Prohibition on Buying, Using, or Contracting with any Entity that Uses Telecommunication Equipment or Services from

Five Named Chinese Companies

A new United States (U.S.) law strictly prohibits U.S. government agencies from:

Buying or using equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such firms or companies); video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such firms or companies)

Contracting with any firm or company that uses any equipment, system, or services that uses the equipment or services of the five Chinese companies named here

This prohibition means Aviano AB must not purchase equipment or services from these named Chinese firms or from other companies that use equipment from these Chines firms.

In order to comply with this prohibition, Aviano Air Base must request and receive a representation from all contractors and suppliers (“offerors”) seeking to do business with Aviano Air Base.

Please complete the following representations:

Offeror [ ] will, [ ] will not provide covered* telecommunications equipment or services to the U.S. Government in the performance of any contract, subcontract or other contractual instrument including Government Purchase Card (GPC) purchases.

Offeror [ ] does, [ ] does not use covered* telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services.

* “Covered” equipment or services means equipment or services from the five Chinese companies named here

These prohibitions and the requirement for representations are further described at Federal Acquisition Regulation (FAR) 4.2101, 52.204‐24, and 52.204‐25
