1.0 GENERAL INFORMATION
1.1 This is a non-personal services contract to provide service and maintenance for Government-owned multi-vendor Test Measurement & Diagnostic Equipment (TMDE) (427 items).
1.2 Description of services/introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the calibration and maintenance as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this PWS.
1.3 Background: Walter Reed National Military Medical Center requires calibration & maintenance coverage of multi-vendor TMDE. This equipment cannot be maintained by in-house Biomedical Equipment Technicians, so a full-service maintenance agreement is required.
Without coverage the TMDE would have to be maintained on a time & material basis which is more costly than having a contract and will result in longer downtimes.
1.4 Objectives:

1.5 Scope: The Contractor shall maintain all equipment listed in the Performance Work Statement (PWS). The Contractor shall maintain the systems within the Original Equipment Manufacturer (OEM) specifications.

1.7 Administrative specifications
1.7.1 Place of performance: The work shall be performed at the Biomedical Engineering Division, Walter Reed National Military Medical Center, Naval Support Activity Bethesda, 8901 Wisconsin Ave, Bethesda MD 20889.
1.7.2 Recognized Federal holidays: The contractor is not responsible for providing unscheduled support/service on United States Federal Government holidays.

1.7.3 Hours of operation: The contractor is responsible for conducting business Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
1.7.3.1 Hours of coverage for this contract will be:
On-Site Support: 0600 to 1800 Eastern Standard Time.
Telephone Support: Vendor shall be available between 0730 to 1700 Eastern Standard Time.
1.7.4 Emergency Services: On occasion, services may be required to support an activation or exercise of contingency plans outside the normal duty hours. The contractor will provide a quote to the COR/CM prior to performing any emergency services.
1.8 Contractor Travel: RESERVED.
1.9 Other Direct Costs (ODC): RESERVED.
1.10 Quality
1.10.1 Quality Control (QC): The contractor shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure nonrecurrence of defective services. The contractor’s QC program is the means by which the work complies with stated requirements. After acceptance of the Quality Control Plan (QCP) the contractor shall receive the CO’s acceptance in writing of any proposed change to his QC system. See Part 7, Technical Exhibit 1 - CDRL A001.
1.10.2 Quality assurance (QA): The government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan provides a systematic method for the Government to evaluate performance and to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.11 Contractor personnel
1.11.1 CAC requirements: RESERVED.
1.11.2 Installation Access and Regulations: The Contractor’s Point of Contact shall comply with all access requirements for the Naval Support Activity Bethesda. Smoking is strictly prohibited inside any buildings on NSAB. Possession of weapons, alcohol, or pharmaceuticals that are not over the counter and not prescribed to the individual/family is prohibited on NSAB premises.
Enclosed containers, including tool kits, are subject to search. Violations NSAB regulations may result in citation answerable in the United States (Federal) District Court. Violation of any policy which results in lost time for Contractor is the sole responsibility of the Contractor and shall not be charged to the Government.
1.11.2.1 Contractors must verify that individuals being dispatched to provide services meet all requirements to access Naval Support Activity Bethesda.
1.11.2.2 Base Access: Contractor personnel shall have valid identification (i.e. Driver’s License, Sate Identification) and present it when requested. If Contractor personnel does not have an approved access pass or has been placed on the access list, they may not be allowed on the installation. To be placed on the access list the contractor will contact the COR or CM. In order to travel freely onto and off of military installations, Contractor personnel may have to undergo background checks, the Rapid Gate process, the Defense Biometric Identification System (DBIDS) process, or a similar process.
1.11.2.3 Parking: It is the responsibility of the Contractor personnel to park in the appropriate designated parking areas. Information on parking is available from the COR or CM. Parking can be requested from the COR/CM or any Biomedical Engineering personnel. Parking requests should be submitted at least 72 hours in advance; in cases of urgent service requests, contact the COR/CM as soon as possible. The Government will not be responsible for any fines incurred by the Contractor’s personnel for parking outside of designated areas.
1.11.2.4 Government Right of Refusal: U.S. Navy Naval Station Bethesda and WRNMMC reserves the right to reject any of the service vendor’s personnel and refuse them permission to enter the premises or work on Government-owned equipment. This right may be exercised at any time. The reasons for rejections may include lack of training and experience, but may also include, but not be limited to behavior, attire, security concerns, and immigration status.
1.11.3 PHYSICAL Security: RESERVED.

