About this file

This document outlines policies and specifications for new sewer connections to the West Montrose Sanitation District system. It addresses general extension policies, application processes, fees, design requirements, construction procedures, and tap transfers.

The District requires developers to construct new sewer main extensions at their own expense according to the City of Montrose Sanitary Sewer System Standards. New facilities will be owned and maintained either by the District if dedicated, or by others if on private property. Applicants must submit plans and apply for taps at least 15 days before each board meeting. Fees include tap fees, review fees, and monthly service fees assessed from final plat approval or tap purchase. Plans require an engineer's stamp and District approval. Construction will be inspected by District staff. Developers must provide a two-year warranty on workmanship. Tap transfers require terminating the old tap, paying fees, and executing new agreements.

The solicitation seeks proposals for the Montrose Work Center Building Construction project, with a budget between $1,000,000-$5,000,000. Base work includes site preparation and constructing a 6,400 square foot prefabricated metal building. Optional items involve connecting utilities. Proposers must register with SAM and the closing date is not provided. The USDA Forest Service is the contracting agency. The level of detail provided is suitable for business.

6.1 Policies and Specifications for New Connections

(Revised and Approved by WMSD Board of Directors on 05/20/2018)

The West Montrose Sanitation District provides wastewater collection and treatment service to its service area under the terms of its Bylaws. New service connections will be made in accordance with these policies and specifications.

Definitions:

Final Plat: A drawing and supporting materials of certain described land prepared as an instrument for recording evidence of legal division of land with the County Clerk and Recorder.

This is the final stage of the Major Subdivision Process.

Major Subdivision: A division of a lot, tract or parcel of land into four (4) or more lots, plats, sites or other divisions of land for the purpose of sale or development.

Minor Subdivision: A division of a lot, tract or parcel of land into no more than three (3) lots, plats, sites or other divisions of land for the purpose of sale or development.

Preliminary Plan: A drawing of a proposed subdivision and specified supporting materials, drawn and submitted in accordance with the requirements of these Regulations, to permit the evaluation of the proposal prior to construction, including service location, the quality and quantity of wastewater the project will generate, the capacity of the District's collection and treatment facilities. This is the initial part of the Major Subdivision review process.

Sketch Plan: A drawing of the proposed project with all required accompanying material drawn and submitted in accordance with the requirements of these Regulations, to evaluate the proposed service location, the quality and quantity of wastewater the project will generate, the capacity of the District's collection and treatment facilities. This is the initial step in the Minor Subdivision review process.

6.1.1 General Sewer Main Extensions and New Connection Policies for Major Subdivisions

1. All extensions from the District's existing facilities to, or within, new service areas shall be constructed at the expense of the Applicant or Owner of the property, unless the Board, at

Attachment 8

1240LT22R0030

its sole discretion, decides it is in the District's best interest to participate in the cost of the extension.

2. Ownership and maintenance responsibilities for new facilities shall generally follow these guidelines:

• Facilities located in dedicated streets shall be owned and maintained by the District.

• Facilities located in private property may be dedicated to the District for ownership and maintenance. In these cases, the District must accept the facilities and adequate easements for access and maintenance must be secured by the Applicant on behalf of the District. The District will be responsible for maintenance of the main pipeline only;

service laterals and service connections (taps) on the main pipeline shall not be the responsibility of the District. Where main pipelines are not located along paved or otherwise hard surfaced routes, the District reserves the right to require that gravel roadways be provided to allow maintenance vehicles access to the pipelines and manholes.

• Facilities located in private property not dedicated to the District shall be owned and maintained by others.

• During the tap application process, the Applicant and the District will determine the preferred arrangement.

3. No facilities shall be installed in areas where access is likely to be complicated by future construction of fencing, outbuildings, or landscaping features. Facilities may be constructed across agricultural ground only when specifically approved by the Board.

4. The West Montrose Sanitation District adopts by reference the Sanitary Sewer System

Standards issued by the City of Montrose, latest edition, for use by the District. The City of Montrose Sanitary Sewer System Standards shall apply except as modified or augmented by the District's policies and requirements.

a. When applying the City of Montrose Sanitary Sewer System Standards, references to the "City" shall be interpreted to mean the District; the term "City Engineer" shall mean the District's Engineer, "City Manager" shall mean the District's President, and "City Council" shall mean the District's Board of Directors, etc.

b. The District's Engineer shall resolve questions regarding interpretation and application of the City of Montrose Sanitary Sewer System Standards.

c. Section numbers cited herein refer to the City of Montrose Sanitary Sewer System Standards.

6.1.2 Application Process

1. Persons wishing to be served by the District must submit a Tap Application and Sketch or

Preliminary Plan to the District for its consideration 15 days prior to the next Board meeting.

