About this file

This is an Authorization & Certification attachment for the City of Long Beach's Request for Proposals (RFP) process. The document establishes the legal framework and requirements that proposers must acknowledge and comply with when submitting bids or proposals to the City. Proposers are required to certify their authorization to submit proposals on behalf of their organization, with specific signature requirements varying by business structure: sole proprietorships require only the owner's signature, partnerships require general partner signatures, corporations require two officer signatures or one officer signature with a certified corporate resolution, and limited liability companies require a member or manager signature. All proposers must confirm they have read and understand the terms and conditions of the RFP, agree to comply with the City of Long Beach Vendor Code of Conduct, and certify that their proposal is genuine and not collusive. The proposal is submitted as a firm and fixed request valid for 90 days from the submission deadline, and proposers acknowledge that failure to submit all required documents as specified in section 4.2 will result in being deemed nonresponsive.

Additionally, the document includes federal compliance certifications required for any contractor potentially receiving federal grant funds through their business relationship with the City of Long Beach. Proposers must certify under penalty of perjury that neither they nor their principals have been suspended, debarred, voluntarily excluded, or declared ineligible by any federal department or agency, and that within the three-year period preceding the proposal, they have not been suspended, debarred, indicted, convicted, or had a civil judgment rendered against them involving fraud or official misconduct, nor have they had public transactions terminated for cause or default. The document also includes a section for proposers to document any exceptions to terms and conditions they wish to request, though the City notes that exceptions are uncommon and not encouraged, and the City has no obligation to accept any exceptions. Any award is contingent upon successful negotiation of final contract terms, and if negotiations cannot be concluded successfully, the City reserves the right to negotiate with another contractor or withdraw the RFP.
