About this file

This is an Authorization & Certification document from the City of Long Beach used for Request for Proposals (RFP) submissions. The document establishes the legal framework and requirements that proposers must satisfy when submitting bids to the City of Long Beach. Proposers must certify authorization to submit proposals based on their business structure: sole proprietors must provide owner signatures, partnerships require general partner signatures, corporations need two officer signatures or one officer signature with a certified corporate resolution, and limited liability companies require a member or manager signature. All proposers must acknowledge compliance with RFP terms and conditions, the City of Long Beach Vendor Code of Conduct, and certify that proposals are firm and fixed for 90 days from the submission deadline. Proposers must also confirm submission of all required documentation as specified in section 4.2 and attest that proposals are genuine and not collusive or sham bids.

The document includes comprehensive federal compliance certifications required because contractors may receive federal grant funds through their business relationship with the City. Proposers must certify under penalty of perjury that they, their principals, and their organization are not currently suspended, debarred, ineligible, or voluntarily excluded from federal funding; have not been suspended or debarred within three years preceding the proposal; do not have proposed debarment proceedings pending; have not been indicted or convicted of fraud or official misconduct within three years; and have not had public transactions terminated for cause or default within three years. Additionally, proposers must declare no conflicts of interest in the selection, award, or administration of contracts and must provide written notice within 21 days if any reorganization, management changes, or principal status changes occur. The document includes a table for proposers to list exceptions to terms and conditions, though the City notes that exceptions are uncommon and has no obligation to accept them; any award is contingent upon successful negotiation of final contract terms.

Exceptions to Terms & Conditions

EXCEPTIONS TO TERMS AND CONDITIONS (IF APPLICABLE)

Exceptions to terms and conditions are uncommon, and Proposers are not encouraged to take exception to terms and conditions. However, in the event there are terms that should be reviewed as part of potential negotiation of a final contract, they should be listed here. The City of Long Beach has no obligation to accept any exceptions to terms and conditions. Any award is contingent upon the successful negotiation of final contract terms. If contract negotiations cannot be concluded successfully, the City reserves the right to negotiate a contract with another

Contractor or withdraw the RFP.
