5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATION OR THE NATURE OF ACQUISTION REQUIRES USE OF CITED

AUTHORITY:

Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. DLA requires a product peculiar to one manufacturer that is a brand name item.

Procurement of this technology is sensitive for US Government wide counterintelligence operations and open solicitation of proposals could compromise operationally sensitive contracts for multiple US Government Agencies with enterprise-wide deployments. Open competition for potential solutions would reveal vulnerability in current counterintelligence capabilities that could negatively impact national security.

DLA requires a system that is compliant with regards to DISA STIGs and the IA controls required for certification and accreditation on SIPRNET (DIACAP) and JWICS (ICD 503 and formerly DCID 6/3). The Forcepoint Innerview solution currently has an ATO on SIPRNET and JWICS as well as numerous other classified and unclassified networks. Each DOD service (Army, Air Force, Navy, and Marine Corp) uses Forcepoint InnerView system on their classified networks and having Forcepoint InnerView allows DLA to share policies jointly developed by DOD services. DLA does not have the counterintelligence resources that DOD services have, and DLA can only leverage these resources by using Forcepoint DataView for InnerView software as no other software is compatible to import these policies.

The vendor is the only authorized distributor of these goods and services and represents the best available price.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

Forcepoint is the only known company that provides Forcepoint InnerView software and support. The requirement will be synopsized to solicit Forcepoint Dataview for InnerView Software Subscription within SAMS.gov. All authorized dealers will be given an opportunity to submit an offer. Only one vendor is known to provide software and support for Forcepoint DataView for InnerView, based on market research.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404-l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE

HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET

RESEARCH WAS NOT CONDUCTED:

A review of GSA FSSs indicates only Forcepoint is an authorized seller of DataView for InnerView Licenses Subscription.

9. ANY OTHER FACTS SUPPORTINGTHE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

Forcepoint equipment and software is a key application across the Enterprise. DLA needs to obtain this Forcepoint software in order to meet DoD guidance for protecting its sensitive information.

Procurement of this technology is sensitive for US Government wide counterintelligence operations and open solicitation of proposals could compromise operationally sensitive contracts for multiple US Government Agencies with enterprise-wide deployments.

OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT

ACQUISITION FOR SUPPLIESOR SERVICES:

DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government, as a continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure future full and open competition. Requirements will continue to be posted on SAMS.gov to ensure fair opportunity is given and no other providers are available.
