attachment from the Commonwealth of Kentucky containing required attestations for bidders, offerors, and contractors seeking state contracts. The affidavits are effective for one year from the date of execution and must be notarized by an authorized representative of the contracting party. Three distinct affidavit forms are included: the Required Affidavit for Bidders, Offerors and Contractors under KRS 45A.110 and 45A.115, which attests that the contractor has not knowingly violated Kentucky campaign finance laws; the Required Affidavit for Bidders Claiming Resident Bidder Status, which certifies that the bidding entity is authorized to transact business in Kentucky and has maintained Kentucky corporate income tax filings, unemployment insurance fund payments, and workers' compensation coverage for the year preceding the contract advertisement; and the Required Affidavit for Bidders Claiming Qualified Bidder Status, which verifies compliance with 200 KAR 5:410(3) requirements.

The Commonwealth reserves the right to request updated affidavits at any time and to demand supporting documentation for any claimed bidder status. Failure to provide requested documentation may result in bidder disqualification or contract termination. The Qualified Bidder status provisions specifically address nonprofit corporations that further the purposes of KRS Chapter 163 and qualified nonprofit agencies for individuals with severe disabilities, which must employ individuals with severe disabilities for at least seventy-five percent of direct labor man-hours and maintain registration in good standing with the Secretary of State. All affidavits require notarization with the notary's seal, commission expiration date, and specific execution dates documented by the bidder or offeror.
