Justification and Approval for Other than Full and Open Competition
This is a Justification and Approval (J&A) document for a single-source, brand-name-only procurement by the Uniformed Services University of the Health Sciences (USUHS), Acquisitions Directorate. The requirement is for a germanium detector and cryostat replacement for the GC2518 High Purity Germanium (HPGe) detector at the Armed Forces Radiobiology Research Institute (AFRRI) that recently failed. The procurement will be conducted as a firm fixed-price contract for commercial items using simplified acquisition procedures under FAR Parts 12 and 13, structured as a total small business set-aside. The Contracting Officer will determine fair and reasonable pricing based on competitive quotes in accordance with FAR 13.106-3(a)(1). The estimated value is below the Simplified Acquisition Threshold (SAT).
The J&A justifies single-source procurement from Mirion Technologies, as the AFRRI HPGe Detection laboratory is standardized on Mirion-manufactured systems, and transitioning to an alternative manufacturer would necessitate significant capital expenditures for hardware upgrades and extensive personnel training. Only a Mirion-manufactured germanium detector and cryostat replacement will be compatible with the existing gamma spectroscopy system. Market research confirmed multiple small business distributors are capable of providing this requirement, supporting the small business set-aside. No other sources expressed written interest in the acquisition. The agency plans to monitor the marketplace for alternative sources in future procurements, though upgrades to the existing system are unlikely to be fulfilled by non-brand-name products due to replacement costs and system compatibility constraints.

PROCUREMENT SENSITIVE INFORMATION – FOR OFFICIAL USE ONLY
The following exception under FAR 5.202 applies:
6. Determination by the Contracting Officer that the anticipated cost/price to the
Government will be fair and reasonable.
The Contracting Officer will determine price fair and reasonable based on competitive quotes IAW FAR 13.106-3(a)(1).
7. Description of market research conducted and the results, or a statement of the reason market research was not conducted:
ACQ market research demonstrated multiple small businesses are capable of providing this requirement and there is no justification for dissolving the automatic small business set-aside. The manufacturer identified multiple small business distributors. Therefore, this procurement will be a total small business set aside for commercial items using simplified acquisition procedures IAW FAR Parts 12 and 13.
8. Any other facts supporting the use of other than full and open competition:
N/A.
9. Listing of the sources, if any, that expressed, in writing, an interest in the acquisition:
No other sources expressed an interest in writing in the proposed acquisition.
10. Statement of the actions, if any, the agency may take to remove or overcome any barrier to competition before any subsequent acquisition for the supplies or services required:
ACQ will monitor the marketplace for other potential sources. However, upgrades to this existing system are unlikely to be fulfilled with products other than brand name only due to costs associated with replacing an entire system and compatibility issues.
