GENERAL REQUIREMENTS

REFUSE TRANSFER TRAILERS

GENERAL REQUIREMENTS

These specifications set forth the minimum requirements for up to five (5), two axle, forty-five (45') foot, open top semi-trailers (maximum height to be 13’ to comply with site tunnel restriction), with walking floor, 3-point contact entry system, and automatic flip top tarp system for use with a rear loading compactor unit or top loading. Bidders may submit optional features listed under Bid Options A-D at the end of the specifications.

In addition to the initial purchase of up to five (5) trailers, the County may elect to purchase up to five (5) additional trailers per year, for four additional years.

All equipment furnished shall be the manufacturer's latest model now in production and shall conform to the best practices known to the automotive trade in strength, quality of material and workmanship, and shall be subject to these specifications in full. All equipment catalogued as standard is to be furnished with the equipment whether or not it is listed in these specifications.

The component parts of the equipment shall be of proper size and design to safely withstand maximum stress imposed by a capacity load and manufacturer's rated loads for axles and bearings must not be exceeded when equipment is loaded with such capacity.

Prior to delivery, new equipment must be completely serviced by successful bidder or his authorized agent. Differential and hydraulic systems must be filled to manufacturer’s recommended capacity when equipment arrives at delivery destination. No 1,000-mile inspection service policy required.

All ratings shall be certified by the manufacturer to be as stated according to test procedures designated by the S.A.E. or the appropriate agencies and shall at a minimum be equal to the requirements and conditions specified herein. Evidence of compliance with the requirements of these specifications shall be based on manufacturer's data sheets and data sheets of the component parts manufacturer published prior to the issuance of these specifications. In case of conflict between the latter, data sheets of the component parts manufacturer shall take precedence.

Semi-Trailer Description

Each semi-trailer shall have automatically activated dual flip top doors, for top loading refuse, two-axle trailer. It will be coupled to a conventional three-axle truck-tractor having an approximate wheelbase of 190" and/or a two-axle Ottawa Yard Truck with a 126” wheel base. The total unit shall be so designed that it will safely carry a legal maximum load of up to 80,000 lbs.

Each bidder shall attach to their proposal and make a part thereof such data as are necessary to show the dimensions, arrangement, type and material of the component parts, and detail drawings to scale of the arrangement of the mechanisms upon which the bid is tendered as well as all other pertinent data necessary to a complete understanding and evaluation of their bid.

Semi-Trailer Operation

The semi-trailer will be used for transporting mixed loads of solid waste from a transfer station to a sanitary landfill site. At the landfill, the unit will be required to traverse poor roadways or operate off the road entirely. The operation is all weather, day and night service, and in severe service. Allowance shall be made in the design for extraordinary abuse during loading and operation at sanitary landfills. The semi-trailer shall be so designed to permit unloading at the landfill by a hydraulically powered self-contained system which will move the refuse to the rear of the trailer and allow it to fall on the ground.

Applicable Specifications

The trailers furnished to meet these specifications, including all equipment and accessories, shall comply with the requirements of 1) California Vehicle Code, 2) current Federal motor vehicle safety standards and 3) Cal OSHA standards as applicable.

Bidder's Qualifications

The manufacturers furnishing the mechanisms described in these specifications shall be experienced in design and construction of such equipment and may be required to furnish evidence of having supplied similar equipment which has been in successful operation for a period of not less than one year.

Warranty / Defective Work

A.) The successful bidder shall provide a warranty, against all defective parts and workmanship, including freight and transportation if necessary, for a period of one (1) year from the date of acceptance of the equipment by the County. The bidder shall supply parts and labor, at no cost to the County, to effect repair or replacement of any parts and workmanship that prove defective during this warranty period.

B.) The County shall be furnished with no-charge invoices for all work performed under warranty. Each invoice shall itemize parts used and show labor charges.

C.) This warranty applies to all optional items bid.

