About this file

This is a Data Use Agreement Template document issued by the Colorado Department of Public Health and Environment (CDPHE) that establishes the terms and conditions for contractors or data users to access and utilize confidential health information. The agreement outlines the obligations of both the data owner (CDPHE) and the data user, including requirements for secure transmission of identifying information, limitations on access and use of confidential data, and procedures for handling the information. Data users are restricted to using information solely for activities described in the attached Statement of Work, must limit access to only essential personnel, and are prohibited from contacting data subjects or attempting to identify individuals from the data provided. The agreement requires all personnel with access to confidential information to sign a corresponding Confidentiality Agreement prior to receiving any data.

The document specifies critical safeguarding and compliance requirements for data users, including implementation of appropriate administrative, technical, and physical security measures and mandatory reporting of any unauthorized use or disclosure within 48 hours of discovery. All individuals accessing CDPHE data must sign Attachment B—the Confidentiality Agreement—which contains ten specific acknowledgments covering proper data use, confidentiality protection, non-disclosure to third parties, prohibitions on public release, and adherence to immigration enforcement restrictions under federal law unless required by court order or legal compliance. Data users must obtain individual authorizations for research activities unless an Institutional Review Board or Privacy Board approves a waiver, and all records must be destroyed or returned to CDPHE within 30 days of work completion with written notification provided. The template serves as the standard instrument for establishing data governance protocols between CDPHE and external entities participating in the Colorado Health Systems Directory project.
