About this file

This document is a Contractor Responsibility Verification template used to assess whether prospective contractors meet federal acquisition standards prior to contract award.

The template requires contractors to demonstrate responsibility across six key factors established by RFO 9.104. Financial resources must be evidenced through profit/loss statements, balance sheets, lines of credit, or statements from financial institutions confirming sufficient resources or ability to obtain them. Contractors must confirm their ability to meet delivery or performance schedules while managing existing commercial and governmental commitments. Performance record requirements mandate submission of minimum two past performance examples within the last three years, or a capability statement for new entrants; however, contractors with prior government contracts receiving CPARS or SPRS ratings are exempt. Business integrity and ethics are verified through certification that SAM.gov Responsibility/Qualification information is current and accurate, including disclosure of active or inactive exclusions and proceedings. Organizational structure verification requires confirmation of adequate experience, accounting controls, operational procedures, and technical skills with ability to correct deficiencies. Production capabilities must be documented through information on technical equipment and facilities or demonstrated ability to obtain them. A company representative must certify under penalty of perjury that all information provided in factors (a) through (f) is correct and accurate. This template serves as a standard form for federal acquisition personnel to make affirmative determinations of contractor responsibility before contract award.

RFO 9.103

(a) Award contracts to responsible prospective contractors only.

(b) Do not award a contract award before making an affirmative determination of contractor responsibility. Without a clear indication of responsibility, make a determination of nonresponsibility. If the prospective contractor is a small business concern, comply with the subpart, Certificates of Competency and Determinations of Responsibility, at part 19.

(c) A prospective contractor must affirmatively demonstrate its responsibility, including, when necessary, the responsibility of its proposed subcontractors.

RFO 9.104

To be determined responsible, a prospective contractor must-

(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;

(c) Have a satisfactory performance record (see 9.104-3 (b) and part 42). Do not determine a prospective contractor responsible or nonresponsible based solely on a lack of relevant performance history;

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors) (see 9.104-3(a));

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (see 9.104-3(a)); and
