EXHIBIT A

STATEMENT OF WORK

1. PURPOSE; SCOPE OF WORK

The beach at Bandon State Natural Area is a historical western snowy plover breeding site that is currently used by breeding snowy plovers. The available habitat changes dramatically over the course of a single breeding season due to sand drifting, erosion, and accumulation of driftwood and other debris. Snowy plovers require open, flat expanses of sand to successfully raise their young and winter storms have resulted in erosion of much of the former small habitat area. Non-native vegetation (mostly beachgrass and gorse) have taken over the area that used to be dry open areas of sand available to plovers. The plover breeding period begins March 15 of each year and extends to September 15 each year, which makes the timing of this work critical since plover breeding areas are restricted from entry once the season begins.

This Statement of Work includes invasive plant treatments on 40 acres of dune habitat south of the City of Bandon between China Creek and New River, at Bandon State Natural Area, Coos County, Oregon.

Dense vegetation creates barriers to movement for the western snowy plover. The plovers require travel corridors of bare sand between the wrack line and their nesting sites in dry sand east of the extreme high-tide mark. To restore the habitat for the plovers, the Contractor must remove vegetation, including non-native beachgrass, gorse and other shrubs that have overgrown the previously open sandy area. OPRD will work closely with the Contractor to define the parameters of this aspect of the work in the field.

Examples of a completed plover habitat restoration areas can be viewed at the Coos Bay North Spit, Sitka Sedge State Natural Area and Nehalem Bay State Park and photos are included in this document for reference.

The area to be treated includes approximately 20 acres of gorse (Ulex europaeus) mostly on the east side of the project area and approximately 20 acres of European beachgrass (Calamagrostis arenaria) mostly on the west side of the project area (Figure 1). Project work will involve mechanically mowing and mulching gorse (Ulex europaeus) patches, using a tracked vehicle with flail head mower (forestry mulcher) to 3-inch pieces in February 2023. Once gorse plants have resprouted to about 12” to 24” in height, the Contractor will spot spray resprouts with triclopyr, three to six months following mulching depending on growth rate. Work will also include spot spraying European beachgrass in February 2023.

The project area is designated as Conservation Area for the western snowy plover which limits access to the site between March 15 to September 15. Follow-up herbicide applications for gorse will need to be coordinated with OPRD staff to avoid impacts to nesting plovers in the area.

Work shall take place at Bandon SNA in Coos County, Oregon. During wet, winter months, the

Contractor will access the project area at the Tish a Tang Street beach access. Work taking place in late-spring and summer may allow for access to the project area at China Creek. Equipment can be left on site during the work period. The work site is adjacent to the beach and work will occur during winter on the Oregon Coast. Marine and coastal weather forecasts as well as beach hazards may be obtained from the U.S. Weather Service. The Contractor shall take responsibility, educate themselves and be prepared for the hazards likely to arise from weather conditions during the contract period. The site work is exposed, and suspension of work may at times be necessary during extreme storm periods. Tides can fluctuate greatly throughout the project period and in some cases range from about 2.0 to over 9.0 feet in one day. Strong winds from intense storms can push sea water onto the ocean shore producing storm surge. Inundation of beaches can cause dangerous working conditions on the ocean beach, which will be necessary for access to the site.

Historic Preservation Office. Coordinate with OPRD’s Contract Administrator to determine start date of project. Once a start date is agreed upon, Contractor shall submit a work schedule to the OPRD’s

Contract Administrator detailing dates of work and start and stop times for work;

OPRD’s Contract Administrator at least once per week and check-in by phone or in-person at least one other time during the week to discuss progress;

g. Use absorbent pads or other containment devices when fueling equipment to prevent spillage.

h. In the event of a fuel spill or hydraulic fluid leak, immediately notify the OPRD’s Contract

Administrator. Contractor is responsible for containment and cleanup as required by all applicable law, and to the satisfaction of the OPRD’s Contract Administrator;

i. Carry fire safety equipment with HazMat Kit and proper spill response kit (including at a minimum two bales of absorbent pads, with a minimum size designed specifically for petroleum clean-up and an absorbent boom at least 30 feet in length) for inadvertent fuel spill;

j. Operate all equipment in a safe and accident free manner, and wear appropriate personal protective equipment (PPE), at all times while at the work sites;

k. Notify OPRD’s Contract Administrator in the event of an accident that did or could result in damage to OPRD property, private property, or the public;

l. If cultural resources are discovered by Contractor, move to a different work area, flag suspect area, and immediately notify OPRD’s Contract Administrator and follow the Inadvertent Discovery Plan

(Exhibit C).

Cultural Resources may exist within the project site and that the existence and location of such Resources may be unknown at the time this Contract is executed. Contractor shall exercise due care in its Operations to ensure that, in the event any such Resources are discovered in the course of, or as a result of Contractor's Work, such Resources may be preserved in accordance with the Inadvertent Discovery Plan, Exhibit C and requirements of ORS Chapter 358.

iii. Protection of Cultural Resources. Contractor shall not remove any historic artifact or other

Cultural Resources from the project site. If any such items are discovered, Contractor shall

Contract 9243: Invasive Species Treatments at Bandon State Natural Area Page 15 follow the Inadvertent Discovery Plan (IDP) and immediately notify Agency’s Contract

Administrator.

m. Clean all vehicles prior to entering the property and before leaving OPRD property to remove noxious weed seeds.

n. Operate during the time between one-half hour after sunrise to one-half hour prior to sunset each day. No work will be done on weekends or holidays unless approved by OPRD’s Contract

Administrator.

2.1.2. Mobilization (Task 1)

i) Access for heavy equipment and contractors is possible from the Tish a Tang Street access point which is approximately 2 miles (one-way) from the project site. Work done later in the year may be accessible through the China Creek beach access. Please refer to Figure 2 for beach access locations. A drive on beach permit will be required for any vehicles on the beach as this area is otherwise closed to motor-vehicle traffic year-round. The equipment will need to travel north along the beach to access the area. Equipment may be left on site in an area selected between the OPRD Contract Administrator and Contractor, however, OPRD is not responsible for equipment if it should be lost, stolen or damaged. Contractor is responsible for

Mobilization/Demobilization (Move in/Move out) which includes movement of personnel, equipment, supplies and incidentals to and from the project site. During the summer and fall, the project site can be access from the China Creek beach access.

2.1.3. Mow and mulch gorse (Task 2)

ii) Mechanically mow and mulch gorse (Ulex europaeus) using a tracked vehicle with a flail head mower with mulching capability over approximately 20 acres. Gorse will be reduced to pieces no longer than 3 inches in length. Mulched gorse will remain on site to decompose.

iii) Equipment Performance Capabilities. Contractor shall use equipment necessary to perform the work outlined in this contract.

iv) All equipment shall be in good operating and mechanical condition and operated in a proper and safe manner. Contractor shall use equipment that meets all OSHA safety standards.

v) A skid steer and/or excavator equipped with a forestry mulcher head are required to mow and mulch gorse patches.

2.1.4. Spot spray European beachgrass herbicide (Task 3)

i) Spot spray European beachgrass (Calamagrostis arenaria) with herbicide using a formulation of 1% glyphosate and 1% imazapyr + 1% surfactant + blue dye over approximately 20 acres.
