About this file

This document provides details on a two-phased evaluation process for solicitation number 70US0923R70093579 to acquire forensic document examination services. In the first phase, offers will be evaluated on document analyst qualifications, personnel availability, and price to establish a competitive range of 3 to 5 offers. Offers not meeting minimum requirements or considered non-responsible or with an unreasonable price will be excluded. Selected offers will then submit proposals in phase two for evaluation of management approach, past performance, and staffing plan, which will be more important than price in a best value determination. The Department of Homeland Security U.S. Secret Service intends to award an indefinite delivery/indefinite quantity contract between September 20-30, 2023 for these services.

Phased Evaluation Addendum to FAR 52.212‐2

A. Phased Evaluation. Government intends to use a two-phased approach to evaluate offers, as follows:

(1) Phase I, Firm Hard Down-Select Process

(a) A tradeoff analysis will not be conducted during this phase.

(b) Offerors are required to submit proposal elements for Factor 1, as defined in the RFP Instructions to Offerors Sheet no later than 5 pm EST September 6th.

(c) During Phase I, the government will conduct a responsibility determination and evaluate Factor 1 (Document Analyst Qualifications), Factor 2 (Personnel Availability) and Factor 6 (Price) to establish a competitive range.

(1) Factors 1 and 2 will be evaluated in accordance with the evaluation criteria in Instruction to Offerors, Evaluation Criteria, Addendum to FAR 52.212-2.

(2) Upon initial review of resume(s), Offerors who have 2 or more proposal resumes submitted that demonstrate their Senior Document Analyst(s) have the following competencies will be considered for entry into the competitive range:

(a) Analyst(s) resume(s) demonstrate 3 years’ experience working within an ISO 17025 accredited laboratory.

(b) Analyst(s) resume(s)meet the minimum qualifications listed in Instruction to Offerors, Evaluation Criteria, Addendum to FAR 52.212-2 for both Factors 1 and 2.,

(c) Analyst(s) resume(s) demonstrate completion of the Competency Training Certificate (Collaborative Testing Services 2022 Handwriting Examination Test).

(3) Offerors whose analysts’ meet the evaluation criteria and requirements for paragraph (2a) – (2c) above, who are considered responsible and whose price is determined fair and reasonable based on adequate price competition may be considered for entry into the competitive range

(4) Factor 6 will be evaluated separately by the Contracts Team and will be evaluated for price fair and reasonableness, using adequate price competition as the primary basis. If adequate price competition does not exist, Price will be fully evaluated in Phase II using the price analysis techniques contained in the Instruction to Offerors, Evaluation Criteria, Addendum to FAR 52.212-2.

(d) After conducting these evaluations, for purpose of efficiency, the government intends to limit the competitive range to only 3-5 of the most highly rated offerors. The Government does not anticipate heavy competition on this requirement but due to fiscal year end constraints should heavy competition exist, the government reserves the right to only invite the 3-5 highest rated offerors into Phase II.

(e) Offerors may be excluded from the competitive range if their Representations and Certifications in sam.gov are not current or if the Offeror is determined to not be responsible IAW FAR 52.209-7. Offerors who do not meet the qualifications in paragraphs (2a) – (2c) will be excluded from the competitive range.

(f) Offerors excluded from the competitive range shall not be allowed to submit revised proposals and will be eliminated from consideration for award and ineligible to proceed to Phase II. Written notice of the competitive range decision will be provided to unsuccessful offerors. Offerors excluded, or otherwise eliminated from, the competitive range will not be further considered or eligible for award.

(g) Offerors included in the competitive range will receive a written notice (approximately Sept 6th) of their selection to proceed to Phase II. Seven calendar days after receipt of this notice (approximately September 15th 2023), Offerors in the competitive range will be required to submit proposals for Factors 3-5. Offerors within the competitive range are not allowed to provide proposal revisions to their Phase I proposal, as the government intends to award without discussions. Therefore, offerors initial proposal should contain the Offeror’s best terms from a cost or price and technical standpoint. The government reserves the right to conduct discussions if the CO later determines them necessary.

(2) Phase II Source Selection Decision.

(a) The government will continue its consideration by inviting those who were included in the competitive range to participate in Phase II. During the second phase, the government will evaluate Factors 3-5. Following Phase II, the Government will make award using a best value approach, as defined under the Bases if Award section below.

(b) The technical team will evaluate Factors 3-5 against the criteria listed in the RFP Instructions to Offerors Sheet and will assess using the following confidence ratings.

Each factor will receive its own confidence assessment rating.

High Confidence

The Government has high confidence the offeror understands the requirements, proposes a sound approach, and will be successful in performing the contract with little or no Government Intervention.

Some Confidence

The Government has some confidence the offeror understands the requirements, proposes a sound approach, and will be successful in performing the contract with some Government Intervention.

Low Confidence The Government has low confidence the offeror understands the requirements, proposes a sound approach, and will be successful in performing the contract even with Government intervention

(c) Offeror proposals will be carefully evaluated in accordance with the aforementioned confidence ratings and price evaluation.

B. BASIS OF AWARD

Award of the contract will be made to the Offeror whose proposal represents the best value; whose proposed price is determined reasonable; and is considered responsible within the meaning of FAR

9.104. The evaluation will be based on the demonstrated capabilities of the Offeror in relation to the requirement, as set forth in the solicitation.

During Phase I, the Government will not conduct a tradeoff analysis but will evaluate Factors 1, 2 and 6 to establish a competitive range.

Offerors who are either determined to NOT be responsible, whose price is not fair and reasonable or who do not meet the minimum requirements for Factors 1 and 2 will be excluded from the competitive range.

Offerors who do meet all these requirements may also be excluded for efficiency purposes, should it be necessary.

The Government does not anticipate heavy competition on this requirement but due to fiscal year end constraints should heavy competition exist, the government reserves the right to only invite the 3-5 highest rated offerors into Phase II.

Offerors remaining in the competitive range will be invited to proceed to Phase II.

Phase II, the Government will evaluate Factors 3-5 and will use these factors, as well as Factor 6 (Price), to select the best value offer by conducting a best value tradeoff analysis.

The Government’s final best value decision will be determined based on a comparative assessment of proposals against the source selection criteria. Factors 3, 4 and 5 are of equal importance and individually each are more important than Factor 6 (Price). All non-price factors, when combined, are significantly more important than Price.

In conducting this analysis, the Government is more concerned with obtaining performance capability superiority rather than a low overall price. However, the Government will not issue an award to an Offeror who presents a significantly higher overall price to achieve only slightly superior performance capabilities.

To receive award, the Offeror must provide the best value to the Government (after the tradeoff analysis completes) and must be determined responsible, fully demonstrating the Offeror is able to accept task orders at time of award and can begin execution of the first task order (minimum order quantity) within 30 days of award.

A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Government intends to award the IDIQ and issue the first task order between September 20th – September 30th, 2023.