1.11.5 Lock combinations: RESERVED.
1.12 Key personnel (Contractor): The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the CO.
The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 0730 to 1800 EST, Monday thru Friday except Federal holidays.
1.13 Data rights: RESERVED.
1.14 Reporting
1.14.1 Contractor Manpower Reporting (CMR): RESERVED.
1.14.2 Non-Disclosure Agreement (NDA): RESERVED.
1.14.3 Government’s COR: The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor contractor's performance and notifies both the CO and contractor of any deficiencies; coordinate availability of government furnished property; and provide site entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.
1.14.4 Post award conference/periodic progress meetings: The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The CO, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance.
At these meetings the CO will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.15 Contractor Identification
1.15.1 Contractor personnel performing services in a contractor capacity in a government facility are required to possess and wear an identification badge that displays his or her name and the name of their company. All contractor personnel shall identify themselves as contractor support personnel in all forms of communication.
1.15.2 Contractor personnel will be required to attend meetings or otherwise communicate with Government and/or other contract representatives to meet the requirements of this order.
Contractor personnel shall make their contractor status known during introductions.
1.15.3 Contractor personnel, while performing in a contractor capacity, are prohibited from using their retired or reserve component military rank or title in any written or verbal communications associated with the contracts in which they provide services.
1.16 Contractor Access to Health Affairs (HA)/DHA Network(s): RESERVED.

PART 2
2.0 DEFINITIONS, ACRONYMS, AND APPLICABLE
PUBLICATIONS/INSTRUCTIONS
2.1 Definitions:
2.1.1 Calibration: This activity should be the procedures for the mechanical adjustments of the device to ensure consistent, standardized performance or output as per the original equipment manufacturer recommendations.
2.1.2 Category D: Information Technology (IT) and Telecommunications Services (called D- Services)
2.1.3 Category R: Support (Professional/Administrative/Management) Services (called R- Services)
2.1.4 Contract Manager (CM): A Government employee appointed by the Chief of Biomedical Engineering to monitor performance of service and maintenance contracts.
2.1.5 Contracting Officer (CO): A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
2.1.6 Contracting Officer’s Representative (COR): An individual, including a contracting officer’s technical representative (COTR), designated and authorized in writing by the CO to perform specific technical or administrative functions. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.7 Contractor Performance Assessment Reporting System (CPARS): Web enabled application that collects and manages the library of automated CPAR’s.
2.1.8 Corrective Maintenance: Repair, adjustment, calibration, software manipulation and updates or other action taken to return a piece of equipment to original manufacturers specifications following a failure, damage, or other incident that causes the product to no longer perform within the original specifications.
2.1.9 Defense Medical Logistics Standard Support (DMLSS): The automated procurement, maintenance, and supply system utilized to document various material management functions within the command, and throughout the Department of Defense.
2.1.10 Field Service Engineer (FSE): The employee/representative of the contractor who will be performing the services.
2.1.11 Field Service Report (FSR): Documentation completed by vendor personnel to officially record all instances of contracted troubleshooting, work, and services conducted on equipment.
Specifics on required reporting details can be seen in Section 3.9.2. of the PWS.
2.1.12 Inspections: The activity of doing functional testing and safety inspections of a medical device at regular intervals to ensure that the equipment is safe for use in accordance with manufacturer’s recommended procedures.
2.1.13 ISO 9001: The ISO 9000 series is a set of five individual, but related, international standards on quality management and assurance. These standards were developed to effectively document the quality system elements to be implemented in order to maintain an efficient quality system in a company. ISO 9001 is the most comprehensive standard covering design, manufacturing, installation, and servicing systems.
2.1.14 Medical Treatment Facility (MTF) or Patient Care Facility: All gross square footage for building with a primary function of delivering Government health care services. (i.e. hospital or clinic, including all activities providing outpatient and/or inpatient health services for authorized patient care)
2.1.15 Nonpersonal services contract: a contract under which the personnel rendering the services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.
2.1.16 Original Equipment Manufacturer (OEM): The company which has created a specific model of product/device.
2.1.17 Preventative Maintenance: Preventative maintenance is used to describe those periodic and “as required” services necessary to maintain equipment in an operating condition which minimizes corrective maintenance. This including but not limited to calibration, adjustment, lubrication, updating software for security, safety or system functionality issues, as well as that testing required to maintain a safe environment of care which includes electrical safety testing, output testing, replacement of batteries and other shelf life components on a scheduled basis (which becomes corrective maintenance if the component fails due to lack of preventive maintenance).
2.1.18 Quality Assurance (QA): Actions, including inspections, performed by the Government to determine whether products and services conform to contract requirements.
2.1.19 Quality Assurance Evaluator (QAE): A Government employee responsible for performing quality assurance functions for a contracted service.
2.1.20 Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance. The Government may either prepare the QASP or require the offerors to submit a proposed quality assurance surveillance plan for the Government’s consideration in development of the Government’s plan.
2.1.21 Quality Control (QC): Actions, including inspections and preparation of inspection records, performed by the Contractor to ensure that products and services conform to contract requirements.
2.1.22 Scheduled Parts Replacement (SPR): This is the activity of listing of parts that need replacing at certain intervals. This may be either hour-based or date-based, in accordance with manufacturer’s specifications.
2.1.23 Uptime: Uptime is defined as that time, during the clinical areas’ normal business hours, when the equipment is available for clinical use without restrictions to the quality of the results, and without safety hazards to the patient, staff, or visitors.

4.0 CONTRACTOR FURNISHED ITEMS AND SERVICES
4.1 Services: The Contractor:

4.2 General: The contractor shall furnish all supplies, equipment, facilities and services required to perform work listed under Section 5 of this PWS.

