10a; COMMUNICATIONS SECURITY (COMSEC) INFORMATION. Classified COMSEC information/material will be protected IAW DoD 5220.22-M (Ch 9, Sec 4) and NSA-CSS Policy Manual 3-16. Access to classified COMSEC information requires a final USG clearance at the appropriate level.
10e(1); SENSITIVE COMPARTMENTED INFORMATION (SCI). Access to SCI information may be required for performance on this contract. SCI furnished in support of this contract remains the property of the USG. SCI must be stored and maintained in accredited and approved facilities. All SCI nomination packages will be processed by the SCO Special Security Office (SCO/SSO). SCI nomination packages must include: (1) SCI Nomination Letter on Company Letterhead, (2) JPAS Printout, (3) Copy of DD Form 254, (4) SCI Pre-Screen Interview, (5) Nominee’s home address, place of birth and home phone #, (6) Pre-Screening Questionnaire (PSQ) and applicable templates (for any “yes” answers), (7) If there is an open investigation, a copy of their complete SF86. If there have been any changes since the investigation opened, submit a SF86C, (8) If the investigation is closed, submit a SF86C and (9) Send Visit Access Request to DDAAUS4 (for personnel working on-site at SCO facility). Submit complete package, encrypted, to sco.security@sco.mil.
10e(2); NON-SCI INTELLIGENCE INFORMATION. Access to non-SCI intelligence information may be required for performance on this contract. SCO Security has exclusive security oversight for Non-SCI intelligence information released or developed under this contract. Non-SCI intelligence information furnished in support of this contract remains the property of the USG. Non-SCI intelligence information must be stored and maintained in accredited and approved facilities. Further dissemination to any individual, company or government organization is not authorized without approval from the CSA.
10.f; Discussion, storage, or processing of SAP information associated with this contract will be conducted in facilities specifically accredited by the Army SAPCO (or designee), or equivalent component-level SAPCO. Contact the appropriate servicing SAPCO for approved SAP facilities locations. SAP activities are governed by Revision 1 Department of Defense Overprint to the National Industrial Security Program Operating Manual Supplement, 1 APR 04, and applicable program security classification and procedure guides. Component-managed SAPFs and SAP Temporary Secure Working Areas (TSWA) are governed by JAFAN6/9. Access to SAP information requires employees undergo additional personnel security screening and meet the SAP access standards delineated in the applicable DoD directives and policies. SAP inspections and security oversight while in component facilities are under the cognizance of the SAPCO, as appropriate. Additional SAP security requirements may apply at alternate locations/facilities based on service/component Command requirements. Locations/facilities will provide specific guidance as required. SAP inspections conducted at contractor facilities are under the security oversight of the Defense Security Service (DSS) unless officially relieved of their oversight responsibilities.
10g; NORTH ATLANTIC TREATY ORGANIZATION (NATO) INFORMATION. Access to NATO information may be required for performance on this contract. The government PM is the designated representative that will ensure the Contractor Facility Security Officer (FSO) and concerned employees are NATO briefed prior to access being granted. The Prime contractor must receive approval from the Government Contracting Authority (GCA) to grant NATO accesses to a subcontractor. Access requires a final US Government clearance at the appropriate level. Forward NATO classified materials needed by the contractor only from a Service Sub-registry directly to the contractor concerned. Special briefings are required for access to NATO information. Prior approval of the government program manager is required for subcontracting. Access to NATO information requires a FINAL U.S. Government clearance at the appropriate level and special briefings. Individuals must have a briefing in accordance with United States Security Authority for NATO (USSAN) Affairs Instruction 1-69 (5100.55 Enclosure 2), "United States Implementation of NATO Security Procedures", Section VI. The briefing ensures individuals with access to NATO information are aware of pertinent security regulations for safeguarding NATO classified information and the consequences of negligent handling. The use of the Central U.S. Registry (CUSR) is mandated for receiving and transferring NATO materials. The Government Contracting Activity must authorize the hand-carrying of NATO classified material across international borders. This will only be authorized when urgent situation exists. Designated couriers must have a NATO Courier Certificate. The contractor is not authorized to destroy controlled classified material.
10h: Foreign Government Information (FGI) is not releasable to contractor employees who have not received a FINAL clearance at the appropriate security level. Written concurrence of the KO is required prior to subcontracting.
10i; ALTERNATIVE COMPENSATORY CONTROL MEASURES (ACCM). Access to ACCM information may be required for performance on this contract. FP/ACCM Access required. REQUIRED FOR ON-SITE ONLY. Individuals workings with ACCM/FPP will be required to have additional training on the handling and safeguarding of ACCM/FPP material and shall comply with the following:
a. All ACCM/FPP work will be done “onsite” at the government facility. No ACCM/FPP material will be stored/transferred/viewed at the contractor facility.
b. The contractor will safeguard all ACCM/FPP information in accordance with CJCSM 3213.02 Series, “Joint Staff Focal Point Program” and the Program Security Plan (PSP) for the specific program(s).
