About this file
This document is an Attachment 3 - Terms and Conditions for a sole source purchase order (No. 70Z03825QJ0000437) from the United States Coast Guard (USCG) to Triumph Engine Control Systems LLC. The solicitation is for repair services of unspecified components, with award expected to be made on a sole source basis due to the unique capabilities of the vendor. Evaluation will be based on price and technical acceptability, with the contract to be awarded to the lowest priced technically acceptable offeror.
Key requirements include submission of a repair turnaround time, FAA 145 or EASA certification, proof of Original Equipment Manufacturer (OEM) authorization, and a certificate of conformance for all repaired parts. Offerors must provide detailed documentation demonstrating their ability to meet all Statement of Work requirements. While the solicitation is primarily targeted at Triumph Engine Control Systems, the document notes that all responsible sources may submit a capability statement or quotation for consideration.

Evaluation Criteria
The provision at FAR 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation.
IAW FAR 6.302-1(b)(2), this order is expected to be awarded on a sole source basis to Triumph Engine Control Systems LLC. (Cage Code 11599). Due to the sole source nature of this acquisition, the basis for award rests with the determination of fair and reasonable pricing and affirmative responsibility determination. However, IAW FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement or quotation which shall be considered by the agency. Award will be made to the lowest priced offeror rated technically acceptable.
Price: The offeror shall provide pricing as requested in the attached spreadsheet titled “Attachment 1 – Schedule – 70Z03825QJ0000437”. Any quantity price discounts and discounts for prompt payment should be included in this section. The offeror’s quotation will be evaluated using one or more of the techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable.
Technical Acceptability: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide a sound, compliant approach that meets all requirements listed in the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of the requirements. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements.
All offerors must provide the following minimum information and documentation with their quotations:
Repair turnaround time to include both the Test and Evaluation (TTE) and repair of units on “Attachment 1 – Schedule – 70Z03825QJ0000437”.
Detailed explanation of any requirement listed in the SOW that cannot be successfully accomplished by the offeror. If not addressed, the United States Coast Guard (USCG) will assume that the offeror does not take exception to any terms or conditions.
FAA 145 Repair Station Certificate or European Aviation Safety Agency (EASA). Original Equipment Manufacturer (OEM) for the repair of components identified in the Schedule must maintain certification for the entire duration of this Purchase Order. Offerors that have completed work for the USCG in the past need only provide this information if it has changed or been updated since the last time the work was performed.
If the offeror is an OEM authorized repair facility and has not previously been approved by the USCG to complete these repairs, they must provide proof with their quote (such as a letter from the OEM) stating that the offeror is approved to complete the repairs. If the offeror does not have proof, then they must provide the additional information listed below.
Offeror must be able to provide a certificate of conformance (COC) with all parts repaired.
Offerors, other than the OEM, a proven OEM-authorized repair facility, or a company that has previously been approved by the USCG to complete these repairs must also provide the following additional documentation. Failure to provide all of the documentation with the quotation may result in the quotation being eliminated from evaluation.
