About this file

This document is a justification and approval for other than full and open competition. The Department of Veterans Affairs requires a standalone contract for subscription access to McGraw-Hill's Access Suite in nine specialty clinical areas including medicine, pharmacy, and surgery. The subscription services would be provided to the Library Network Office from September 30, 2020 through September 29, 2025 with option years extending to September 29, 2024. Pricing is provided annually for each clinical area, ranging from $32,123 for neurology and OB/GYN to $240,250 for medicine. Market research identified one small business, Prenax Inc., as capable but subcontracting limitations under the small business socioeconomic status of McGraw-Hill may preclude an award. Responses were due by September 22, 2020 to solicitation number 36C77620Q0175 issued by the Department of Veterans Affairs Technology Acquisition Center Austin.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID:__ 36C776-20-AP-1668_______________

1. Contracting Activity: Department of Veterans Affairs, Program Contracting Activity Central (PCAC), 6150 Oak Tree Blvd., Suite 300, independence, OH 44131.

2237: 776-20-4-8251-0158

2. Nature and/or Description of the Action Being Processed: This action is a brand name justification to support a standalone contract for the Library Network Office. The VA requires subscription-based access to the Brand Name McGraw-Hill Access Suite in the nine specialty areas of Medicine, Pharmacy, Emergency Medicine, Physiotherapy, Anesthesiology, Hematology, Neurology, OB/GYN and Surgery. This product must include clinical references such as electronic healthcare textbooks/manuals and other resources that will serve to educate and inform students, residents, fellows and other healthcare professionals practicing in the VA medical and administrative facilities to ensure uniform availability of high quality, clinical healthcare knowledge-based resources across the VA system to improve clinical decision making, education, and research. The Library Network Office (LNO) maintains the National Core Collection of Online Resources on behalf of the Department of Veterans Affairs and makes those resources available for use at all medical centers, community out based clinics (CBOC), VISNs and Program Offices.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The scope of work shall consist of providing subscription services for the Office of Health Informatics (OHI) office; LNO. This effort falls in line with VA’s mission, goals and objectives in support of providing Veterans’ care.

Contractors shall be responsible for the management, labor and equipment necessary to provide the brand name subscriptions detailed above. The centralized purchase of these resources began in 2010 to guarantee that equal access to high quality clinical information resources was available to improve clinical decision making at the point of care by insuring the uniform availability of a core collection of knowledge-based information. The current contract expires 9/29/20.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The VIP search conducted on 06/10/20 produced 48 VOSB/SDVOSB results, respectively. An email blast was sent to the 48 VIP query matches to further maximize competition and encourage them to reply should they believe they could meet the requirements. A Sources Sought Notice was published to Federal Contracting Opportunities on 06/10/20. Of the four (4) responses received in response to the market research efforts. One (1) was an SDVOSB and deemed not reasonably capable. Two (2) were SBs, one (1) SB was deemed reasonably capable while the other SB was deemed not reasonably capable because they are not listed as a verified entity in SAM. One (1) was an SDB and deemed not reasonably capable. PRENAX, INC. is the one (1) Small Business that was deemed reasonably capable. The Government determined said vendor as reasonably capable because their capability statement addressed all elements of the RFI instructions. Additionally, McGraw-Hill, the other than Small Business publisher, confirmed the following are SB authorized resellers:

• PRENAX, INC.

• COX SUBSCRIPTION, INC. dba WT COX

• COMPLETE BOOK & MEDIA SUPPLY, INC.

While the Program Office found the one (1) SB as reasonably capable, due to the socio-economic status of McGraw-Hill, the publisher, being Other Than Small Business, the CO does not expect the authorized resellers to meet the limitations on subcontracting clause.

Sources Sought notice 36C77620Q0111 was published to Federal Contracting Opportunities on June 11, 2020. This publication stated, while not an official solicitation, that any responsible source that could meet the requirement defined in the PWS should submit a capability statement to the government point of contact.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

a. Prenax, Inc. (SB)

b. Malosi Solutions (SDVOSB)

c. J2 Industrial Engineering, LLC (SB)

d. Eagle Global Scientific (SB)

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

VA will continue to perform market research in attempts to find other sources before exercising options and or soliciting new awards for the same or similar future acquisitions of the services being acquired.

11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
