Addendum to FAR 52.212-2
A. Evaluation Process.
(1) Low Price Technically Acceptable Selection Process
(a) A tradeoff analysis will not be conducted.
(b) Each Offerors price will be evaluated separately by the government contracts team and will be evaluated for price fair and reasonableness, using adequate price competition as the primary basis. If adequate price competition does not exist, Price will be fully evaluated using the price analysis techniques contained in the Evaluation Criteria, Addendum to FAR 52.212-2. The result of this evaluation is to determine which Offeror represents the lowest price in accordance with the terms of the solicitation.
(c) The government contracts team will then determine if the lowest priced Offeror meets the responsibility parameters of the solicitation. The government will utilize FAR 9.104 and FAR clauses 52.209-5 (Certification Regarding Responsibility Matters (Aug 2020)), 52.209-7 (Information Regarding Responsibility Matters (Oct 2018)) and 52.209-11 (Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016)) to determine if the Offeror is Responsible and eligible for contract award.
(d) If the lowest priced Offeror is deemed Responsible and eligible for award, the government technical evaluation team will evaluate the technical (non-cost) factors for technical acceptability using FAR 52.212-2 and its Addendum. The technical acceptability factors include:
· Technical Acceptability Factor 1: Hardware Components and Suppliers
· Technical Acceptability Factor 2: Support Services
(e) At any point in this process, if the Offeror’s proposal fails to meet any of the criteria set forth in the solicitation the Government will discontinue evaluating that Offeror’s proposal and will evaluate the next lowest priced Offeror’s proposal using these same procedures. This process will continue until an Offer is determined to meet all parameters of the solicitation.
(g) If no Offeror is found to meet all the requirements, the government will enter into discussions IAW FAR 15.306 with all offerors to address deficiencies or concerns. If discussions do not resolve the deficiencies or concerns, the Government will resolicit.
B. Basis Of Award.
Award will be made to the Offeror or Offerors who is determined responsible in accordance with FAR 9.104, who meets the standards for the non-cost (technical acceptability) factors and offers the lowest evaluated price.
A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Government intends to award the IDIQ contract(s) and may an initial task order by July 24, 2024.
