L.2.6. Discrepancies If an Offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the Offeror shall immediately notify the Contracting Officer in writing with supporting rationale as well as the remedies the Offeror is asking the Contracting Officer to consider as related to the claimed omission or error.

Recommend requesting a DoD SAFE drop-off link at least three (3) business days before the qualifications/proposal due date to ensure that your firm receives a link in time.

L.2.11. Design Within Funding Limitations

The A-E shall accomplish design services required under each task order so as to permit the award of contracts using standard Federal Acquisition Regulation procedures for the construction of projects designed at a price that does not exceed the estimated construction contract price established for each task order issued under this contract. When proposals for the construction contract are received that exceed the designer’s detailed construction cost estimate by more than 20%, the A-E firm shall assist with evaluating the proposals. The additional services shall be performed at no increase in the Task Order price. The A-E firm will promptly advise the Contracting Officer if it finds that the project being designed will exceed or is likely to exceed the funding limitations and it is unable to design a usable project within these limitations. Upon receipt of such information, the Contracting Officer will review the A-E’s revised estimate of construction cost.

L.2.12. Responsibility of the Architect-Engineer Contractor In accordance with FAR 52.236-23, the Contractor shall be responsible for the professional quality, technical accuracy, and the coordination of all designs, drawings, specifications, and other services by the Contractor under this contract. The Contractor shall, without additional compensation, correct or revise any errors or deficiencies in its designs, drawings, specifications, and other services. Neither the Government’s review, approval or acceptance of, nor payment for, the services required under this contract shall be construed to operate as a waiver of any rights under this contract or of any cause of action arising out of the performance of this contract, and the Contractor shall be and remain liable to the Government in accordance with applicable law for all damages to the Government caused by the Contractor’s negligent performance of any of the services furnished under this contract. The rights and remedies of the Government provided for under this contract are in addition to any other rights and remedies provided by law. If the Contractor is comprised of more than one legal entity, each such entity shall be jointly and severally liable hereunder.

L.2.13. Work Oversight in Architect-Engineer Contracts The extent and character of the work to be done by the A-E shall be subject to the general oversight, supervision, direction, control, and approval of the Contracting Officer.

L.2.14. Requirements for Registration of Designers Final design documents shall be stamped by the engineer or architect of record, registered to practice the particular professional field in the state of Arizona.

L.3. PROPOSAL PREPARATION GUIDLINES

L.3.1. Data and Information The Offeror's proposal must include all data and information requested by Section L in this solicitation and must be submitted in accordance with these instructions. The offer shall be compliant with the requirements as stated in the A-E IDIQ Statement of Work (SOW). Non-conformance with the instructions provided in Section L of this solicitation may result in an unfavorable proposal evaluation and may be grounds to eliminate the proposal from consideration for contract award; alternate proposals will not be accepted.

L.3.2. Clear and Concise The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements but rather shall provide convincing rationale to address how the Offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the Offeror's proposal.

L.3.3. Relevant Information Elaborate artwork and expensive visual and other presentation aids are unnecessary and discouraged.

Include only information that is relevant to this source selection.

L.3.4. Acceptance Period The proposal acceptance period is specified in the SF33 under block 12 of this solicitation. By signing block 17 of the SF33, the Offeror certifies that the proposal is valid from the due date and time listed in block 9 through the entire period specified in block 12.

The Government is not responsible for any costs incurred or associated with preparation and submission of a proposal in response to this solicitation, even in the event of cancellation of the solicitation.

L.3.7. Unsuccessful Proposals In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain a copy of all unsuccessful proposals.

L.3.8. Proprietary Information The exclusive responsibility for Source Selection will reside with the Government. Proprietary information submitted in response to this solicitation shall be clearly marked as such and will be protected from unauthorized disclosure as required by the Office of Procurement Policy Act as amended (41 U.S.C.

423) (hereinafter referred to as "the Act") as implemented in the FAR. Any unmarked proprietary information will be considered releasable under the restrictions of the Freedom of Information Act. The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contract qualifications and proposals submitted to federal agencies. If an Offeror’s submissions contain information that he/she believes should be withheld from such requestors under FOIA on the grounds that they contain “trade secrets and commercial or financial information” [5 USC§552(b)(4)], the following notice should be placed on the title page:

“Source Selection Information – See FAR 2.101 and 3.104 -- Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act. Material considered privileged or company confidential on such grounds is contained on page(s).”

Each item considered privileged or confidential under FOIA should be marked with the following notice:

“This data or information is considered confidential or privileged and is not subject to mandatory disclosure under the Freedom of Information Act.”

Do not risk being late.

L.4.10. Evaluation Criteria and Order of Importance The Government will use the evaluation criteria specified in FAR 36.602-1. In accordance with DFARS 236.602-1, these criteria are listed in relative order of importance below:

Table L.4.10. Evaluation Criteria and Order of Importance Factor Criteria Volume

Factor 1 Professional Qualifications Volume I – Technical Factor 2 Specialized Experience Volume I – Technical Factor 3 Interview Volume I – Technical Factor 4 Past Performance Volume II – Past Performance Factor 5 Location Volume I – Technical Factor 6 Capacity Volume I – Technical

L.5. VOLUME I – TECHNICAL

L.5.1. General The Technical Volume shall be specific, detailed, and complete to clearly and fully demonstrate that Offerors have a thorough understanding of requirements. Legibility, clarity, and coherence are very important. Do not merely reiterate the objectives or reformulate the requirements specified in the solicitation. Statements that Offerors understand, can, or will comply with the specifications (including referenced AF publications, etc.); statements paraphrasing the specifications or parts thereof (including referenced AF publications, etc.); and phrases such as "standard procedures will be employed" or "well known techniques will be used" etc., will be considered unacceptable. Offerors should note that data submitted prior to the proposal submission will not be considered in the Government's evaluation;

therefore, such data should not be relied upon or incorporated in the Technical proposal by reference.