PART 5
5.0 SPECIFIC TASKS
5.1 Performance Work Statement: The Contractor shall provide equipment maintenance services in accordance with OEM specifications. The Preventative Maintenance/Calibration should be available on-site for the majority of the covered equipment. Upon completion of each of each service, the Contractor must provide a signed service report, in English, to the COR and Contract Manager (CM) for data entry into DMLSS. The service report shall include all information outlined in Section 5.7.
5.2 Preventative Maintenance (PM)
5.2.1 The contractor shall insure that planned maintenance is performed within the month the preventative maintenance is due. Preventative Maintenance should be completed no later than the 20th of the month due. Preventative maintenance visits shall include complete inspection and testing of the equipment in accordance with OEM recommended guidelines or agreement between the contractor and the government.
5.2.2 100% Completion: Under the circumstances of Sections 5.2.3 & 5.2.4, the COR/CM and Contractor shall arrange a means of complying with the requirements for preventive maintenance at no additional cost to the Government. Equipment determined missing, lost, or stolen shall be removed from Section 1.5.1 via official contract modification.
5.2.3 Frequency: The frequency of preventative maintenance will be determined by Original Equipment Manufacturer recommendation or local risk assessment. All equipment listed in Section 1.5.1 will receive preventative maintenance and or calibration at least once a year.
5.2.4 Scheduling: Preventative maintenance visits shall be scheduled with the COR/CM at least one month in advance. If the routine procedural scheduling for clinical use of equipment items is in excess of one (1) month in advance, then the preventive maintenance visits must be coordinated at least that far in advance, so as to not require rescheduling patients.
5.2.4.1 Equipment In-Use or Not Available: If, for reasons beyond the Contractor’s control, equipment is not made available for maintenance for the entire thirty (30) days before the maintenance due date, the Contractor shall immediately notify the COR/CM. The Contractor shall arrange the performance via coordination with the COR/CM during circumstances of unexpected delays (i.e. non-availability of the patient care areas due to room occupancy, etc.)
during normal coverage hours, at no additional cost to the Government.
5.2.4.2 Equipment Unable to Locate (UL): If the Contractor is unable to locate an item within the maintenance window specified, the Contractor shall immediately notify the COR/CM. The COR may determine that the property has been disposed of or is otherwise inactive or unavailable for use and adjust Section 1.5.1, accordingly, via official contract modification.
5.3 Corrective Maintenance (Repair Services)
5.3.1 The Contractor shall provide for any corrective maintenance services necessary to maintain equipment within the original manufacturer’s specifications. Corrective maintenance shall include repairs for all listed equipment to include problems resulting from, but not limited to, unintentional damage, normal wear and tear, component part failures, etc.
5.3.2 Requests For Service: The Contractor will not accept any trouble calls other than from Biomedical Engineering Division (BMED) personnel. Contractor trouble call intake from the Biomedical Engineering Division shall include a work order number, indicating that the equipment failure and service needed is properly recorded and included in the equipment’s maintenance history. The Contractor’s personnel only communicate with the TL/CM/COR/CO.
5.3.3 Off-Site Equipment Repairs
5.3.3.1 Equipment Pick-up: The Contractor shall arrive on-site to pick up broken equipment within three (business) days or service request.
5.3.3.2 Equipment Return to Contractor: The Contractor shall be responsible for all shipping costs for equipment that will be shipped to the Contractor’s location. The Contractor will provide acknowledgement of receipt to the COR or assigned Government representative upon receipt of the equipment via email.
5.3.3.3 The Contractor shall provide insurance coverage for damage to or loss of equipment while in Contractor or service Contractor’s custody. The Contractor will provide alternate, interim loaned unit(s) for any equipment requiring repairs outside of the Naval Support Activity Bethesda.
5.3.4 Turn-Around Time: The Contractor shall complete all repairs within fourteen (14) business days of receipt at Contractor’s location. The Contractor shall notify the COR/CM within 14 business days of any extended repairs or delays.
5.3.5 Repair by Exchange: All “repair by exchange” shall be approved in advance by the COR and/or CM. All “repair by exchange” devices will be equivalent or better than presently Government owned equipment.
5.4 Telephone Support: Telephone consultation shall provide instruction in determining operator error, determine the most likely cause of the problem, determine if resolution of the problem requires the equipment to be sent to the Contractor.
5.4.1 The Contractor shall respond telephonically to all requests for telephone support with-in 4 hours.
5.5 Recalls and Updates: The Contractor shall provide notification of any applicable recall or updates and a detail quote if there will be a cost.
5.6 Parts: The Contractor shall provide coverage for all repair and replacement parts necessary to maintain the equipment, listed in Section 1.5.1, within the parameters of the original manufacturer’s specifications.
5.7. Documentation & Reports
5.7.1 100% Service Event Documentation: Upon completion of all services the Contractor must provide a signed service report to the Contract Manager or designated Government representative within five (5) business days. The service report shall indicate all problems addressed, devices checked, parts replaced/repaired, parts ordered, and problem resolution or pending action. Each service report must document the following data legibly, in English, and in complete detail:
