About this file

This document is Attachment 3 of a federal solicitation containing the evaluation criteria for awarding a commercial items contract. The evaluation employs a two-factor approach under Federal Acquisition Regulation (FAR) 52.212-2, with best value expected to result from selection of the technically acceptable quote with the lowest evaluated price.

Factor 1 addresses Price, whereby the Government will award to the responsible offeror whose conforming quotation is most advantageous, while reserving the right to award to other than the low quote for higher quality items. Factor 2 addresses Technical Acceptability, requiring vendors to demonstrate that their quoted item meets all requirements specified in Attachment 2 (Salient Characteristics). Technical submissions must be completed using a secondary document and provide clear, concise, and sufficiently detailed information for effective evaluation. Quotes receive a binary rating of either "Acceptable" (clearly meets minimum solicitation requirements) or "Unacceptable" (does not clearly meet minimum requirements). The evaluation process is limited to only the three lowest priced quotes deemed technically acceptable. By submission of a quote, vendors accept all solicitation requirements, including technical requirements and terms and conditions, with failure to conform potentially resulting in determination of non-awardability without further evaluation.

RFO Provision 52.212-2, Evaluation -- Commercial Items, applies to this acquisition. As prescribed in RFO 12.205(a)(2), the following addendum is provided for this solicitation and hereby amends any language therein: (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Price

Technical Acceptability

(End of provision)

ADDENDUM TO FAR 52.212-2:

Best value is expected to result from selection of the technically acceptable quote with the lowest evaluated price. By submission of its quote, the vendor accepts all solicitation requirements, including all technical requirements and terms and conditions. Failure to conform to solicitation requirements may result in a quote being determined not awardable without further evaluation.

Only the three lowest priced quotes deemed technically acceptable will be used in the evaluation process. The evaluation criteria are detailed below:

Factor 1 – Price. The Government will award a contract resulting from this solicitation to the responsible offeror whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government reserves the right to award to other than the low quote for a higher quality item.

Factor 2 – Technical. The purpose of the technical factor is to assess whether the vendor’s quoted item meets all of the provided information from the Salient characteristic Attachment. Each vendor’s quote will be evaluated against technical requirements and will be assigned a rating of “acceptable” or “unacceptable.” Technical submission must be completed using a secondary document. The Technical information shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims. Proposals shall provide convincing rationale addressing how the technical portion of the offer meets solicitation requirements. Offerors shall assume the Government has no prior knowledge of the offeror’s experience. The Government will base its evaluation on the information presented in the offer.

Rating Description:

“Acceptable” - Quote clearly meets the minimum requirements of the solicitation.

“Unacceptable” - Quote does not clearly meet the minimum requirements of the solicitation.

The quote will be determined technically acceptable if it meets the requirements set out in the Attachment 2 Salient Charateristics.
