Volume I – Offer and Other Documents

This volume shall contain the offeror’s contractual documentation. These documents will be reviewed only for compliance with solicitation, FAR, or other statutory requirements and will not be evaluated as part of the source selection factors identified in FAR 52.212-2 Evaluation- Commercial Products and Commercial Services.

This volume consists of the actual offeror to enter into a contract to perform the desired work. It also includes required representations, certifications, and acknowledgements, justification for noncompetitive proposed subcontracts, identification of technical data to be withheld, any other administrative information, and a summary of exceptions and deviations taken. Although it incorporates them by reference, it does not physically include the other volumes.

Format and Content

Volume I - Offer and Other Documents, shall include the following documents (in the order listed):

a. Offeror shall submit a cover letter on official business letterhead that provides the following information and is signed by an individual who has the authority to enter into business with the BLM and bind the business to this contract. The cover letter shall include the company name, company address, SAM UEI, contact name and phone number.

b. Offeror Representations, Certifications, and Other Statements fully executed as required pursuant FAR 52.212-3 – Offeror Representations and Certifications – Commercial Products and Commercial Services. This provision is in the System for Acquisition Management (SAM.gov) where offerors should ensure the information is up to date. If this information is in SAM.gov then the offeror is not required to provide it with their quote. Additionally, even if the offeror has an active SAM.gov registration, if necessary, they should print and complete FAR 52.204-24 and submit with their quote.

c. Exceptions and Deviations taken to the contract and/or solicitation requirement and summary of Exceptions and Deviations taken on other Volumes.

Volume II – Factor 1: Technical Capabilities

This Volume consists of the offeror’s technical documentation/information provided in their quote. The technical quote will be evaluated according to criteria contained in FAR 52.212-2 Evaluation-Commercial Products and Commercial Services and it shall be specific and complete in every detail. To enable the evaluation of the technical quote strictly on the merit of the material submitted, no contractual price information is to be included in the technical quote.

a. The Technical Quote shall contain and clearly address each of the quote evaluation criteria contained in FAR 52.212-2 Evaluation-Commercial Products and Commercial Services of this solicitation.

b. Technical Quote Exceptions and Deviations shall identify and explain any exceptions or deviations taken or conditional assumptions made with respect to the technical requirements of the solicitation. Any exceptions taken must contain sufficient amplification and justification to permit evaluation. All benefits to the Government shall be explained for each exception taken. Such exceptions shall not, of themselves, automatically cause a quote to be termed unacceptable. However, a large number of exceptions or one or more significant exceptions not providing benefit to the Government may result in rejection of the quote(s) as unacceptable.

c. As a minimum, the Technical Quote must specifically respond to the following evaluation factors and the information shall be organized in the order shown on the following pages:

Factor 1: Technical Capabilities.

Offeror shall submit a technical quote to address, at a minimum, the following items:

a. Knowledge and Skill

1. Provide a detailed description of knowledge, experience, and skill on how you would trim wild horses and burros’ hooves. The offeror shall include photos showing how they trim hooves.

2. Provide a list of key personnel and related experience.

3. Offeror must provide certification that no member of the corporation, or any person(s) named in the proposal, have been convicted of, nor are currently under indictment or investigation for, any cruelty to animal charges. Failure to certify will render the submission non-responsive and proposal will NOT be evaluated or considered for award.

b. Equipment

1. Offeror shall explain in detail the equipment to be used to safely trim wild horse and burros’ hooves.

c. Availability

1. Offeror shall describe their ability to be at the Rock Springs, Wyoming WH&B facility, for an entire day or multiple days, with only a 5-day notice.

Include only information relevant to this project and the contractor's quote only. Provide a narrative which address each item described above, at a minimum.

Volume III - Factor 2: Price Quote

Provide a separate price quote. The price quote shall provide a firm fixed unit price per head for hoof trimming as identified in Attachment 2 – Price Schedule. Firm fixed unit pricing is required for all performance periods (each year/contract line-item numbers (CLINs)), then multiply unit price by quantity for an estimated subtotal, then total these subtotals for a total period of performance value, and then total each period of performance for a total price quote value. Offeror’s quoted unit prices shall include, but are not limited to, all labor, equipment, materials, State and Federal taxes including workman’s compensation.

Quotes that omit unit pricing for any period may be considered unacceptable with no further consideration for award.

QUOTE SUBMISSION CHECKLIST

a. Acknowledged receipt of all solicitation amendments (if applicable).

b. Offeror Representations, Certifications, and Other Statements fully executed as required pursuant FAR 52.212-3 – Offeror Representations and Certifications – Commercial Items. This provision is in the System for Acquisition Management (SAM.gov) where offerors should ensure the information is up to date. If this information is in SAM.gov then the offeror is not required to provide with their quote. Additionally, even if offeror has an active SAM.gov registration, if necessary, they should print and complete FAR 52.204-24 and submit with their quote.

c. Provided Technical Capabilities.

d. Complete pricing information as identified in Attachment 2 Price Schedule.

e. Read entire FAR Clause 52.212-1, Instructions to Offerors-Commercial Products and Commercial Services and FAR 52.212 Addendum (Attachment 6) to ensure compliance.

f. Limitations on Subcontracting. In this contract there is a limit on the amount of work that can be subcontracted to businesses that are not “similarly situated” to the prime contractor. A similarly situated subcontractor is a business that would have qualified under the set-aside that was used for this acquisition.

The prime contractor shall not pay more than 50 percent of the amount paid by the government for contract performance to firms that are not similarly situated.

The offeror shall submit with their quote a subcontracting plan that identifies any portion of the contract that will be subcontracted and shall indicate if the subcontractor(s) are similarly situated as the prime contractor or not. If work under this contract will not be subcontracted, the offeror shall submit with their quote a certification stating that they will perform all services under this contract.

The BLM must review the contractor’s performance to monitor compliance with the limitations on subcontracting rules at the end of each performance period, including optional periods, and at the end of the total period of performance. The table below identifies the information the contractor will need to provide to the Contracting Officer at the end of each performance period.
