About this file

This is an affidavit document from the Commonwealth of Kentucky containing required attestations for bidders, offerors, and contractors seeking to be awarded state contracts. The document outlines three separate affidavit requirements that must be completed, notarized, and submitted to the Commonwealth. The first affidavit requires contractors to attest under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance provisions. The second affidavit applies to entities claiming resident bidder status and requires attestation that the bidder is authorized to transact business in Kentucky, has filed Kentucky corporate income taxes for at least one year prior to contract advertisement, has made payments to the Kentucky unemployment insurance fund, and has maintained a current Kentucky workers' compensation policy. The third affidavit pertains to entities claiming qualified bidder status and requires attestation that the bidder and all subcontractors meet the definition of a qualified bidder under 200 KAR 5:410(3) and will maintain compliance throughout the contract term. The document is effective for one year from the date of execution.

All affidavits must be executed by a duly authorized representative of the contracting party and notarized before submission. The bidding agency reserves the right to request supporting documentation for claimed resident or qualified bidder status at any time, with failure to provide such documentation upon request resulting in bidder disqualification or contract termination. The Commonwealth retains the right to request an updated affidavit at any time during the contract period. Qualified bidder status includes nonprofit corporations furthering purposes under KRS Chapter 163 or nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor hours and are registered in good standing with the Secretary of State.