L.5.2.1. Factor 1 – Professional Qualifications – Professional qualifications necessary for satisfactory performance of required services: Firms will be evaluated on professional qualifications, competence, and experience of the proposed key personnel in providing services to accomplish tasks required under this contract, including participation in example projects in the SF330, Part I, Section G.

Key personnel are individuals who will have major contract or project management responsibilities and/or will provide unusual or unique expertise. List only the team members who will actually perform the major tasks under this contract. Specific disciplines and personnel that must be included in key personnel are:

- Project Manager

- Program Manager

- Civil Engineer

- Mechanical Engineer

- Electrical Engineer

All key personnel shall have a minimum of 5 years related project experience. In addition, all key personnel shall have Arizona Professional Engineer licenses in their related fields. Firms must provide a copy of the license and issuing organization for such personnel. Copy of license shall not be counted as part of the page limitation.

L.5.2.1.1. Factor 1 Submission Requirements (SF 330, Part I, Sections D, E, and G): SF 330, Part I, Section D – provide an organization chart of the proposed team. The organization chart shall provide a description of the proposed team composition for the IDIQ, identifying scope to be conducted by each participating firm (e.g. prime A-E contractor, each participating JV partner, teaming partners, subcontractors, etc.). SF 330, Part I, Section E – Provide resumes for all proposed key personnel that illustrate experience in the work proposed under this contract. For each key personnel, identify active professional registration, licensure, or certification; area of expertise and demonstrated experience; role expected to play in this contract; and describe the roles they performed in a maximum of five (5) completed projects that best illustrate the individual member’s experience level. Qualifications should reflect each individual’s skills and abilities to contribute to the successful completion of task orders issued on this contract. Indicate participation of key personnel in example projects in the SF 330, Part I, Section G. Resumes for key personnel are limited to one (1) page each. Any pages over this limit will not be considered. Experience completing projects for the Government is desirable but not required. Identify key personnel who participated in the firm’s sample projects submitted in the SF 330, Section F.

L.5.2.2. Factor 2 – Specialized Experience – Specialized experience and technical competence in the type of work required: Firms will be evaluated on their demonstrated specialized recent/relevant experience and technical competence for services anticipated under this contract. Recency is defined as active contract performance during the five (5) years preceding the date of issuance of this solicitation.

Relevancy is defined as projects involving any combination of Mechanical, Electrical, Fire Protection, Civil, Structural and Architectural Engineering services. Multidisciplinary projects performed on a military installation or Federal Government facility will be considered more relevant. Relevant past projects cost should be in the range of $75,000 - $2,500,000.

L.5.2.2.1. Factor 2 Submission Requirements (SF 330, Part I, Section F): Projects shall be submitted on the SF 330 at Part I, Section F. Provide a maximum of five (5) projects demonstrating specialized experience of the proposed firm/team in provision of the services noted above. The projects shall have been completed within the five (5) years immediately preceding the date of issuance of this solicitation.

Sufficient information to determine the date of completion of the project must be included in the project description or the project will not be considered. If more than the maximum number of projects are submitted, the Government will only evaluate projects up to the maximum number authorized in the order submitted.

All projects provided in the SF 330 must be completed by the actual office/branch/regional office/individual team member proposed to manage and perform work under this contract. Projects not meeting this requirement will be excluded from consideration in the evaluation. To enable verification, firms should include the SAM Unique Entity ID (UEI) number along with each firm name in the SF 330 Part 1, Section F, block 25, and include a contract number or project identification number in block 21.

Include an e-mail address and phone number for the point of contact in block 23(c). In block 24, include in the project description the contract period of performance, award contract value, and summary of the work performed that demonstrates relevance to specialized experience as outlined above. For projects performed as a subcontractor, specifically indicate the value of the work performed as a subcontractor or by those firms proposed for this contract, and identify the specific roles and responsibilities performed as a subcontractor or by those firms on the project rather than the work performed on the project as a whole.

If the project description does not clearly delineate the work performed by the entity/entities offering/teaming on this contract, the project could be eliminated from consideration.

For submittal purposes, a task order on an IDIQ contract is considered a project, as is a stand-alone contract award. Do not submit an IDIQ contract as an example project. Instead, list relevant task orders or stand-alone contract awards that fit within the definition provided above.

L.5.2.3. Factor 3 – Interview – No Submission Requirements: Firms will be contacted after Volume I

– Technical and Volume II – Past Performance have been received by the Government to coordinate a date/time for an interview. Key personnel, as indicated in Part I Section E of the SF 330 must attend the interview. The interview will not last longer than 45 minutes in duration and can be structured as follows:

Firm Introduction/History (5 minutes), Key Personnel Introduction/Experience (up to 5 minutes per person; no longer than 20 minutes total), Questions from the panel (20 minutes). Questions will be asked in the following areas:

- Specialized Experience (Government Projects, Project near Luke AFB etc.)

- Technical Approach to Complex Projects/Quality Control

- Responsiveness

- Four individual questions – how well each interviewee provided a thoughtful response that addressed key points within the solicitation documents and demonstrated an understanding of the requirements
