QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF

THE AUTHORITY CITED:

Other similar products do not meet, and cannot be modified to meet, the Government’s requirement for FedRAMP standards and FIPS framework to properly secure the CITOPS information system outlined and established in the Information Operation Contingency Operation Enclave (IOCOE) Cybersecurity Risk Management Framework (RMF).

The Cradlepoint R1900 5G, LTE modem required by the J64 CITOPS Division is unique, highly specialized, and only Cradlepoint authorized resellers, can provide the necessary hardware level required by the Government.Only brand-name Cradlepoint R1900 routers are capable of meeting the Government’s needs. ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT

CONDUCTED:

The Government will continue to conduct market research to determine if there are changes in the marketplace that would enable future competitive actions, i.e. whether there are similar services in the marketplace that provide the same functionality. Information received from this research was used to establish the Government’s estimated cost for this procurement. No competitor service exist in the market at this time.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

Cradlepoint is the sole designer and producer of the R1900-5GB Dual Band 5G, LTE modem and is the only known source to provide original manufactured hardware, software that meets FIPS 140-3 certification in heightening levels of security and protection for federally owned and operated equipment.

10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION:

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

The DLA J64 CITOPS Division is predicated with the assumption that the Cradlepoint R1900 is the best and only viable solution to meet the cellular solution requirements outlined within this document. Multiple testing iterations were conducted and coordination with cybersecurity representatives along with agency frequency managers resulted in the Cradlepoint R1900 satisfying the governments requirements. To encourage competition to the greatest extent possible under the circumstance, all acquisitions for this action have been and will be competitively solicited amongst authorized resellers with contracts for the brand-name cited.

DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government, as a continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure future full and open competition. Requirements will continue to be posted on FedBizOpps to ensure fair opportunity is given and no other providers are available.