The Application and Sketch Plan/Preliminary Plan shall describe the proposed project and show its location and proposed method of connection to the District. Preliminary engineering satisfactory to the District and sufficient to evaluate the proposal shall be submitted with the Sketch Plan/Preliminary Plan.

2. Application for all taps for a given filing in a development must be made at one time and purchased as a block in one transaction.

3. Applications received at least 15 days prior to the next regular meeting of the Board of

Directors of the District will be placed on the agenda and considered at that meeting. The Board will evaluate the proposed service location, the quality and quantity of wastewater the project will generate, the capacity of the District's collection and treatment facilities, and will determine whether the District is able to provide service.

4. If the Board determines that District has adequate capacity to serve the proposed project, approves all required drawings and documents, and approves the application, the Board at its discretion may offer to sell the tap(s) requested. The tap(s) thus offered shall be available to the Applicant for 30 days. The Applicant must execute a sewer tap agreement and make all payments in full within that time. If the sale is not completed within 30 days, the offer to sell taps shall expire and re-application will be required.

5. If the property to be served is not within the boundaries of the District, an agreement to annex the property into the District must be executed concurrently with the sewer tap agreement.

6. All costs incurred by the District to evaluate an application for more than one tap will be borne by the Applicant. Fees for legal services, engineering, and construction inspections may be assessed to any project that requires more than one tap. The Tap Review Fees are necessary to apportion the District's review costs to those persons whose plans and intentions create the need for the work.

7. The fees will be estimated by the staff and approved by the Board of Directors and shall be collected prior to commencement of the project. If during the progress of the project it is determined that the previously paid review fees will not be adequate, additional funds will need to be deposited with the District. Upon completion of the project, a summary statement will be provided, and any remaining balance will be refunded, or balance due billed.

8. Action by the District approving a Tap Application does not endorse or approve the land uses intended by the Applicant. Applicants are solely responsible for complying with all City, County, and State land use and subdivision regulations.

9. The District will provide a copy of the tap agreement to buyers to provide information about District policies and conditions for services to new owners.

6.1.3 Fees

1. Tap Fees and Monthly Service Fees are determined by the Board of Directors and shall be revised from time to time as necessary and appropriate.

2. Monthly service fees for new subscribers shall be identical to those paid by current subscribers of the District unless special circumstances affect the cost of providing service to the new subscriber. New taps in a Major Subdivision will be assessed the monthly service fee beginning the next regular billing cycle after the Final Plat approval, regardless of the activation status of those taps. New tap purchases for single lots and Minor Subdivisions will be assessed the monthly service fee beginning the next regular billing cycle after the tap purchase is made.

6.1.4 Design Specifications and Plan Requirements

1. All new facilities shall be designed for gravity flow sewer unless specifically approved for pumping by vote of the Board of Directors. The District discourages the use of pumping stations. As such, applicants may need to acquire easements for gravity sewer pipelines located on property owned by others to be approved by the District for sewer service. Higher monthly sewer rates can be expected for users served by pumping stations.

2. Plans for new facilities are generally required when more than one tap is requested. An

Engineer licensed in Colorado in accordance with the City of Montrose Sanitary Sewer System Standards Section 9-3-1 shall prepare plans for the proposed work.

3. The Plans shall be reviewed by the District's Engineer in accordance with District policies and requirements.

4. When the District's Engineer is satisfied that the Plans substantially conform to the City of

Montrose Sanitary Sewer System Standards, and with the District's policies and requirements, the Engineer will issue a written Notice to Proceed.

5. All excavation, bedding, pipe materials, pipe installation, service laterals, manholes, backfill, compaction, and testing shall be furnished or performed in accordance with the City of Montrose Sanitary Sewer System Standards, except as modified or augmented herein.

a. Minimum Pipe Size and Minimum Grade Requirements:

Service lateral

Minimum pipe diameter

(in inches) Minimum grade

(in percent)

Individual 4 1.0% 6 0.5%

Multi-Unit (2 to 8 units) 4 1.0%

More than 8 Units 6 1.0%

b. Separate service laterals are required for each individual dwelling or multi-family unit. All service laterals in new main pipelines shall be connected using full body wyes. Cleanout access portals shall be provided adjacent to each structure, and as required by the Engineer. Piping for service laterals, including those portions on private property shall be minimum SDR-35 (ASTM 3034) PVC pipe.

c. The Contractor shall make connections to the District's sewer pipes only in the presence of the District's observation personnel.

d. Closed caption television inspection of all new main line sewers will be required and shall be performed at the Contractor’s expense. Copies of the television inspection shall be provided to the District in DVD or digital format.

e. Sewers shall be designed to extend to the perimeter boundaries of a particular development to facilitate future service to adjoining properties in accordance with the City of Montrose Sanitary Sewer System Standards Section 9-3-1(B). Where public rights-of-way are not present, minimum 20’ wide utility easements shall be provided.

f. Sewers within the District shall be typically located at the center of roadways, or laterally within 10 feet of separation from opposing utilities.

6.1.5 Construction Procedures and Warranty

1. Prior to commencing work, the Applicant or its Contractor shall provide the District with a Certificate of Public Liability and Property Damage Insurance, in such amounts and from such sources as may be acceptable to the Board of Directors, naming the District a co-insured party.

2. The Contractor shall have full and unabridged responsibility for all aspects of workplace safety.

3. Construction of all new extensions, connections, and facilities shall be observed by personnel assigned by the District to ensure general conformance with the plans and specifications. Any work performed without providing the District reasonable opportunity to observe the work will not be accepted for connection to the District's system. Construction observation personnel will be assigned to the work only after the Tap Application has been approved, and after all Tap and Application Fees have been received by the District, unless otherwise approved by the District. No taps for future lots in future filings of a project or main sewer pipelines may be constructed without Tap and Application Fees paid in full.

4. The Applicant shall provide the District with at least 72 hours written notice prior to commencing (or restarting) construction to allow construction observation personnel to be scheduled.

5. Upon completion of the work, the Applicant shall submit a full set of "As-Built" drawings prepared in accordance with the City of Montrose Sanitary Sewer System Standards Section 9-3-7. Such drawings are generally required for new facilities that involve more than one new tap. “As-Built” drawings shall be labeled with cumulative distances from the downstream manhole to service laterals. Where service lateral is not constructed at 90-degree angles to the main sewer, both cumulative distances (to locate where lateral joins main sewer) and dimensional ties to adjoining property corners (to locate upstream end of service, typically at right-of-way) shall be shown to define the alignment of the lateral.

6. Newly installed pipelines may be placed in service after the District Engineer has issued a Statement of Completion. Any deficiencies or defects in the work shall be corrected at the expense of the Applicant or its Contractor prior to issuance of the Statement of Completion.

7. The Contractor shall warrant the work to be free from defects in materials and workmanship for a period of not less than two (2) years (the "Acceptance Period"), in accordance with the City of Montrose Sanitary Sewer System Standards Section 9-3-7.

8. At the end of the Acceptance Period, and upon written request by the Contractor, the District

Engineer will, after observation of the work and correction of any deficiencies, issue a Statement of Acceptance in accordance with the City of Montrose Sanitary Sewer System Standards Section 9-3-7, relieving the Contractor of any further responsibility for the work.

9. If an area to be served by the District is to be developed in phases, the District reserves the right to require retesting or television inspection of a previously installed and accepted sewer (mains and/or services), where that sewer may be adversely affected by construction of subsequent phases.

6.2 Tap Transfers

(Approved by WMSD Board 03/08/07)

6.2.1 Tap Ownership Transfer

Taps may be transferred from property seller to new buyer upon completion of a “Tap Ownership Transfer” form, full payment of any past payments and payment of the current transfer fee.

6.2.2 Resale and physical relocation of taps

There may be times when redevelopment of existing property creates a situation where taps need to be resold and/or moved. The ownership of sewer taps within the West Montrose Sanitation District (WMSD) may be transferred with WMSD approval under the following conditions:

1. Transferred taps must be assigned to locations on specific parcels. Transfers of taps that are purchased and not so assigned, will not be recognized by WMSD.

2. Parcels that receive transferred taps must fall within the legal boundary of the WMSD. If the parcel is not currently within WMSD, annexation into WMSD will be required. Such annexation is generally permissible if the subject parcel falls within the District’s Service Area Boundary.

3. WMSD is not obligated to extend sewer pipelines to serve new or transferred taps. The cost for sewer tap extensions is the responsibility of the proponent.

4. The existing service tap must be physically terminated and capped within 1 foot of the main sewer at the proponent’s expense. Such termination shall be constructed in a watertight manner under the review of a WMSD representative.

5. New tap agreements must be executed for each transferred tap.

6. Installation of the transferred tap must be observed by a WMSD representative and the cost for such will be the responsibility of the tap purchaser.

7. If multiple taps are purchased for a single parcel, such taps shall be assigned to new lots, if the parcel is later subdivided. Other provisions of the District’s Development Review Policy shall apply at that time.

8. A transfer fee of $200 shall be pre-paid to WMSD for administrative and field review services.

9. Upon completion of the above items, WMSD will issue a written approval of the tap transfer. That document will require acknowledgement signatures from the tap seller and buyer. The responsibility for payment of the monthly sewer service fee will be transferred to the buyer upon execution of this document and will be billed at the next billing cycle without prorating between billing periods.

Such conditions may be changed from time to time by WMSD or as necessary for special circumstances. All other policies and procedures of WMSD shall apply.
