52.212-2 Evaluation- Commercial Items Oct 2014

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers and are listed in relative order of importance:

Evaluation Method

Factor 1: Technical Acceptability Technical Acceptability will be determined by evaluating offers on their ability to repair the Hover Landing Lights in accordance with the Statement of Work. Offerors shall be a FAA or EASA certified repair facility and shall provide documentation of certification with their submitted quote. Failure to provide a FAA or EASA repair facility certification with a submitted quote shall result in the quote being removed from award consideration. Offers shall be compliant with FAA Form 8130 or EASA Form 1 air worthiness certification and shall be able to obtain the required technical and engineering data from the OEM.

Factor 2: Past Performance Past Performance will be evaluated to assess the confidence in the offeror’s ability to fulfill the solicitation requirements. The evaluation will consider the offeror’s demonstrated record of relevant performance in performing the required services and will consider areas of quality, meeting delivery schedules, compliance with contractual requirements, and customer satisfaction. Relevant is defined as performing Hover Landing Lights repairs services as stated in the solicitation to other government and/or commercial entities.

The Government intends to use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s Asset Logistics Management Information System (ALMIS) system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS).

If an offeror does not have a record of past performance or past performance information is either unavailable or so sparse that no meaningful rating can be reasonably assigned, the offeror will receive a Neutral Confidence rating.

Factor 3: Price Quotes will be evaluated using the Tradeoff evaluation method. Contract award will be based on a comparative assessment of quotes to determine best value for the Government.

The preferred FOB point for shipments under this requirement is FOB destination. Quotes submitting FOB Origin terms should include all applicable customs, duties, taxes, and shipping charges. Any quote providing FOB Origin terms that does not provide this information shall be removed from consideration for award.

Prices will be evaluated to determine fair and reasonableness. Prices that are extremely low may be judged as an indication the offeror has misunderstood the nature of the work and may be removed from consideration for award. The Government will evaluate prices for each contract period of performance including escalation rates between contract periods. The Government may determine that a quote is unacceptable if the option period prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option.

Offerors are required to submit a completed Schedule attached to the solicitation as an Excel spreadsheet. Failure to submit the price quote in the Excel document may result in the quote being removed from award consideration.

(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
