About this file
This is an Annual Affidavit form for the Commonwealth of Kentucky requiring sworn statements from bidders, offerors, and contractors participating in state procurement opportunities. The affidavit has a maximum effective period of one year and must be notarized. All bidders and offerors are required to affirm compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115), confirm proper disclosure and compliance with lobbying restrictions (KRS 45A.485), verify current registration with the Kentucky Department of Revenue for sales and use tax collection, certify non-delinquency on state taxes and fees, confirm non-participation in prohibited boycotts as defined in KRS 45A.607, and attest to compliance with restrictions outlined in KRS 11A.236 for the previous ten years.
For non-bid contracts including sole-source, not practical or feasible to bid, and emergency contracts, contractors must provide additional affidavits regarding campaign contributions. These include certifications that neither the contractor nor immediate family members with 10% or greater business interest have exceeded contribution limits to gubernatorial campaigns (KRS 121.056 and 121.150), that officers, employees, and affiliated entities have not contributed more than $5,000 in aggregate to campaigns of elected officials with jurisdiction over the contract (KRS 121.330), and that no direct solicitation of contributions exceeding $30,000 in aggregate has occurred for such campaigns. The form also includes optional affidavits for bidders claiming resident bidder status or qualified bidder status as nonprofit organizations or qualified nonprofit agencies for individuals with severe disabilities, with documentation subject to agency request and verification.
