About this file

This document is an Inspection and Acceptance section of a federal contract for Non-Native Invasive Plant Treatment in the Allegheny National Forest. The quality assurance plan details specific performance standards and inspection procedures for invasive plant treatment, with stringent acceptable quality levels (AQL) for different herbicide application methods. The contract requires the contractor to treat sites according to specifications, with Forest Service inspections occurring at the start of the contract, periodically during work, and within 3-4 weeks after treatment to assess vegetation stress and treatment effectiveness.

The document outlines detailed disincentive and payment reduction mechanisms for non-compliance. For example, if less than 1% of treatment areas show inadequate treatment evidence, full payment is authorized. If a contractor must return to rework an area multiple times, payment deductions range from 5% to 8%. Water quality buffer areas have strict requirements, with a 1% cost deduction for every 0.5 acres of non-compliance. If rework cannot be completed within the contract performance period, payment will be reduced by the cost per acre of untreated areas.

Non-Native Invasive Plant Treatment Allegheny National Forest

INSPECTION AND ACCEPTANCE

INSPECTION RECORDS

Contractor shall not be required to maintain an inspection system as stated in Paragraph (b) of Clause 52.246-4, Inspection of Services.

INSPECTION METHODS

In accordance with the Inspection Clause the Government is able to inspect the entire work the Contractor performs, and the Contractor shall be required to rework any areas that are not in conformance to the requirements of this contract.

PERFORMANCE-BASED SERVICE CONTRACT (PBSC) REQUIREMENTS

Performance based disincentives apply to the Government’s inspections for contract noncompliance.

Inspection will be in accordance with the standards indicated in Specification Section 200 and will be accomplished by either the COR or Government Technical Monitor (GTM).

INSPECTION AND ACCEPTANCE

Inspections of the work performed under this contract will be made as the work progresses by the COR/GTM. Inspection will be at intervals necessary to insure compliance with the contract. The Government reserves the right to conduct compliance surveillance of any contractual requirement. The Government will rely on the contractor’s Quality Control system to ensure that services conform to contract quality requirements before they are tendered to the Government for acceptance.

DISINCENTIVE

Non-work: If a contractor has to be sent back to any area that the Government has failed on the 1st inspection and the contractor failed again to fix work the second time, there will be a 5% deduction from their payment for that area. With each following return to the area to fix the work an additional 3% deduction from the final payment for that item will be made.

Buffer Areas: no evidence of herbicide application or equipment use/disturbance within water quality buffer areas = 100% payment. Or there will be a 1% cost deduction for every 0.5 acres of non-compliance found for that item area.

The use of disincentives does not waive any other rights of the Government, in dealing with inadequate performance.

QUALITY ASSURANCE PLAN

Areas to be Inspected

Each Project Area will be inspected as a separate unit. Units will not be averaged with other units for acceptance and payment.

Inspection Procedures

The COR/GTM will inspect each of the project acres, in accordance with specification Division 100-500.

Performance Measures after inspection.

Treatment

Contractor will treat sites according to contract specifications.

Forest Service will be on site at the start of the contract.

Periodic inspections of treatment as work occurs will also take place as work progresses.

Forest Service will inspect sites within 3 weeks of treatment.

Vegetation should be showing signs of treatment stress by then, if not the Forest Service reserves the right for up to 4 weeks after treatment to inspect treatment.

Manual Foliar Herbicide application: If less than 1% of the treatment area’s acres show the following: no evidence of treatment (dye) or the effects from herbicide treatment (yellowing, drooping, death, etc.);

Cut Surface Herbicide application: If less than 1% of the treatment area’s acres show no evidence of dye;

Herbaceous Perennials: cutting of all stems greater than 1 foot = 100% = 100% payment.

Spraying 99% of area shows die back = 100% die back = 100% payment.

Water Quality Buffer Areas:

no evidence of herbicide application or equipment use/disturbance within water quality buffer areas with = 100% payment.

Or 1% deduction for every 0.5 acres of non-compliance found.

Task Performance Standard

Inspection/Surveillance Acceptable Quality Level (AQL)

The contractor will be required to rework sites found to be outside the AQL within contract performance period. If rework cannot be accomplished during contract performance period payment shall be reduced by the cost per acre of the acres not treated for that item.
