About this file
This justification and approval document and related federal contract opportunity outline requirements for a small business set-aside solicitation seeking construction services to renovate the HVAC systems of two buildings at a National Guard facility in Nevada. Specifically, the solicitation will provide for installation of a new variable refrigerant volume HVAC system throughout Buildings 56 and 111, totaling approximately 36,000 square feet, in accordance with provided plans and specifications. The specifications include requirements for pre-insulated PEX carrier pipe from the brand Rehau or approved equals. The pre-solicitation period did not yield any industry challenges to the brand or equal terms. Requesting Brand name or equal for the following products from Rehau on the repair HVAC Bldg 56 and 111 projects. 1. Pre-insulated PEXa carrier pipe
IAW DFARS 206.302-1(c)(2), this J&A is to allow the use of brand name or equal descriptions. Rehau is specifically identified in the specifications for both projects and list characteristics of the products for an or equal. The below descriptions is for the products:
1. Rehau Insulpex - Underground Geothermal Piping (outside building): Pre-insulated PEXa carrier pipe with a corrugated low-density polyethylene (LDPE) jacket. Pipe shall be suitable for 180 degree water at 80 psi. Joints: Nipple with stainless steel clamp. Energy transfer pipe system, where shown on the drawings and schedules, shall include the following: Insulated PEXA pipe and associated fittings, installation accessories including insulation kits and end caps, supervision and field engineering required for the complete and proper function of the system. Crosslinked polyethylene, commonly abbreviated PEX, is made from high density polyethylene (HDPE).
Crosslinking is accomplished during manufacturing. Crosslinking enhances the physical & mechanical properties of the polymer. The high-temperature properties are improved. Chemical resistance is enhanced by resisting dissolution. Low temperature properties are also improved; its impact and tensile strength, scratch resistance, and resistance to brittle fracture are enhanced. The required degree of crosslinking, according to ASTM standard f876-07, is between 70 - 89%. This specification requires PEX to be designated as PEXA and be manufactured by the high-pressure peroxide method. The pipe manufacturer shall warrant the crosslinked polyethylene carrier pipe to be free from defects in material and workmanship for a period of twenty-five (25) years.
This J&A is to support the unchanged verbiage in the specifications.

Based on the specification for this product staying as is, this J&A is to cover the solicitation. During the pre-solicitation there were no challenges or remarks from the industry about the brand name or equal. The specifications allow vendors to submit "or equals" for approval.
In the future, specification will be screened by the Contracting Officer and the Contracting Officer Representative during the A-E submittal process to ensure any limitation on competition to include brand name or equals are removed if possible. This will allow an efficient construction phase during the solicitation. Additionally, this J&A will be posted with the solicitation for the full construction project under W50S8C-20-B-0001.
