I. Contracting Activity.

354th Contracting Squadron, Eielson AFB, Alaska

II. Nature and/or description of the action being processed.

The purpose of this justification and approval IAW FAR 6.303 & FAR 6.304 is to justify the acquisition of Hardside Expandable Small Air Mobile Shelters (HESAMS) and the accompanying generator trailers using a brand-name description.

III. Description of supplies/services required to meet agency needs.

The 354th Fighter Wing is in need of a specialized, compact, and exceptionally mobile Special Access Program Facility (SAPF) shelter.

The required shelter to meet limited mission parameters is the HESAMS, exclusively produced by AAR Manufacturing Inc., (Doing Business As - AAR Mobility Systems) Product No. 58205022A07. The criteria are defined by the compact footprint and swift deployment requirements of F-35 mission systems. These systems necessitate precise weight, dimensions, and a streamlined support system for mission execution, a unique capability exclusively delivered by HESAMs manufactured by AAR Manufacturing Inc.

Significant characteristics of the equipment which no other readily available equipment in the commercial market comprises to meet the governments needs are the following:

- Occupies a single pallet position on a 463L cargo system when stored

- Provides a minimum of 160 SqFt when expanded

- Offers a functional workspace when not expanded

- Can be air, rail, and ground transported

- Is capable of being transported by forklift in multiple configurations

- Can be erected by no more than 2 personnel in 15 minutes

- Contains integrated power, communications, and HVAC systems

- Has an embedded Cipher lock for physical security

IV. Statutory authority permitting other than full and open competition.

The Government's mission needs require the use of a brand-name description of products to procure the aforementioned equipment.

Subsequently, IAW FAR 13.501(a) this justification is prepared according to the instructions illustrated in FAR 6.303-2, modified to reflect the use of procedures from FAR Subpart 13.5.

Under these procedures, IAW FAR 6.302-1(c)(1), the statutory authority to allow other than full and open competition for this acquisition of supplies using a brand-name description is 10 U.S.C. 3204(a)(1) "the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency."

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The current required shelter, known as "HESAMS," is exclusively manufactured by AAR Manufacturing. The government has determined that there are currently no other commercial products available that possess the necessary characteristics to meet the mission needs for Eielson's F-35 operations in terms of security, mobility, and size. Through market research, several small businesses authorized as re-sellers of AAR Manufacturing products have been identified.

These businesses express both interest and capability in fulfilling this acquisition. However, despite having multiple small businesses capable of meeting the government's needs, the use of a brand-name description precludes full and

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The 354th Contracting Squadron intends to solicit this as a brand-name specific requirement on SAM.gov under a total small business set-aside with the approved Non-Manufacturer Rule waiver attached.
