BRAND NAME REQUIREMENT JUSTIFICATION TEMPLATE

(For Simplified Acquisitions < $150,000)

1. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED

2. JUSTIFICATION FOR SOLICITING A BRAND NAME

Air Force Civil Engineering Center (AFCEC) guidance requires that all current software be placed on the coin V1 server. ALC is the only software that is tied to the coin V1 server and converting all remaining HVAC systems to run Automated Logic Controls fulfills the guidance from AFCEC and the needs of the government to retake control of the bases systems. ALC software therefore represents the only responsible source to fulfill this requirement.

3. EFFORTS TO OBTAIN COMPETITION

Efforts to obtain competition mainly focused on attracting interest from authorized dealers of Automated Logic Controls. Only one dealer is located within the state of California and no other supplier was willing to provide services due to the vast distance between their own operations and Vandenberg SFB. There is no alternative supplier of this software within the state.

4. STEPS TO PRECLUDE FUTURE BRAND NAME AWARDS

Future brand name awards of this nature can be avoided if the Civil Engineering Squadron maintains control of their systems and hire/employee technicians capable of working on multiple systems. Software licensing requirements will continue to be difficult to avoid and the government should invest in its own software production and maintenance.

5. OTHER FACTORS: The HVAC control system currently in place is outside the control of CES and represents a risk to mission assurance. This system must be consolidated under one type of software and ALC is currently the sole operationally sound system. Soliciting brand name for this software is in the best interest of the government and will restore control the most efficiently.

6. CONTRACTING OFFICER’S DETERMINATION

The 30th Civil Engineering Squadron currently controls various HVAC systems with both Automated Logic Control (ALC) and Alerton software. CES has lost the ability to control HVAC systems that are currently controlled by Allerton software and requires a highly qualified technician to install ALC software on all remaining systems.

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a brand name is reasonably available.
