About this file

This document is a tailored evaluation provision for commercial products and commercial services under FAR 52.212-2, effective February 1, 2022. It establishes the evaluation criteria and award methodology for quotations submitted in response to a Government solicitation for commercial items.

The Government will award a purchase order to the responsible quoter whose conforming quotation provides the most advantageous value, considering price and other factors. Quotations will be evaluated using three primary factors: Price, Technical or Quality, and Speed of Delivery. The evaluation employs a comparative process where quotations are assessed against one another rather than against a fixed standard. The Government reserves discretion to select a quotation other than the lowest price if it provides additional benefits and meets minimum requirements. Price evaluation is calculated by summing all line-item prices to determine the Total Evaluated Price. Technical or Quality evaluation assesses the extent to which a quotation meets or exceeds Government requirements as specified in the solicitation; authorized distributors of brand name equipment must provide an authorized distributor letter from the Original Equipment Manufacturer (OEM). Speed of Delivery evaluation considers the estimated delivery date and the rapidity of delivery. All responses must satisfy minimum solicitation requirements, and alternate quotations are not permitted.

ADDENDUM to 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES

(a) Basis for Award. The Government will issue a purchase order to the responsible quoter whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

(b)The following factors shall be used to evaluate quotations:

1. Price

2. Technical

3. Speed of Delivery

(c) Evaluation Approach. The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2 (b) (3), where quotations will be compared to one another to determine which provides the best benefit to the Government. The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s).

Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation but is not required to do so. Each response must meet the minimum requirements of the solicitation. The Government is not requesting or accepting alternate quotations. The evaluation will consider the following:

(1) Price: The Government will evaluate the price by adding the total of all line-item prices. The Total Evaluated Price will be that sum.

(2) Technical or Quality: The quotation will be evaluated to the extent to which it can meet and/or exceed the Government’s requirements as outlined in the solicitation and based on the information requested in the instructions to quoters section of the solicitation.

Authorized distributors of brand name equipment shall provide an authorized distributer letter from the Original Equipment Manufacturer (OEM).

(3) Speed of Delivery: The Government will evaluate the estimated delivery date of the procurement and the speed at which it can be delivered.
