About this file
This document is a Brand Name Justification (BNJ) for the procurement of 44 Cisco 8851 VoIP phones to support the Navy at NUWC Keyport in Keyport, WA. The requiring activity is NUWC Keyport and the contracting activity is the GSA Federal Acquisition Service. The BNJ justifies limiting the procurement to Cisco phones, as the agency's existing Cisco Unified Call Manager system is only compatible with Cisco devices. The market research conducted determined that no other brands could meet the agency's requirements. The procurement will be conducted competitively among vendors on the DoD Enterprise Software Initiative (ESI) Agreement to ensure the government receives the best value. Prior to any future procurements, the market will be reevaluated to assess the availability of other qualified sources.

Cisco Phones
Requisition Number: N0025342068687
1. Identification of the Contracting Activity and the Requiring Agency
The contracting activity is the General Services Administration (GSA), Federal Acquisition Service (FAS), Global Supply Chain Management Branch. The requiring activity is NUWC Keyport in Keyport, WA.
2. Nature/Description of Action
This Brand Name Justification (BNJ) is in response to a requisition received from NUWC Keyport for the one-time purchase of forty-four Cisco 8851 phones.
Manufacturer : Cisco
Part Number: EM-8851-06S, Cisco 8851 VoIP NTSWG Class B Phones; QTY: 44
3. Description of Supplies and Services
In accordance with agency objectives, the government has a need to procure the Cisco 8851 Phones to meet the agency’s needs as outlined in this document.
The following identifies the complete requirement:
P/N: EM-8851-06S
Description: Cisco 8851 VoIP NTSWG Class B Phones
QTY: 44
4. Identification of Justification Rationale
The circumstances and rationale for limiting consideration to select contractors for award are as follows:
In accordance with FAR 8.405-6(b)(1), “Agency requirements shall not be written to require a particular brand name product…peculiar to one manufacturer, thereby precluding consideration of a product manufactured by another company.” An exception to this rule is allowed only if there is a written justification…essential to the Government’s requirement.

Additionally, this limited source justification will document that this brand name requirement is essential to the Government’s requirements, and the market research will indicate that no other brand is qualified to meet the Government’s requirements.
5. Demonstration of the Unique Nature of the Required Supply
On July 31, 2024, the requiring agency submitted a signed BNJ Memorandum in accordance with FAR 6.303-2(b)(2) to limit sources for the purchase of the above reference Cisco phones.
The basis for limiting sources for this acquisition is due to the following:
“The Cisco Unified Call Manager has a compatible device listing available for review. None of the alternatives listed on the TSG Approved Devices List except Cisco devices work with the call manager system currently in place. Alternatives will not work with Keyport’s system and have previously been tested by our Network Team.
Therefore, for this acquisition, the contracting activity is restricting the consideration of NAICS Code 334111 to include Cisco as the only manufacturer that can provide the required phones.
6. Determination that the Order Represents the Best Value
The order will be competitive among vendors on the DoD Enterprise Software Initiative (ESI) Agreement to ensure the government is receiving the most competitive price.
7. Description of the Market Research Conducted
In accordance with FAR 6.303-2(b)(8), the customer has provided detailed market research that has been conducted to justify this RFQ as brand name only. The customer provided that they consulted the list of compatible devices and determined that Cisco is the only applicable manufacturer. A review of GSA Advantage revealed the products are not available via multiple MAS schedules.
However, there are fifteen (15) vendors on the ESI Agreement for Cisco.
8. Statement of Actions to Overcome Barriers to Competition
Prior to any subsequent procurement, the market will be reviewed to assess whether any other qualified sources are available and are able to meet the Government’s requirements.
9. Contracting Officer Certification and Approval
I certify that the justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge and belief. Based on the above, I hereby determine that it is in the best interest of the government and most appropriate for this acquisition to be Brand Name Only.
