About this file
This document contains a Justification and Approval for a sole source procurement and information about a related federal contract opportunity. The sole source J&A supports procuring airflow monitoring and airflow monitoring stations from Ebtron on an HVAC renovation project at Building 56 and Building 111 at the Nevada Air National Guard base in Reno, Nevada. The specifications require Ebtron's brand or equal products with specific characteristics. The J&A allows for this limited competition and states that different companies can provide equivalent products. The related federal contract opportunity is an invitation for bid to award a firm fixed-price construction contract between $1-5 million to provide a new HVAC system at the two buildings. The North American Industry Classification System code is 238220 and it has a small business set-aside with a size standard of $16.5 million in average annual receipts. The pre-bid conference was to occur with bids due as stated in the solicitation, which is available on beta.sam.gov. Funds may become available by September 30, 2020 and the Army National Guard is the contracting agency.

Different companies can provide the one brand name or equal product. The COR engaged with the A-E to state additional manufacturers or to re-word the specifications. Based on the specification for this product staying as is, this J&A is to cover the solicitation. During the pre-solicitation there were no challenges or remarks from the industry about the brand name or equal. The specifications allow vendors to submit "or equals" for approval.
In the future, specification will be screened by the Contracting Officer and the Contracting Officer Representative during the A-E submittal process to ensure any limitation on competition to include brand name or equals are removed if possible. This will allow an efficient construction phase during the solicitation. Additionally, this J&A will be posted with the solicitation for the full construction project under W50S8C-20-B-0001.
