About this file

This is a Brand Name Only Justification document submitted by the Bureau of Indian Affairs for a landscaping equipment procurement for the Northern Cheyenne Agency (Purchase Request 44051035, J&A Control JA26-00171).

The requirement is for specialized skid-steer attachments to support year-round facilities operations: one 90-inch mower for Bobcat skid-steer, one 84-inch angle broom for S76 skid-steer, and one 84-inch angle broom for S260 skid-steer. The procurement will be conducted on a firm-fixed-price basis as a new requirement. The justification cites FAR 13.106-1(b)(1)(i) as the statutory authority permitting other than full and open competition. The agency justifies the brand-name restriction based on engineering compatibility requirements, explaining that Bobcat Company attachments are specifically designed to integrate seamlessly with the existing Bobcat fleet, including hydraulic connections, mounting interfaces, control systems, and operational specifications. Use of non-OEM attachments could void warranties and increase maintenance costs. The contracting officer determined that pricing will be fair and reasonable based on an Independent Government Estimate (IGE) derived from manufacturer websites and local dealer estimates, with competitive quotes to be obtained from multiple authorized Bobcat distributors through a lowest-price-technically-acceptable (LPTA) request for quote. Market research confirmed that multiple vendors can supply Bobcat-brand OEM attachments, although no alternative manufacturers produce attachments guaranteed to meet all compatibility and safety requirements. The requirement will be publicized on sam.gov along with the brand name justification. No sources expressed written interest in the acquisition, and the agency indicated it will continue evaluating alternative equipment options in future acquisitions that could potentially eliminate brand-name restrictions.

FAR 13.106-1(b)(1)(i)

The existing equipment is manufactured by Bobcat Company and is currently in use within the fleet. The proposed attachment must be fully compatible with this equipment, including hydraulic connections, mounting interface, control systems, and operational specifications. Bobcat Company attachments are specifically engineered to integrate seamlessly with existing Bobcat machinery, ensuring proper fit, safe operation, and optimal performance without the need for modification. Use of non-OEM attachments can void or limit existing warranties and increase long-term maintenance costs. Due to these factors, Bobcat-brand attachments are the only products that reliably meet the Government’s minimum technical, safety, and operational needs.

This requirement will be publicized on sam.gov along with the Brand Name Justification.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination is based on the following:

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

9. Any other facts supporting the use of justification of other than full and open competition, such as:

11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Pricing will be evaluated as fair and reasonable using the IGE and competitive quotes obtained through a LPTA RFQ among authorized distributors. This ensures that even though the requirement is brand-specific, multiple vendors will be able to compete, ensuring fair and reasonable pricing to the Government.

Market research was conducted by reviewing product catalogs, manufacturer specifications, online product listings, and available Native American-owned vendors under the appropriate NAICS code. Research confirmed multiple vendors can supply Bobcat-brand OEM attachments and no alternative manufacturer produces attachments guaranteed to meet all compatibility, safety, and integration requirements for the existing fleet.

Agency owned bobcat is engineered to match with bobcat branded attachments.

IGE derived from manufacturer website and local dealer estimates.
