About this file

This is a Department of the Air Force Justification and Approval (J&A) document for other than full and open competition, issued in May 2026.

The 99 Contracting Squadron, under Air Combat Command, seeks to award a purchase order on a brand name basis to DMI Asphalt Equipment for a mobile asphalt batch plant system to support the 801st Red Horse Training Squadron. The requirement includes two specific part numbers—DMAP-MBV2000 and DMRAP-TD80—along with associated training and installation services. The plant will be used to mix asphalt and produce Hot Mix Asphalt (HMA) for paving projects. The acquisition is valued under $10 million and is justified under 10 U.S.C. 3204(a)(1) on the basis that only one responsible source can satisfy agency requirements. The justification centers on training standardization: the 801st Red Horse Training Squadron previously purchased a DMI batch plant for use in Guam and currently provides 40-hour training to designated members. The contractor is proposing expanded 120-hour training for the existing Guam plant; acquiring an identical system would allow members to complete training on the same equipment model, eliminating the need for dual trainings and preventing readiness gaps and unnecessary manpower expenditure. A sources sought was posted on GSA eBuy using NAICS 333120 and yielded two small business responses; the Ability One procurement list did not contain these items. To overcome the brand name limitation, the 99 Contracting Squadron will continue coordinating with the 801st Red Horse Training Squadron to identify alternative equipment options. The Contracting Officer, SSgt Chase M. Brandt, certified the justification on 6 August 2026, with technical approval from MSgt Xavier Gemba on 24 July 2026.

I. Agency and Contracting Activity (RFO 6.104-1(a)(1)):

Agency: United States Air Force, Air Combat Command Contracting Activity: 99 Contracting Squadron

II. Nature and/or description of the action being approved (RFO 6.104-1(a)(2)):

This document approves the award of a purchase order on a brand name basis to DMI Asphalt Equipment for mobile asphalt batch plant in support of the 801st Red Horse Training Squadron. This justification is made on individual basis.

III. Description of supplies/services required to meet agency needs (RFO 6.104-1(a)(3)):

The 801st RED HORSE Training Squadron (801 RHTS) has submitted a new requirement for a DMI mobile asphalt batch plant. This plant will be used to mix asphalt and produce Hot Mix Asphalt (HMA), used in paving projects.

Part Numbers are DMAP-MBV2000 and DMRAP-TD80 along with training and installation.

IV. Statutory Authority Permitting Other Than Full and Open Competition (RFO 6.104-1(a)(4)):

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

V. Rationale for Use of Authority (RFO 6.104-1(a)(5)):

The 801 RHTS purchased a DMI Batch Plant for use in Guam. They currently provide a 40-hour training for each designated RED HORSE member for the asphalt batch plant. The contractor is proposing a 120-hour training for the current DMI asphalt batch plant in Guam. This would mean that RED HORSE members would need to go through both trainings according to AFI 10-209 requirements and the contractor training being a deployment requirement. Conducting assembly and disassembly training on two different asphalt batch plants would require members to go to both trainings, causing gaps in readiness and unnecessary manpower usage.

VI. Integrated Market Analysis and Efforts to Solicit Competition (RFO 6.104-1(a)(6), (8), and (10)):

A sources sought was posted on GSA eBuy using NAICS 333120 and the salient characteristics that were provided by the customer. This sources sought resulted in two responses, both being small businesses. The ability one procurement list did not have these items listed.

VII. Determination of Fair and Reasonable Cost (RFO 6.104-1(a)(7)):

The Contracting Officer is responsible for evaluating, determining, and documenting the anticipated contract cost/price is fair and reasonable in accordance with RFO Subpart 15.4, Contract Pricing.

VIII. Any Other Facts Supporting the Justification (RFO 6.104-1(a)(9)):

IX. Actions to Overcome Barriers to Competition (RFO 6.104-1(a)(11):

To ensure the Government is taking measures to overcoming the brand name limitation of this requirement, 99 CONS will continue to coordinate with the 801 RHTS to search for any alternative equipment that will meet the needs of the 801 RHTS.
