52.212-2, Evaluation – Commercial Items (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Factor 1 – Technical
Factor 2 – Past Performance
Factor 3 – Price
All proposals will be graded Acceptable or Unacceptable by (1) Technical based on an Acceptable or Unacceptable rating; (2) Past Performance based on an Acceptable or Unacceptable rating; and (3) Price, in order of their price rankings, lowest to highest. Evaluations will cease once an (1) Acceptable technical evaluation and (2) Acceptable past performance evaluation is identified, along with (3) lowest priced selected.
Factor 1 – Technical. To be determined technically acceptable the contractor shall provide an offer that clearly meets the requirements of the Solicitation and the Performance Work Statement.
Technical Evaluation Questions
1. Does Contractor’s past performance demonstrate their ability to provide elevator repair parts, components, and/or assemblies unavailable from the manufacturer due to obsolescence by obtaining engineered equivalent products from commercial sources for elevators identified on the PWS “Appendix, A VTE List”.
2. Is the inquiring contractor licensed by the state (NV) in which the work will be conducted to provide the services specified in this contract? Specifically, does contractor possess “State of Nevada Elevation and Conveyance (Class C7) Contractor’s License”?
3. Are contractor personnel certified by appropriate federal and state regulatory agencies to meet federal and local certification requirements in repair service of VTE elevators? Specifically, do contractor personnel (elevator mechanics/QEI Elevator Inspectors) possess a current “State of Nevada Mechanical Compliance Section Elevator Mechanic Certification in accordance with Nevada Administrate Code: 455C”?
4. Are contractor personnel trained and qualified to provide the services specified in this contract for the 26 elevators listed on “PWS Appendix A” based on elevator manufacturer, elevator type, capacity and year installed/altered?
5. Does the Contractor proposal include proof of active State of Nevada Elevation and Conveyance (Class C7) Contractor License AND active State of Nevada Mechanical Compliance Section Elevator Mechanic Certification in with Nevada Administrative Code 455C?
Technical Acceptable/Unacceptable Ratings:
Rating
Description
Acceptable
The proposal clearly demonstrates a thorough understanding of the requirements, provides all required licenses, and describes an approach to demonstrating how the tasks will be accomplished in accordance with the outlined services summary table in the Performance Work Statement.
Unacceptable
The proposal does not demonstrate an understanding of the requirement. A demonstration of how the tasks will be accomplished is not clearly defined.
Factor 2 – Past Performance. The Government will evaluate the completion of the offeror’s past performance by reviewing the Past Performance Evaluation Survey (Attachment 4).
Past Performance Evaluation Survey, provide evidence of at least (2) two but no more than (5) five recent examples, recency is defined as within the past 3 years, that are relevant to this requirement. Relevant work for this requirement includes having completed maintenance, repairs, and inspection of vertical transportation equipment according to the following table:
Relevancy Assessment:
Rating
Description
Relevant
Contractor has experience performing at least 50% of the work for maintenance, repair, and inspection of vertical transportation equipment on contracts that include servicing 15 or more elevators located in 8 or more buildings.
Not Relevant
Services described were not for performing at least 50% of the work for maintenance, repair, and inspection of vertical transportation equipment.
The Government will evaluate the quality of the offeror’s past performance by analyzing past performance received and other past performance information data independently obtained from Government and/or commercial sources which may include, but not limited to: Contractor Performance Assessment Reporting System (CPARS), the Past Performance Information Retrieval System (PPIRS); Federal Awardee Performance and Integrity Information System (FAPIIS); or other databases.
Offerors without a record of past performance, or for whom information is so sparse that no confidence assessment rating can be reasonably assigned, will not be evaluated favorably or unfavorably on past performance and, as a result, will receive an “Unknown Confidence” rating. A strong record of relevant past performance may be considered more advantageous to the Government than an “Unknown Confidence” rating.
Factor 3 – Price. The Government shall conduct a price evaluation of offers receiving (1) an Acceptable Technical Rating and (2) an Acceptable Past Performance Rating. The Government will utilize an Abstract of Offers by arranging offers from lowest price to highest price. The Government will begin the evaluations with the lowest priced offer. Once a lowest priced, technically acceptable, and responsible offer is identified, evaluations will cease. The Government will evaluate an offer by total price. Initially, the proposals will be ranked according to their total proposed price, inclusive of options. The evaluated price is determined by adding the price of the six-month extension period, in accordance with FAR 52.217-8 Option to Extend Services, to the Proposed Price. The extension period price is then added to the Proposed Price to derive the Evaluated Price. Evaluation of options shall not obligate the Government to exercise the option(s).
If only one offer is received, the Government may use various price analysis techniques and procedures to ensure a fair, reasonable, and realistic price. It is expected that the competitive nature of this acquisition will drive price reasonableness and fairness.
a. Contract may be awarded to the offeror who is deemed responsible and technically acceptable in accordance with FAR Part 9.1, whose offer conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by this RFP) and is judged, based on the evaluation as outlined in this combo synopsis-solicitation.
The Government intends to evaluate proposals and award one (1) contract without discussions with offerors The offeror’s initial proposal shall represent the offeror’s best terms. The Government reserves the right to conduct discussions if the Contracting Officer as deemed necessary.
While the Government will strive for maximum objectivity, the selection process, by its nature, is subjective; therefore, professional judgement is implicit throughout the entire process.
b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