10j; CONTROLLED UNCLASSIFIED INFORMATION (CUI). Access to CUI is required for performance on this contract. IAW DoDM 5200.01 Volume 4, EO 13556, 32 CFR Part 2002, NIST SP 800-171 Rev 1, DFAR Supplement Clause 252.204-7012 Version 2, and applicable guidance provided by the CSA, certain types of information require safeguarding or dissemination controls to ensure it is not released improperly. CUI categories include, but are not limited to: (1) Procurement and Acquisition Information (i.e., contractor proposals and source selection information), (2) Proprietary Data (i.e., information protected under the Trade Secrets Act, 18 USC §1905), (3) For Official Use Only(FOUO) Information(i.e., information that is exempt from release under The Freedom of Information Act, 5 USC §552), (4) Export Restricted or Controlled Technology (e.g., defense articles and technical data restricted by the International Traffic in Arms Regulations (ITAR), (22 CFR §§120-130), (5) Program-specific Financial Data, (6) Limited Distribution Unclassified Intelligence Information, (7) Law Enforcement Sensitive Information, (8) Personal Identifying Information (PII), (9) Critical Infrastructure, (I0) North Atlantic Treaty (NATO) Restricted or Unclassified Information, (11) DoD Unclassified Controlled Nuclear Information. At a minimum, all AGC technical program information should be marked as U//CUI.
10k; Additional notes: contractor may required access to SIPRNET and JWICS at Government Facility per task order requirements. Alternate and Compensatory Control Measures (ACCM) will be managed by the owning commands security protection plan as appropriate.
11c; RECEIVE, STORE AND GENERATE CLASSIFIED INFORMATION OR MATERIAL. Receiving, storing and generating classified information or material is required for performance on this contract. Access to classified information cannot be precluded. The contractor is not authorized to release program information to any activity or person, including subcontractors, without prior approval from AGC. Classified material generated on this contract shall be classified IAW provided classification guidance and applicable references. Automated Information Systems (AIS) must be certified and accredited by the appropriate CSA for the AIS prior to processing classified information for AGC programs. All classified information received or generated under this contract is the property of the USG.
11d; Contractor must provide adequate storage at their facility for classified hardware to the level of SECRET COLLATERAL. Contractor may not process information of a higher classification at their facility.
11f; HAVE ACCESS TO U.S. CLASSIFIED INFORMATION OUTSIDE THE U.S., PUERTO RICO, U.S. POSSESSIONS AND TRUST TERRITORIES. Contractor may require access to classified information outside the U.S. to include its possessions and Trusted Territories to include OCONUS locations including but not limited to Korea, Germany,Italy, Canada or Japan.
11g; Access to DTIC and other types of data may be necessary to meet the requirements of the contract. The contractor/subcontractor shall prepare and process a DD Form 1540 and DD Form 1541 through the AGC.
11 h. The Contractor will store accountable COMSEC information at their cleared facility per task order requirement.
11j; HAVE OPERATIONS SECURITY (OPSEC) REQUIREMENTS. All organizations participating in AGC programs have an OPSEC requirement. The PM at each work location (government and industry) is responsible for the protection of both unclassified and classified AGC technical program information. The PM will: (1) Not provide any AGC technical program information (unclassified or classified) to any individual or organization (this includes periphery program support; contracts, finance, etc.), until they have read and understand program-specific security requirements (This applies only if the individual has a Need- To-Know (NTK) for technical program information) for execution of their duties.
If they do not have a NTK for technical program information (e.g. - individual only requires unclassified administrative, non- technical program information, the local PM and/or designated Security POC is responsible for reviewing the administrative program information prior to release, ensuring there are no compilation concerns.), (2) Designate a Security POC and provide them the appropriate resources required to protect technical program information, (3) Strictly enforce NTK and (4) Implement OPSEC measures. Each organization is required to create a program-specific OPSEC Plan (or incorporate OPSEC into an existing plan).
11k: Courier Service is authorized per task order requirements.
11l; RECEIVE, STORE OR GENERATE CONTROLLED UNCLASSIFIED INFORMATION (CUI). Receiving, storing or generating CUI is required for performance on this contract. Storage and transmission requirements set forth in (1) DoD Manual 5200.01, Volume 4; DoD Information Security Program: Controlled Unclassified Information (CUI), 24 Feb 2012, (2) Executive Order (EO) 13556, Controlled Unclassified Information, 4 Nov 2010, (3) Code of Federal Regulations Title 32 Part 2002 (32 CFR Part 2002), Controlled Unclassified Information (CUI), 14 Sep 2016, (4) NIST Special Publication 800-171 Rev I, Protecting Controlled Unclassified Information in Nonfederal Systems and Organization, updated 28 Nov 2017 (includes updates from 7 Jun 2018), (5) DFARS Clause 252.204-7012 Version 2, Safeguarding Controlled Technical Information, Aug 2015, and any other applicable guidance provided by the CSA must be adhered to. CUI must be transmitted by DoD-approved encryption software, approved secure communications systems, systems utilizing protective measures such as Public Key Infrastructure (PKI) or USPS mail.
CUI PROTECTION MEASURES. Protection measures utilized in the mitigation plan must employ at least one of the following mitigations; (1) Encryption of data at rest on unclassified servers (in addition to end-point encryption for data at rest),(2) Off-network storage/repository for data protection and segregation (e.g.-full air gapped system), (3) FOUO accredited software suite (i.e. - APAN, D2IE, TENS, etc.), (4) MS or Adobe encryption with password protection for each file.
