About this file
This is a Non-Disclosure Agreement and Non-Use Agreement (NDA/NUA) for Federal Aviation Administration Announcement Number AAC-2026-ChBA, which concerns the procurement of the Alaska Automation Capability (AAC). The agreement requires authorized representatives of recipient organizations to electronically sign and submit the agreement to the FAA contracting officer prior to accessing export-controlled technical data related to the procurement. Recipients and their subcontractors and vendors must undergo pre-approval screening through the Department of Commerce's Consolidated Screening List to ensure they are not prohibited end users. All individuals with access to the export-controlled attachments must be identified to the FAA, and subcontractors and vendors cannot receive the data until they have executed their own signed NDA/NUA and Business Declaration Form.
The agreement restricts recipients from exporting, re-exporting, or disclosing the technical data to countries in group E:1 or E:2, nationals of such countries, or prohibited end-users without appropriate export licenses, in accordance with EAR99 marking requirements and Part 744 of the Export Administration Regulations. Recipients receive no commercial use rights to the data and must adopt operating procedures and physical security measures to prevent unauthorized disclosure. Upon completion of the announcement's purpose, recipients must destroy all technical data and copies and certify such destruction in writing to the FAA contracting officer, including a list of all subcontractors and vendors who received the data package. Recipients indemnify the U.S. Government against all liability arising from misuse or unauthorized disclosure. The agreement does not extend confidentiality obligations to data legally possessed prior to receipt, data entering the public domain through no fault of the recipient, or data disclosed by third parties without breach. Signed agreements must be submitted electronically to the AAC Contracting Officer at Helaina.K.Germosen@faa.gov.