D.) No part, which is defective in its construction or deficient in any of the requirements of these specifications, will be considered as accepted in consequence of the failure of any employee of the County to point out said defects prior to acceptance of the equipment by the County. The manufacturer shall replace any part of parts of any equipment which are defective or which show undue wear within one year after the equipment has been placed in operation, and the manufacturer shall bear all costs directly pertaining to the replacement. If the County of Sacramento is required to deliver the trailer outside of the immediate Sacramento area for warranty work, the vendor shall reimburse the County at a rate of $200.00 per hour for pickup and delivery time involved.

E.) The Bidder shall have sufficient stock of parts on hand to ensure a minimum of down time on the equipment offered and shall be able to provide daily parts delivery to the County within 24 hours after notification. Such service shall be available on a 24-hour, 7 day a week basis.

F.) The Bidder shall satisfy the County that he maintains a store or branch within 100 miles of the working location of the machine, staffed with qualified personnel to service and maintain the equipment with provisions for storing a representative supply of parts for the machine offered. Response time shall be twenty-four (24) hours from notification by the County.

DMV Documentation: Dealer/Vendor will be responsible for registering and titling the vehicle(s)/equipment with the California Department of Motor Vehicles as required by the County. Each unit will be delivered with a completed “EXEMPT” registration and license plates. A temporary registration or operating permit will be acceptable to facilitate delivery of the unit in cases where the registration has not yet been completed. DMV title and registration documents will reflect registered owner information as follows:

County of Sacramento

Department of Waste Management & Recycling

North Area Recovery Station (NARS) 4450 N. Roseville Rd.

North Highlands, CA. 95621

Delivery: Unit specified herein shall be delivered to the County ready for service according to the following maximum delivery schedule:

1.

Delivery of first unit within 120 to 150 calendar days after contract award.

2.

Delivery of last unit within 180 calendar days after contract award.

Delivery is important and will be considered in evaluating bids.

LATE DELIVERY PENALTY FEES: The delivery date of the equipment is set so that the utilization of the equipment is consistent with County needs. If the unit is not delivered within the time specified, the delay will interfere with the proper implementation of the County's programs utilizing the equipment procured pursuant to this bid, to the loss and damage of the County. The amount of the penalties is based on the County’s costs to continue to operate old equipment which is to be replaced by the new equipment ordered.

Amounts due the County as delivery penalty fees may be deducted by the County from any money payable to the contractor pursuant to this contract. The County shall notify the contractor in writing of any claim for late delivery penalty fees pursuant to this paragraph.

A. If the contractor does not deliver equipment meeting these specifications and ready for use, on or before the delivery date as specified, the contractor shall pay to the County, as late delivery penalty fees for each calendar day between the date specified and the date of the certification for such equipment, but not more than 90 calendar days an amount of:

$175.00 per calendar day per unit

If the delay is more than thirty (30) calendar days, then by written notice to the contractor, the County may terminate the right of the contractor to deliver and may obtain substitute equipment. In this event, the contractor shall be liable for late delivery penalty fees, in the amounts specified above until substitute equipment is delivered, ready for use, or for 90 days from the delivery date, whichever comes first.

B. Exception: Except with respect to defaults of subcontractors, the contractor shall not be liable for late delivery penalty fees when delays arise out of causes beyond the control and without the fault or negligence of the contractor. Such causes may include, but are not restricted to, acts of God or of The Public Enemy, acts of the County in either its sovereign or contractual capacity, fire, floods, epidemics, quarantine restrictions, strikes, freight embargoes and unusually severe weather: but in every case the delays must be beyond the control and without the fault or negligence of the contractor.

If the delays are caused by the default of a subcontractor, and if such default arises out of causes beyond the control of both the contractor and subcontractor, and without the fault or negligence of any of them, the contractor shall not be liable for late delivery penalty fees for delays, unless the supplies or services to be furnished by their subcontractors were obtainable from other sources in sufficient time to permit the contractor to meet the required performance schedule.
